It is preferred that they are downloaded free of charge on the City of Middletown web site: www.MiddletownCT.gov. Bids will not be publicly opened in the Municipal Building, however, bids will be opened and read aloud via Webex. Additional information and a link will be provided on our website www.middletownct.gov for those interested in viewing the bid opening via Webex.
The City of Middletown reserves the right to waive any defect or any irregularity in any bid and reserves the right to reject any or all bids or any part thereof. Bids, and amendments to bids received after the time set for the bid opening will not be considered. All bids must be completely filled out when submitted. No bid may be withdrawn for a period of ninety (90) days subsequent to the opening of bids without the City of Middletown's written consent. Withdrawal of any bid must be submitted in writing to the City of Middletown.

Date and Place for Opening Proposals - Pursuant to the"Invitation to Bidders", sealed proposals for performingthe work will be received by the Purchasing Departmentat the time and place set forth therein with the award tobe made as soon as practicable.Bids received prior to the date set for receipt will besecurely kept sealed. All bids received by the time set forreceipt will be opened by the Supervisor of Purchasesand read publicly at the exact time set for receiptirrespective of any irregularities therein. Bidders and ortheir representative and any interested public may bepresent.making him responsible and liable for failure to executeas prescribed.6. Time for Executing Contract and Damages for Failureto Execute - Any bidder whose proposal shall be acceptedwill be required to execute the contract within ten (10)days, including Saturdays and Sundays, of the date ofmailing of a notice, stating that the award has been madeto him or his firm. Failure or neglect to do so shallconstitute a breach of contract for which the City maycancel the notice of award, award the bid to someoneelse, or rebid the entire project as well as sue fordamages.2. Printed Form for Proposals - All proposals must bemade upon the blank proposal form as attached hereto;should give unit prices both in words and figures; mustbe signed and acknowledged by the bidder whereindicated on the proposal form; sealed in an envelopeusing the bid return label provided.Damages for such a breach of contract will include butnot be limited to the loss of any awarding of work to himand other items whose accurate amount will be difficultor impossible to compute, and all other damagesrecoverable at law and in equity.3. Omissions and Discrepancies - Should a bidder finddiscrepancies or omissions from the Contract Documentsor should he doubt their meaning, he shouldimmediately notify the Supervisor of Purchases who maysend written instructions to all bidders. Bidder musttype or use black pen at all times.4. Acceptance or Rejection of Proposals - The Cityreserves the right to accept or reject any or all proposals.Without limiting the generality of the foregoing, anyproposal which omits a bid on any one or more items onthe price sheet may be rejected; any proposal containingmodifications or changes to the price sheet may berejected; any proposal in which unit prices are omittedor in which unit prices are obviously unbalanced may berejected.5. Acceptance of Proposals and the Effect - Within sixty(60) calendar days after the opening of the bids, the Citywill act upon them. The acceptance of a proposal will beeither a notice of award, in writing, or an acceptanceletter from the Supervisor of Purchases, and no other actshall constitute the acceptance of a proposal. All bidpricing shall be held firm for the minimum of sixty (60)calendar days from the date of opening of bids, unlessspecified otherwise.The acceptance of a proposal shall bind the successfulbidder to execute the contract within the time andmanner as set forth within these contract documents7. Determination of Lowest Responsible Bidder/Award -Except where the Owner exercises the right herein toreject any or all proposals, the contract will be awardedby the owner to the "Lowest Responsible Bidder", asdetermined under the factors to be considered undersection 78-9(f)(2), as amended, of the Middletown Codeof Ordinances.It is the intent of the city to award one (1) contract in theaggregate to the lowest responsible bidder, complyingwith these specifications, submitting the lowest totalcost to provide the services as specified, providingsufficient funding is available to award this contract. Thebid will be awarded to lowest responsible bidderthat can complete the job in the specified timerequired in the bid regardless of any specializedequipment the vendor chooses to use.Additionally, in determining whether a bidder qualifies asthe lowest responsible bidder, the City shall also reviewother subjective factors, such as the bidder’s skill, abilityand integrity to perform the work as specified, thebidders professional references (if required), the biddersreputation, information discovered during the interviewprocess (if applicable) and whether the City in its solediscretion determines that awarding the bid to thebidder will be in the best interests of the City. The Cityshall award the contract to the lowest responsible bidder4using the guidelines set forth herein, or shall reject allbids.8. Term of Contract and Work Order Time frame - Thecontractor, if required, shall commence or be availableto work at the City's request upon receipt of a pre-approved purchase order which shall serve asauthorization to proceed from the City. The successfulbidder shall be available to provide the minimum ofeight (8) hours of service to the City per week on an on-call basis. The contractor shall further be available toprovide service based on a two-week responsenotification, forty eight (48) hours response notificationand four-hour emergency response notification. A four(4) hour response time is required for all emergencyassignments.The term of this contract shall be for a period of twelve(12) months commencing on or after July 1, 2026 andterminating on June 30, 2027.specifications or other data in sufficient detail to enablethe Supervisor of Purchases to determine the equality orsuitability of the product or method. In general, theSupervisor of Purchases will neither approve nordisapprove particular products prior to the opening ofthe bids; such products will be considered when offeredby the bidder for incorporation into the work.The Purchasing Supervisor will arrange as Addenda,which shall become a part of the contract, all questionsreceived as above provided and the decision regardingeach. The Purchasing Supervisor will post said addendato the City website at www.middletownct.gov. Non-receipt of said Addenda shall not excuse compliance withsaid addenda. It is the bidder’s responsibility todetermine whether any addenda have been issued and ifso whether he/she has received a copy of each. Nothingin this section shall prohibit the Purchasing Supervisorfrom posting Addenda to extend the deadline for thereceipt of bids at any time and for any reason.9. Prices - In the event of discrepancy between the unitprices quoted in the proposal in words and those infigures, the words shall control. The prices are to includefurnishing all equipment, labor, materials and incidentalsnecessary to comply with the City's requirements. Forthe purpose of this contract the bidder shall provide acost per tree location to provide tree removal/pruningand stump grinding services. Also requested is an hourlyrate at various locations which shall include all materials,labor, equipment, mileage to and from the work site andincidentals required.10. Interpretations and Addenda - No oralinterpretations shall be made to any bidder as to themeaning of any of the Contract Documents or to beeffective to modify any of the provisions of the ContractDocuments.Every request for an interpretation shall be made inwriting, addressed and forwarded to the Supervisor ofPurchases, Municipal Building, 245 DeKoven Drive,Middletown, Connecticut, 06457. Questions may besent via facsimile to (860) 638-1995 or emailed atpurchase@middletownct.govTo receive consideration, such questions shall besubmitted in writing. Deadline for submission ofquestions is 12:00 PM, Wednesday, June 3, 2026 (EST).If the question involves the equality or use of products ormethods, it must be accompanied by drawings,It is the responsibility of each bidder to visit our websiteat www.middletownct.gov to view additionalinformation and/or acknowledge any addenda’s issuedprior to submitting a bid.No alleged "verbal interpretation" shall be held valid.Any addenda issued during the bidding period shallsupersede previous information.11. Insurance - The selected vendor shall be required toprovide a Certificate of Insurance as specified in theattachment "Insurance Requirements". The vendor shallbe required to provide evidence of such insurancecoverage to the Supervisor of Purchases within ten (10)days from receipt of the Notice of Award. Evidence ofsuch insurance coverage and City approval shall berequired prior to the execution of the contractdocument.12. Indemnification - The successful bidder agrees todefend, indemnify and hold harmless the Owner, itsofficers, agents, servants and employees against any andall liability, judgments, cost, expenses and other loss, andagainst all claims or actions including but not limited tothose based upon or arising out of damage or injury(including death) to persons or property caused by orsustained in connection with the negligence of theSuccessful Bidder, its officers, agents, servants andemployees in the performance or lack of performance of5
