REQUEST FOR PROPOSALS (RFP) FOR THE OPERATION OF THE CITY OF MARIETTA'S AQUATIC CENTERREQUEST FOR PROPOSALS (RFP)FOR THE OPERATION OF THECITY OF MARIETTA'S AQUATIC CENTER1. INTRODUCTION
The City of Marietta is seeking to obtain a qualified service provider to operate the City of Marietta Family Aquatic Center for the 2026 pool season. The successful “Provider” shall be required to do all things necessary to open, operate and staff the aquatic center with qualified staff. The Provider shall have the option to extend the contract, upon the same terms and conditions, for one (1) additional pool season, to-wit: the 2027 pool season upon acceptance and the express written agreement of the City of Marietta.
2. GENERAL OVERVIEW AND PROVISIONS
The following sections describe the basic rules governing the Request for Proposal (RFP) process.
2.1. PURPOSE OF THIS REQUEST FOR PROPOSAL
The purpose of this Request for Proposal is to seek proposals that meet the specifications listed in Section 4 (aquatic management) of this RFP. It is the City of Marietta's intention to select the proposal which best meets its anticipated needs at the lowest cost. All proposals will be evaluated in accordance with the Criteria listed in Section 3, Paragraph 3.10 of this RFP.
2.2. SCOPE OF THE RFP
This RFP is not an offer to purchase, but a request to receive proposals to operate the City of Marietta's Aquatic Center. It contains instructions for proposal responses and requirements that must be met for eligibility. The City of Marietta reserves the right to accept or reject any or all proposals.
Although the aquatic management provider must submit a proposal for the entire RFP, the City of Marietta reserves the right to accept or reject any part or segment of the total proposal. Providers may be excluded from further considerations for failure to fully comply with the specifications of this RFP. It is each Provider's responsibility to read the entire RFP and submit completed RFP responses by the required dates indicated in Section 2, Paragraph 2.4 of this Document.

All laws of the United States and the State of Ohio, and the Codified Ordinances of theCity of Marietta in so far as they apply, are made a part hereof.2.3.2. This RFP, and any subsequent contract as a result of this RFP, will be governed by andconstrued in accordance with the Laws of the State of Ohio.2.3.3. The Provider must provide a disclosure of any pending or threatened court actionsand/or claims against the Provider, parent company or subsidiaries. THE RFP PROCESSThis section provides particular instructions for various steps in the RFP process. All Providersshould pay particular attention to paragraphs 3.4.4.5 Operations Plan, 3.8 Evaluation Criteria,and Section 4, the Specifications. All Providers must provide an operational plan explaininghow they will provide the services set out in the Specifications. This plan will be judgedaccording to the Evaluation Criteria stated in Section 3, Paragraph 3.8.3.1. PROVIDER RESPONSIBILITIESAll Providers are responsible for being thoroughly familiar with all provisions of this RFP, anysubsequent addenda, the facilities involved and the specifications contained herein. Thefailure of the Provider to do the foregoing does not relieve the Provider from any obligationwith respect to the proposal submitted.3.2. All proposals must be complete, including cost information and signatures by aProvider's representative authorized to bind the firm, corporation or partnership or otherbusiness entity. Any proposal to offer an alternative to meet the requirements must be notedand explained as to how the alternative offered will meet the intent of the RFP. Any proposalwhich is incomplete, conditional, contingent, obscure, or which contains irregularities of anykind, may be rejected. Proposals not received by the specific date and time will be rejected.3.3.2. No person, firm or corporation shall be allowed to make or file more than one (1)proposal for the same work, unless alternate proposals are called for. A person, firm orcorporation who has submitted a sub proposal to a Provider, or who has quoted prices onmaterials to a Provider, may submit a sub proposal or quote prices to other Providers.3.3.3. In submitting a proposal, the Provider affirms that the proposal is genuine and notcollusive or a sham and that the Provider is not financially interested in, or otherwise affiliatedin a business way with any other Provider on the same contract.3.3.4. In submitting a proposal, the Provider affirms that all statements contained in theproposal are true and accurate.3.4. PREPARATION OF PROPOSALThe preparation of a proposal must not deviate from the noted requirements and shouldprovide clear and concise information to satisfy the requirements.3.4.1. Proposal Cost - Costs incurred developing proposals are to be entirely borne by theProviders and will not be reimbursed under any circumstances. All supporting documentationand manuals submitted with this proposal will become the property of the City of Marietta.All proposals and associated documents are public record.3.4.2. Number of Copies - One (1) signed original proposal must be received in the office ofthe Mayor of the City of Marietta, 301 Putnam Street, Marietta, Ohio, 45750 up to the hour of11:00 A.M. on April 7,2026.3.4.3.
