NOTICE TO BIDDERS(REVISED)PUBLIC NOTICE IS HEREBY GIVEN that sealed bids will be received by the BOROUGH OFBEACHWOOD for the 2025 NJEIT BEACHWOOD WATER MAIN PROJECT in Borough ofBeachwood, Ocean County, New Jersey..Bid forms, contracts and specifications are available by contacting Remington & Vernick Engineers.Contact shall be made by phone or by email to make bid purchase arrangements. At 732-286-9220 or bysubmitting RVEbidinterest@rve.com.The bid opening date for the “2025 NJEIT BEACHWOOD WATER MAIN PROJECT” wasoriginally scheduled to be held on May 5th, 2026, at 11am. However, the bid opening date for the “2025NJEIT BEACHWOOD WATER MAIN PROJECT” will be moved to May 19th, 2026, at 11:00 amat the Administration Building, 1600 Pinewald Rd, Beachwood, NJ 08722.Electronic download link for copies of the bid forms, contracts and specifications may be obtained fromsaid Remington and Vernick Engineers, by prospective bidders upon request, upon payment of the sum of$50.00 for each set. Should interested bidders not have the ability to handle electronic download sets, aset may be arranged to be sent overnight by calling 732-286-9220.NO BIDS ARE TO BE PICKED UP AT THE ENGINEER’S OFFICE OR AT THE MUNICIPALITYOFFICES.PAYMENT MUST BE RECEIVED PRIOR TO OBTAINING SAID SPECIFICATIONS.NO BIDS ARE TO BE DROPPED OFF AT THE ENGINEER’S OFFICE.ALL BIDS ARE TO BE DELIVERED PRIOR TO THE BID OPENING DATE AND TIME.The scope of work for this project consists of the replacement of the water mains Compass Avenue,Beacon Avenue, Clubhouse Road, Bayside Avenue, Ship Avenue, Harpoon Street, and LarboardStreet in the Borough of Beachwood, Ocean County, New Jersey. It will also involve the installationof new copper water services and fire hydrants.The Borough of Beachwood reserves the right to consider the bids for sixty (60) days after the receiptthereof, and further reserves the right to reject any or all bids, either in whole or in part and also to waiveany informality in any and make such awards or take action as may be in compliance with the New JerseyLocal Publics Contract Law N.J.S.A. 40A:11-1 et. Seq.If indicated, bid proposals must be accompanied by a certified check, cashier's check, or bid bond in theamount of ten per centum (10%) of the total amount of the bid, but not in excess of twenty thousand($20,000) dollars and made payable to the Borough of Beachwood.The award of the contract shall be made subject to the necessary moneys to do the work being providedby the Borough of Beachwood in a lawful manner. The contract to be executed by the successful bidderwill provide that it shall not become effective until the necessary moneys to do the work have beenprovided by the Borough of Beachwood in a lawful manner. The award shall further be subjected to thesecuring of necessary State, Federal or Local permits governing the work.NTB-1Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq., N.J.A.C. 17:27(Affirmative Action), N.J.S.A. 34:11-56.25 et seq.(New Jersey Prevailing Wage Act), and Americans withDisabilities Act of 1990 (42 U.S.C. S12101, et seq.).The contractor is further notified that he must comply with N.J.S.A. 52:25-24.2 and submit a DisclosureStatement listing stockholders with his bid.The contractor is further notified that he must comply with N.J.S.A. 34:11-56.48 et seq. Public WorksContractor Registration Act and he and any subcontractors must be registered in accordance with the act.The contractor is also further notified that he must comply with N.J.S.A. 52:32-44 and submit proof ofbusiness registration and submit proof of business registration for any named subcontractors in accordancewith the act.This contract or subcontract is expected to be funded in part with funds from the New Jersey Departmentof Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State ofNew Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies oremployees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract.This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10.The project is funded in part by the New Jersey wastewater treatment financing programs and thesuccessful bidder must comply with all the provisions of N.J.A.C. 7:22-9 et seq. for the participation ofsmall business enterprises owned and controlled by socially and economically disadvantaged individuals(SEDs). This invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill theSED utilization requirements. The agencies specified in N.J.A.C. 7:22-9.13(a)8 will have a list of eligibleSED firms and shall, upon request, provide them to the MUNICIPAL CORPORATION. TheMUNICIPAL CORPORATION, during the bidding phase, will provide copies of the list to all Contractorson unrestricted contracts.N.J.A.C. 7:22-3.17(a)24, 4.17(a)24, 6.17(a)24 and 7:22A-2.4(a) provide that a goal of not less than 10percent be established for the award of contracts to small business concerns owned and controlled by oneor more socially and economically disadvantaged individuals. The goal of 10 percent applies to the totalamount of all contracts for building, materials and equipment, or services (including planning, design andbuilding related activities) for a construction project. The project sponsor has identified that the SEDutilization goal for this project is TEN (10%) PERCENT.The 10 percent SED utilization requirement shall be accomplished by the following:1. Bids shall be solicited on an unrestricted basis. The bid documents, however, shall include a statementto the effect that the successful bidder must fulfill the SED utilization requirements by subcontractingportions or the work to SEDs; or2. Contractors also have the option of establishing unrestricted bidding procedures to fulfill the TEN(10%) PERCENT SED utilization requirement for the project.All project sponsors, at least 10 days prior to public advertisement for bids, shall notify the NJDEP Officeof Equal Opportunity and Public Contract Assistance via H2Loans, of the availability of opportunities forSEDs to provide services, to bid on unrestricted contracts or subcontracts, or to provide any other necessarypurchase or procurement.NTB-2Awards will be made only to socially and economically disadvantaged business concerns that are certifiedby the New Jersey Commerce, Economic Growth and Tourism Commission, the New Jersey Departmentof Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agenciesdeemed appropriate by the Office as eligible minority businesses or female businesses. The invitation tobid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements.Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 (P.L.1975, c.127, Affirmative Action); P.L. 1963. C150 (New Jersey Prevailing Wage Act); and Americanswith Disabilities Act of 1990 (42 U.S.C. 12101, et.seq.).Pursuant to N.J.A.C. 10:5-33, “Bidders are required to comply with the requirements of P.L. 1975, c. 127.”The contractor is further notified that he must comply with P.L. 1977, c. 33, and submit a DisclosureStatement listing stockholders with his bid.The contractor is further notified that he must comply with P.L. 1999 c.238 Public Works ContractorRegistration Act and he and any subcontractors must be registered in accordance with the act.The contractor is also further notified that he must comply with P.L. 2004 c. 57 and submit proof ofbusiness registration and submit proof of business registration for any named subcontractors in accordancewith the act.In accordance with N.J.A.C. 7:22-3.17(g) and N.J.A.C. 7:22-4.17(g), all applicable surety bonds requiredin connection with the advertisement and award of building contracts or sub-agreements must be writtenby a surety company listed on the Federal Treasury List (Department Circular 570-Surety CompaniesAcceptable on Federal Bonds), incorporated herein by reference.
