NOTICE TO BIDDERSNOTICE is hereby given that sealed bids will be received by the Township of Galloway (here-inafter called the "Owner") for:WAVELAND AVENUE BULKHEAD REPLACEMENTCONTRACT NO. 89Notice is hereby given that sealed bids for the above named Contract, which is comprised of abulkhead replacement and roadway restoration on Waveland Avenue in the Township ofGalloway, Atlantic County, New Jersey (“Owner”), will be received at the Municipal Complexin the Township Clerk’s office at 300 E. Jimmie Leeds Road (Atlantic County Route 561),Galloway, New Jersey 08205 on Tuesday, December 2nd, 2025 at 10:00 a.m. prevailing time, atwhich time they will be publicly unsealed and the contents publicly announced.The work for CONTRACT NO. 89, WAVELAND AVENUE BULKHEAD REPLACEMENT,includes the furnishing of all labor, materials and equipment necessary to complete the workshown on the Drawings and as described in the Specifications. The work consists of thereplacement of approximately 85 linear feet of bulkhead, construction of two stormwater inlets,installation of approximately 80 linear feet of stormwater culvert pipe, final roadway restorationvia the HMA milling and resurfacing of approximately 460 square yards of roadway, installationof approximately 125 linear feet of beam guide rail, application of traffic markings, and theassociated turf repairs on Waveland Avenue. The work is located within the Township ofGalloway on Waveland Avenue between Fifth Avenue and Sixth Avenue. The work shall becompleted within one hundred and twenty (120) days of the Notice to Proceed or be subject toliquidated damages of $500.00 per day.No bid will be received unless in writing on the forms furnished, and unless accompanied by bidsecurity in the form of an original bid bond or certified check made payable to the Owner in anamount equal to 10% of the amount of the total bid, provided that the said security need not bemore than $20,000 nor less than $500.00 and be delivered at the place on or before the hournamed above.The bid shall be accompanied by a Certificate of Surety on the form included in the ContractDocuments, from a surety company licensed to do business in the State of New Jersey, whichshall represent that the surety company will provide the Contractor with the required bonds in thesums required in the Contract Documents and in a form satisfactory to the Owner's Attorney andin compliance with the requirements of law. Each bidder shall submit with his bid a “Statementof Ownership Disclosure” and “Non-Collusion Affidavit” on the forms included in the ContractDocuments. All submitted bid documents must be originals and no photocopies will beaccepted. Bidders are strongly encouraged to visit the site in-person prior to submitting a bid.Bidders must use the prepared proposal form that is contained in the Contract Documents. Eachindividual proposal must be separately enclosed in a sealed envelope addressed to the Owner andmarked on the outside with the number of the contract(s) and name of the project being bid on.After receipt of bids, no bid shall be withdrawn except as expressly authorized herein. TheOwner shall award the Contract or reject all bids within 60 days of bid opening, except that thebids of any bidders who consent thereto may, at the request of the Owner, be held for consider-ation for such longer period as may be agreed.The Owner will evaluate bids and any award will be made to the lowest, responsive, responsiblebidder. The Owner reserves the right to reject any or all bids and to waive minor informalities orirregularities in bids received.Successful bidders must provide a photocopy of their “Certificate of Employee InformationReport” or the pink copy of the AA-302 form within seven (7) days after the notification ofintent to award the contract or receipt of contract, whichever is sooner. Failure to do sowill result in the bid being rejected as non-responsive.Successful bidders will also be required to submit bonds and proof of insurance on or beforeexecution of their respective Contracts as explained in the Contract Documents.Bidders are required to comply with all relevant Federal and State Statutes, Rules and Regula-tions including but not limited to the applicable provisions of Chapter 127, PL 1975 andSupplements thereto Laws Against Discrimination (Affirmative Action), the State requirementfor bidders to supply statements of ownership (N.J.S.A. 52:25-24.2) and the State requirementfor submission of the names and addresses of certain subcontractors (N.J.S.A. 40A:11-16).Prospective bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et. seq. andN.J.A.C. 17:27 (Contract Compliance and Affirmative Action for Public Contracts). A copy ofthe Law is available at the Township Clerk’s Office upon request and is made a part of the bidspecifications.Public Works Contractor Registration pursuant to N.J.S.A. 34:11-56.48 et. seq. is required for allprojects/contracts which include construction, reconstruction, demolition, alteration, repair ormaintenance work on a public building. All Contractors and Subcontractors are required tosubmit a copy of their Business Registration Certificate issued by the NJ Division of Taxation(PL 2004, c57 effective 9-1-04).Challenges to bid specifications must be made, in writing, addressed to the Owner, at least, three(3) business days prior to the bid opening date. Challenges filed otherwise will not beconsidered.The Contract Documents may be examined and must be obtained from Polistina & Associates,6684 Washington Avenue, Egg Harbor Township, New Jersey 08234 (Phone 609-646-2950)between the hours of 8:00 a.m. and 4:00 p.m. Prospective bidders will be issued plans andspecifications upon payment of a fee of $150.00 for each set of full-sized drawings withspecifications. Payment must be made by either cash or business check, which shall be made outto Polistina & Associates, LLC.If the Contract is awarded, no refunds will be given. If for any reason the Contract is notawarded, refunds will be made to bidders pursuant to N.J.S.A. 40A:11-24(b) when the ContractDocuments are returned in reasonable condition within 90 days of notice that the Contract hasnot been awarded.It is the purpose of this Notice to Bidders to summarize some of the more important provisionsof the Contract Documents.
