STATEMENT OF PURPOSE:1. Overview and GoalsThe goal of this solicitation is to secure a source to purchase Landscape Maintenance for theSouthside Wastewater Treatment Plant for the Water and Sewer Department of the City of Tulsa.2. Term of ContractThe City intends to award a one-year annual contract. The City may offer the Seller the opportunityfor additional one-year terms. The City also reserves the right to make multiple or partial awards. Todo business with the City, You must agree to the terms and conditions of the City’s standardPurchase Agreement, indicated by Your Authorized Agent’s signature on the Purchase Agreement.Capitalized terms used in this IFB and not defined in the Purchase Agreement shall have themeanings as ascribed to them in Title 6, Chapter 4 of the Tulsa Revised Ordinances.The entire Invitation for Bid (IFB), including any additional information submitted by Bidder andAccepted by City will be included as part of the Agreement between Seller and City. All sheets ofthis IFB (including Sections I-VI) must be submitted.Authorized AgentSeveral parts of the Bid (Affidavits, Purchase Agreement) must be signed by an “AuthorizedAgent.” An Authorized Agent means an agent who is legally authorized to bind the Seller under thelaw of the state in which the Seller is legally organized. For instance, under Oklahoma law, theAuthorized Agent for each of the following types of entities is as stated below:o Corporations – the president, board chair or board vice chair (or the vice president if the corporationwas formed in Oklahoma) can sign; others can sign if they have and provide the City with (i) a corporateresolution giving them authority to bind the Seller, and (ii) a recent certificate of secretary indicatingthe authority is still valid and was in full force and effect on the date of the signature. (See IFB SectionVI for sample of a Certificate of Secretary)o General Partnerships – any partner can sign to bind all partners.o Limited Partnerships – the general partner must sign.o Individuals – no additional authorization is required, but signatures must be witnessed and notarized.o Sole Proprietorship – the owner can sign. Any other person can sign if s/he provides a recent Powerof Attorney, signed by the owner, authorizing him/her to bind the sole proprietorship.o Limited Liability Company (LLC) – any manager of the LLC elected by the members of the LLC, orany member signing as manager of the LLC. All other signers will need a Consent of Members signedby all the Members of the LLC authorizing their signature on or up to 30 days before the date of theirsignature. SCOPE OF SERVICES AND SPECIFICATIONS1. Scope of ServicesThe City is requesting Bids for Landscape Maintenance for the Southside Wastewater TreatmentPlant for the Water and Sewer Department.Delivery RequirementsAll prices quoted shall be based on delivery F.O.B. Tulsa, Oklahoma or to any other points as maybe designated in the Specifications, with all charges prepaid by Seller to the actual point of delivery.Bids must state the number of Days required for delivery under normal conditions.Absolutely no items over 500lbs. may be directly shipped to the City requiring the City personnel tounload from the shipping truck or trailer. The City carries no responsibility for any damages incurredduring an unloading occurrence. All unloading shall be the responsibility of the Seller and/or shippingentity.2. SpecificationsThe Bid must meet or exceed the following Specifications.Seller will be familiar with this type of work and have the necessary equipment and personnel toperform the work within the time specified. Seller will be responsible for all labor, equipment, andmaterial required.Bidders must submit equipment and employee lists with their Bid. The City reserves the right tovisually inspect and verify equipment before awarding the Bid.Licensing: Bidders must provide copies of current State of Oklahoma Commercial PesticideApplicators Licenses with their Bid. All licenses must be current and valid. The Seller is required tosatisfy all licensing requirements of the State of Oklahoma Department of Agriculture.Seller will be responsible for compliance with all applicable federal, state, and municipal laws andordinances and shall be subject to product testing of chemicals used. Such test(s) may be conductedat any time by the City of Tulsa or the State Department of Agriculture.Chemical Use: Seller will strictly adhere to all application rates, instructions, requirements, andprocedures of the product label. The City’s Plant Representative will report any chemical misuse bySeller to the State Department of Agriculture. Seller will be solely responsible for any fines orpenalties resulting from said misuse. One application rate will be used for all acres treated during anapplication. The rate of chemical applied on a per acre basis shall never exceed the manufacturer’smaximum allowable amount recommendation, as established in the Environmental ProtectionAgency’s label for non-cropland areas. Seller must have labels and Safety Data Sheets for allchemicals they are applying in their possession at the time of application. All chemicals applied forvegetation control must be approved by the Environmental Protection Agency and the State ofOklahoma Department of Agriculture for their intended use.Bidders shall have a formal written safety program and provide a copy of that program along withtheir Bid.Seller shall always be responsible for the character and actions of its employees while working onthis Agreement. Any disrespectful or discourteous actions toward the public will not be tolerated.IFB Rev 02/20244TAC 383E | Landscape Maintenance – Southside Wastewater Treatment Plant | Issue Date: 01/05/2025The work may not be sub-contracted to any other company or individual without requesting such inwriting and receiving prior written consent from the Southside Plant Representative.Any sub-contractor permitted will have the same insurance, licensing, and performance bond, andall other requirement of these specifications as the Seller.The amount to be contracted will depend upon the need and the funds available and there is noguaranteed level of work.Examination of Work Sites:Bidders shall be responsible for examining the work sites and be familiar with work required at eachsite. Bid submission is taken as evidence that the Bidder is familiar with the work site and workrequired. A tour of the work sites will be available immediately after the Pre-Bid Conference.Secondary or Back-Up Seller:City reserves the right to purchase from a Secondary or back-up Seller to be used in the event offailure of the primary source(s) ability to supply the full needs of the City.Seller will make a concerted effort to meet the City’s needs daily. Seller will give City as muchadvance notice as possible whenever they are unable to supply the service(s) required.General Specifications:A. The Southside Plant Representative will determine if and when mowing is appropriate andneeded. Work will not be permitted whenever the Plant Representative determines that thecondition of the grounds is not adequate to accommodate the Seller’s equipment. Work willnot be permitted when conditions are wet or when the ground is soft. No work will be permittedon “ozone” days.B. The Seller must be contactable by the City during normal business hours, 8:00 AM to 5:00PM Monday through Friday. Calls made to the Seller must be returned within 2 hours fromthe time the message is left. Current phone number and address must be on file with thePlant Representative at all times.C. It is expected that services will begin within 72 hours from the time notification is provided tothe Seller. Failure to meet either the 2-hour or 72-hour time requirements will be consideredas a failure of the primary source to supply the full needs of the City and may result in theCity contacting the Secondary Seller for the service needed.D. All materials, tools, and equipment used in performing the work outlined herein will befurnished by Seller and must be removed from the site at the end of each working day orproperly secured with prior approval from the Plant Representative. City will not beresponsible for equipment left on City property.E. The Plant Representative will be available for consultation and supervision from the start dateof the Agreement until completion. If at any time it is determined by the Plant Representativethat the work performed is in violation of the Agreement, the Plant Representative may stopthe work until the problem is resolved.IFB Rev 02/20245
