Additional products, equipment, and services maybe accepted as approved Substitutions only by written Addendum.From time to time, the Commission issues new editions of the “State of Ohio Standard Requirements for Public FacilityConstruction” and may issue interim changes. Bidders must submit Bids that comply with the version of the StandardRequirements included in the Contract Documents.The project is financed with grant assistance from Federal Aviation Administration and is subject to the Davis-BaconAct and Related Provisions. The total amount of the federal grant is $TBD.The requirements of 49 CFR Part 26, Regulations of the U.S. Department of Transportation, apply to this contract. It is thepolicy of the Airport Sponsor to practice nondiscrimination based on race, color, sex or national origin in award orperformance of this contract. These requirements apply to all Bidders/Offerors, including those who qualify as aDisadvantaged Business Enterprise. Per the provisions of Federal Regulation 49 CFR Part 26.55, qualified DBE firms thatsubcontract work to a non-DBE firm shall deduct the amount of the non-DBE subcontract from the total amount of the DBEparticipation that counts toward meeting the Owner’s DBE participation goal.The DBE goal of 0% is established for this contract.Federal Aviation Administration (FAA) provisions/clauses apply to federally funded construction projects per the ContractProvision Guidelines for Obligated Sponsors and Airport Improvement Program Projects document issued by the FAA onNovember 18, 2022.The project must comply with 49 USC § 50101, Buy American Preference, BABA and other related Made in AmericaLaws,1 U.S. statutes, guidance, and FAA policies, which provide that Federal funds may not be obligated unless all iron,steel and manufactured goods used in AIP funded projects are produced in the United States, unless the Federal AviationAdministration has issued a waiver for the product; the product is listed as an Excepted Article, Material Or Supply inFederal Acquisition Regulation subpart 25.108; or is included in the FAA Nationwide Buy American Waivers Issued list.M160-00 10 00.EB2025-OCTPage 1 of 2OSU-240504-2Airport Airfield Lighting ImprovementsThe Bidder must indicate on the electronic Bid Form, in the spaces provided or by attachment, the locations where itsservices will be performed, in accordance with the requirements of Executive Order 2019-12D related to providing servicesonly within the United States. The Bidder must also affirm its compliance with Executive Order 2022-02D prohibitingpurchases from or investment in any Russian institution or company. Failure to do so may cause the Bid to be rejected asnon-responsive.DOMESTIC STEEL USE REQUIREMENTS AS SPECIFIED IN OHIO REVISED CODE SECTION 153.011APPLY TO THIS PROJECT.
