ONE WATER MARBLE FALLS 3 MGD PLANT & RELATED FACILITIES CMAR PROJECT

PROCUREMENT PACKAGE 2 – 3 MGD ONE WATER PLANT, OFF-SITE LIFT STATION, PIPELINE, ELECTRICAL I&C.

MGC Contractors, Inc. has been selected by The City of Marble Falls to act as the Construction Manager at Risk (CMAR) for the One Water 3 MGD Wastewater Treatment Plant & Related Facilities. MGC Contractors will receive proposals for the bid packages included in this advertisement via electronic submission until 2:00 pm CT at www.opengov.com (Project ID: CIPWW-20210420 #2) on the day of December 4th, 2025.

Contract Documents, including Drawings, Technical Specifications, and Instructions to Bidders are on file and available for download at www.opengov.com. Project ID: CIPWW-20210420 #2. Please use the project portal on www.opengov.com for all questions.

Prospective proposers are advised to study the Instructions to Bidders to maintain compliance with all proposal submittal requirements. Proposals must be submitted on the forms provided in the bid package documents unless otherwise stated. This advertisement includes the following bid items:

Bid Package 1 – 3 MGD One Water Plant

Bid Package 2 – Off-Site Lift Station

Bid Package 3 – Pipeline

Bid Package 4 – Electrical, Instrumentation and Controls (3MGD One Water Plant and Off-Site Lift Station)

Bid Package 5 – Long Lead Equipment

This contract is subject to the Environmental Protection Agency's (EPA) Disadvantaged Business Enterprise (DBE) Program, which includes EPA-approved fair share goals toward procurement of Minority and Women-owned Business Enterprise (M/WBE) businesses. EPA rules require that applicants and prime contractors make a good faith effort to award a fair share of contracts, subcontracts, and procurements to M/WBEs through demonstration of the six affirmative steps. This contract is to be funded through a loan obtained from the Texas Water Development Board as part of the Clean Water State Revolving Fund. There are several special provisions for this funding that bidders, by submitting a bid, acknowledge understanding, including the following: A contract is contingent upon release of funds from the TWDB. Any contract or contracts awarded under this Notice to Bidders are expected to be funded in part by financial assistance from the TWDB. Neither the State of Texas nor any of its departments, agencies, or employees are or will be a party to this Invitation for Bids or any resulting contract. The contractor shall carry   out applicable requirements of 40 CFR Part 33 in the award and administration of contracts awarded under TWDB financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach, which may result in the termination of the awarded financial assistance. The project will consist of the following:

It is anticipated that Procurement Package 2 will have an NTP in January 2026, and scope of work substantially completed in compliance with CMAR’s Schedule. Failure to meet the completion date will result in assessment of Liquidated Damages at a rate of $1,500.00/day substantial then $1,000.00 for final.

Small and minority firms are encouraged to submit bids for this project. All Offerors will be required to submit a statement of qualifications and provide specific company information meeting the requirements of the Bid Package. The Contract Team may conduct investigations as considered necessary to establish the responsibility, safety ratings, qualifications, and financial ability of the Offerors, proposed Subcontractors, and other persons and organization’s ability to do the work in accordance with the Bidding Documents, to the Contract Team’s satisfaction and performed within the prescribed time. The Contract Team may reject the proposal of any Offeror who does not meet any such evaluation to the Owner’s, Engineer’s and/or CMAR's satisfaction. The Team conducting the review and making the best value selection will be made up of representatives from MGC, Marble Falls, and Plummer.

MANDATORY PRE-PROPOSAL MEETING AND SITE VISIT

A pre-proposal meeting will be held on October 30th, 2025, at 10 A.M. We are pleased to invite you to the Mandatory GMP 02 Preproposal Meeting and Site Visit for the Marble Falls 3 MGD Plant and Related Facilities Project. This meeting will be held both in-person and online via Microsoft Teams (See Link Below). The Preproposal Meeting will commence at the Marble Falls Lakeside Pavilion, located at 305 Buena Vista Drive, Marble Falls, TX 78654 followed by a walkthrough of the job site for the new 3 MGD Plant (in-person only). The jobsite tour will occur at 2000 Colt Circle, Marble Falls, TX 78654. We look forward to your participation.

The right is hereby reserved to accept or reject any or all proposals or parts thereto, to waive any informality in any proposal, and reject the proposals of any persons who have been delinquent or unfaithful to any contract with Owner, Engineer and/or CMAR. Bids may be held by MGC Contractors Inc. for a period not to exceed one hundred twenty (120) days from the date of the proposal submission for the purpose of reviewing the proposals and investigating the proposers' qualifications prior to the contract award. Contract negotiations will be offered to the first best value selection contractor. If unable to negotiate, the next best rated contractor will be selected.
