If the Bidder is unable to certify, the Bidder shall provide a detailed andprecise description of such activities to the Department.By submitting its bid to the Department, the Bidder warrants that no person or selling agency has been employed or retained by theBidder to solicit or secure such Contract upon an agreement or understanding for a commission, percentage, brokerage or conti ngentfee, except bona fide employees or bona fide established commercial or selling agencies maintained by the Bidder for the purp ose ofsecuring business, for the breach or violation of which warranty the Department shall have the right to annul such Contract without2liability or in its discretion to deduct from the contract price or consideration the full amount of such commission, percentage, brokerageor contingent fee as required by N.J.S.A. 52:34-15.Pursuant to N.J.S.A. 34:11-56.35(d), if the Commissioner of the Department of Labor and Workforce Development (LWD Commissioner)makes an initial determination that an employer has violated the provisions of P.L.1963, c.150 (C.34:11-56.25 et seq.) by paying wagesat rates less than the rates applicable under that act, the LWD Commissioner may immediately issue a stop-work order to cease allbusiness operations at every site where the violation has occurred, and may assess a civil penalty of $5,000 per day against theemployer for each day it conducts business operations in violation of the stop-work order. If the stop-work order is issued against asubcontractor, the general contractor may terminate that subcontractor from the project in accordance with N.J.S.A. 34:11-56.35(d).Pursuant to the DIANE B. ALLEN EQUAL PAY ACT, N.J.S.A. 34:11-56.14(b), the Contractor shall provide to the Commissioner of the NewJersey Department of Labor and Workforce Development, through certified payroll records required pursuant to P.L.1963, c.150(C.34:11-56.25 et seq.), information regarding the gender, race, job title, occupational category, and rate of total compensation of everyemployee of the employer employed in the State in connection with the Contract. The Contractor shall provide the Commissioner,throughout the duration of the Contract, with an update to the information whenever payroll records are required to be submittedpursuant to P.L.1963, c.150 (C.34:11-56.25 et seq.).
