The City of Siloam Springs, Arkansas invites qualified professional firms that are recognized on the Arkansas Natural Resources Commission Rate Study Provider approved list to submit qualifications to conduct Phase 1: Impact Fee Implementation & Capital Planning.

Proposals may be submitted to the City of Siloam Springs no later than 12 noon on June 30, 2026. All proposals should conform to the format described in this Request for Qualifications and should be submitted to the attention of:

All submittals should include three (3) complete hard copies and one (1) electronic copy of the proposal in a sealed envelope marked "RFQ FOR PHASE 1: IMPACT FEE & CAPITAL PLANNING.”

Proposals will be opened and evaluated in private. From the proposals submitted, the City will select firms for further consideration. Additional information may be requested from these firms, and the City may schedule interviews prior to making a final selection. The City reserves the right to reject any or all responses, waive any irregularities or formalities in responses received, modify or terminate the RFQ process at any time, and negotiate the final scope of services and compensation with the selected firm(s).  Issuance of this RFQ does not obligate the City to award a contract or implement any impact fee program.

SCOPE OF SERVICES – PHASE 1: IMPACT FEE IMPLEMENTATION & CAPITAL
PLANNING
The selected consultant will utilize existing City studies, models, and planning documents to
support the implementation of water and wastewater impact fees and to develop a coordinated 5-
year Capital Improvement Plan (CIP). This phase is intended to leverage available information to
expedite decision-making and minimize redundant analysis.
1. Background and Objectives
Compile and summarize existing information related to the City’s water and wastewater
systems, including current infrastructure, planning documents, and known system
constraints.
Confirm the City’s objectives for implementing impact fees, including:
o Ensuring new development pays its proportionate share of system expansion
costs.
o Supporting funding of growth-related capital improvements.
o Maintaining fairness and legal defensibility.
o Developing sufficient technical analysis and documentation to support a
reasonable nexus and rough proportionality between new development impacts
and any proposed impact fees.
Define the scope and limitations of Phase 1 based on available data and identify any
critical data gaps.
Identify and document any assumptions required where existing studies, models, or data
are incomplete or unavailable.
2. Data Compilation and Review
The consultant will collect, review, and synthesize the following existing materials:
2025 Utility Rate Study
Water Treatment Plant Long Range Plan
Water System Hydraulic Model
Wastewater Treatment Plant 5-Year Repair and Replacement Plan
Current and upcoming water and wastewater capital projects
Relevant portions of prior master plans and planning-level cost estimates
The consultant will evaluate the consistency and usability of these materials for impact fee
development and capital planning.
The consultant shall independently evaluate the suitability, consistency, and reliability of existing
studies, models, and planning documents for purposes of impact fee implementation and shall
identify any material limitations, assumptions, or data gaps that could affect the resulting
methodology or recommendations.
3. Growth-Related Capital Improvement Plan (5-Year CIP)
Develop a 5-year Capital Improvement Plan focused on projects required to serve
anticipated growth.
Identify and clearly separate:
o Growth-related capital improvements that expand system capacity and may be
eligible for impact fee funding
o Repair, replacement, maintenance, operational, or deficiency correction projects
that are not growth-related and are not eligible for impact fee funding except to
the extent directly attributable to growth
Prioritize projects based on:
o Capacity needs identified in the provided studies, models, and planning
documents
o Regulatory or operational drivers
o Timing of anticipated development
Develop planning-level cost estimates and project timing for inclusion in the CIP.
The CIP shall identify projects intended to serve existing demand separately from
projects attributable to anticipated new development.
4. Impact Fee Methodology and Calculation
Develop a development impact fee methodology consistent with applicable constitutional
and statutory principles governing development impact fees, including Arkansas Code
Annotated § 14-56-103 and other applicable Arkansas law governing development impact
fees.
Allocate growth-related capital costs identified in the CIP to new development.
Determine appropriate service units (e.g., ERCs or equivalent) and calculate impact fees
for:
o Water Treatment Plant
o Wastewater Treatment Plant
o Collection & Distribution Systems
Provide clear documentation supporting the methodology to ensure transparency and
defensibility.
Provide all supporting assumptions, growth projections, service unit calculations, cost
allocations, and technical analyses utilized in development of the proposed fees.
Deliver editable electronic calculation models, spreadsheets, and supporting worksheets
used in preparation of the fee calculations.
5. Financial Alignment (Planning-Level)
Provide a high-level review of how impact fee revenues align with planned capital needs.
Identify any anticipated funding gaps or timing mismatches between development-driven
revenue and project delivery.
Coordinate impact fee revenue projections with the proposed CIP.
Identify any assumptions regarding growth rates, timing of development, debt financing,
grants, or other funding sources utilized in preparation of the analysis.
6. Stakeholder Coordination
Coordinate with City staff to review assumptions, data inputs, and draft findings.
Facilitate working sessions to confirm:
o Project eligibility (growth vs. non-growth)
o Growth assumptions
o Fee structure approach
Present draft and final recommendations to:
o Siloam Springs Utility Commission
o Siloam Springs Board of Directors
Coordinate with City staff and legal counsel regarding implementation considerations and
preparation of adoption-ready materials.
7. Regulatory Compliance
Ensure the impact fee methodology and implementation approach comply with Arkansas
Code Annotated § 14-56-103 and other applicable federal, state, and local legal
requirements governing development impact fees.
Provide guidance on required adoption procedures, including public notice and
documentation.
Develop an impact fee methodology and fee schedule that reasonably relates the impacts
of new development to the costs of growth-related public facilities attributable to such
development.
Consultant shall develop the methodology in a manner intended to support the City’s
compliance with applicable constitutional and statutory standards governing development
impact fees.
Consultant shall identify any legal or procedural limitations associated with reliance on
existing studies, plans, or assumptions.
8. Reporting and Deliverables
Prepare a Phase 1 Technical Memorandum and Final Report that includes:
o Summary of data sources and assumptions
o 5-year growth-related Capital Improvement Plan
o Impact fee methodology and calculated fees
o Supporting tables, cost allocations, and service unit calculations
Provide implementation-ready materials, including:
o Editable electronic copies of all models, spreadsheets, calculations, assumption
tables, and supporting worksheets used in development of the study.
o Documentation identifying which projects are growth-related versus non-growth-
related and the basis for such classifications.
o Supporting narrative sufficient to assist the City in preparation of findings and
ordinance materials related to any proposed impact fee program.
o Draft ordinance language, implementation materials, and supporting exhibits (if
requested)
o Fee schedules and supporting exhibits
9. Implementation Support
Provide support during the City’s adoption process, including presentations and responses
to stakeholder questions.
Assist with minor refinements to the impact fee model based on feedback during
adoption.
Provide reasonable post-adoption clarification or technical support regarding
interpretation of the methodology and supporting documentation, if requested by the City.
10. Project Management
Provide project management services to ensure timely completion of Phase 1.
