LEGAL NOTICE
Sealed bids for the “Pataskala BMV Alterations Project Rebidwill be accepted by the Licking
County Board of Commissioners on Tuesday, December 16, 2025 at 1:00 pm where they will be
publicly opened and read aloud. Late submissions will not be opened. Sealed envelopes should
be addressed to the Licking County Board of Commissioners, 20 South Second Street, Newark,
Ohio 43055 with the project name clearly marked on the outside.
Bids must include 2 copies, and one thumb drive. No Bidder may withdraw its bid within 60
days after the bid opening. The Owner reserves the right to waive irregularities in bids, to reject
any or all bids, and to conduct such investigation as necessary to determine the lowest and best
bidder.
A Bid Surety in the form of a certified check, cashier’s check, or letter of credit pursuant to
Section 153.54 of the Ohio Revised Code in the amount of ten percent (10%) of the total bid
shall accompany each bid. Or a Bid Guaranty and Contract Bond pursuant to Section 153.571 of
the Ohio Revised Code in the amount of one hundred percent (100%) of the total bid shall
accompany each bid.
Drawings & Specifications prepared by JBA Architects. Submit all questions to Greg Cotterman,
JBA Architects, (T: 740-366-3391; email: glcotterman@jbapc.net ). Documents may be obtained
from JBA Architects for the nonrefundable cost of $90/set. Shipping costs are separate and the
bidder’s responsibility. Plans and Specifications will be available November 24, 2025. Electronic
copies are available at no cost

INSTRUCTIONS TO BIDDERS
1. EXAMINATION OF CONTRACT DOCUMENTS AND SITE
A. Each Bidder shall have a competent person carefully and diligently review each part of the Contract Documents,
including the Divisions of the Specifications and parts of the Drawings that are not directly applicable to the Work
on which the Bidder is submitting its bid. By submitting its bid, each Bidder represents and agrees, based upon
its careful and diligent review of the Contract Documents, that it is not aware of any conflicts, inconsistencies,
errors, or omissions in the Contract Documents for which it has not notified the Design Professional in writing at
least four (4) days prior to the bid opening. If there are any such conflicts, inconsistencies, errors, or omissions in
the Contract Documents, the Bidder (i) will provide the labor, equipment, or materials of the better quality or
greater quantity of Work and/or (ii) will comply with the more stringent requirements. The Bidder will not be
entitled to any additional compensation for any conflicts, inconsistencies, errors, or omissions that would have
been discovered by such careful and diligent review, unless it has given prior written notice to the Design
Professional.
B. Each Bidder shall have a competent person carefully and diligently inspect and examine the entire site and the
surrounding area, including all parts of the site applicable to the Work for which it is submitting its bid, including
location, condition, and layout of the site and the location of utilities, and carefully correlate the results of the
inspection with the requirements of the Contract Documents. The Bidder’s bid shall include all costs attributable
to site and surrounding area conditions that would have been discovered by such careful and diligent inspection
and examination of the site and the surrounding area, and the Bidder shall not be entitled to any Change Order,
additional compensation, or additional time on account of such conditions. If requested, Owner may provide
Bidder access to the site to conduct such examinations, investigations, explorations, tests, and studies as Bidder
deems necessary for submission of a Bid. Bidder shall fill all holes and clean up and restore the site to its former
condition upon completion of such explorations, investigations, tests, and studies. The Owner will work to allow
such investigations and may require the explorations, investigations, tests and studies be made available to all
Bidders. Bidder shall comply with all applicable Laws and Regulations relative to excavation and utility locates.
C. The Bidder may rely upon the general accuracy of any technical data included in the Project Manual in preparing
its bid, but such technical data are not part of the Contract Documents. Except for the limited reliance described
in the preceding sentence, Bidder may not, if awarded a contract for the Work, rely upon or make any Claim
against the Owner or Design Professional, or any of their agents or employees, with respect to any of the
following:
1. the completeness of such reports and drawings for Bidder’s purposes, including, but not limited to, any
aspects of the means, methods, techniques, sequences, and procedures of construction to be employed
by the successful Bidder and safety precautions and programs incident thereto;
2. other data, interpretations, opinions, and information contained in such reports or shown or indicated in
such drawings; or
3. any interpretation by the successful Bidder of or conclusion drawn from any technical data or any such
other data, interpretations, opinions, or information. For example, all interpolations and extrapolations of
data performed by the Bidder to estimate locations or quantities of subsurface strata are independent
factual assumptions, which Owner does not warrant.
D. No allowance will be made subsequently for any omission, error, or negligence of the Bidder.
E. All Bidders shall be familiar with the existing conditions in the material and labor markets, as well as the
conditions related to the Work, and the fact that a bid is submitted will be construed by the Owner as an
agreement by the Bidder to carry out the improvements in full conformance with the Specifications and other
Contract Documents, notwithstanding the existing conditions.
F. Each Bidder shall be responsible for coordinating its Work with the Work of the Owner and/or other bid packages
that require integration of the Bidder's Work.

G. Failure of a Bidder to attend the pre-bid meeting, which failure to attend results in the Bidder not fully being
familiar with the existing conditions and Project Requirements, shall not be considered a basis for additional
compensation to the successful Bidder for the Work. Each Bidder will be deemed to have actual knowledge of all
information provided or discussed at the pre-bid meeting.

3. PROJECT: LICKING COUNTY COMMISSIONERS: PATASKALA BMV ALTERATIONS

The Project consists of all labor, materials, and services necessary for the timely and proper completion of minor
interior alterations and finishes in accordance with the Contract Documents.

The Project consists of a single general contract bid package as permitted by the Ohio Revised Code.

Bidders shall use complete sets of Contract Documents in preparing bids. Neither the Owner nor the Design
Professional assumes any responsibility for errors or misinterpretations resulting from the use of incomplete sets of
Contract Documents.
The Owner or the Design Professional, in making the Contract Documents available on the above terms, do so only
for the purpose of obtaining bids on the Work and do not confer a license or grant for any other use.
7. PRE-BID MEETING
A pre-bid meeting will be not be held this is a rebid. Bidders can contact Owner if visit to site is needed.
8. PREPARATION OF BIDS
A. All bids must be submitted on the "Bid Form" furnished with the Contract Documents.
B. All blank spaces shall be filled in, in ink or typewritten, in words and figures, and in figures only where no space is
provided for words, and signed by the Bidder. The wording on the Bid Form shall be used without change,
alteration, or addition. Any change in the wording or omission of specified accompanying documents may cause
the bid to be rejected. If both numbers and words are requested for any bid item, the amount in words shall
prevail if there is an inconsistency between the numbers and words written.
C. Bidders shall note receipt of Addenda on the Bid Form. If the Lowest and Best Bidder fails to acknowledge
receipt of each Addendum, the Bid shall be deemed non-responsive, unless the Bid amount reflects receipt of the
Addendum or the Addendum involves only a matter of form and does not affect the price, quantity or quality of
the Work to be performed.
D. Each Bidder shall submit one (1) copy of its bid to the Owner. The Bid Form shall be signed with the name typed
or printed below the signature. A bid shall not be submitted by facsimile transmission. A Bidder that is a
corporation shall sign its bid with the legal name of the corporation followed by the name of the state of
incorporation and the legal signature of an officer authorized to bind the corporation to a contract.
E. Each bid shall be enclosed in a sealed opaque envelope with the Bidder's name and the title of the Project
printed in the upper left hand corner and addressed as follows: Licking County Board of Commissioners, 20
South Second Street, Newark, Ohio 43055. Bids must be received at the designated location for the bid
opening before 1:00 PM, local time, on Tuesday, December 16, 2025. If the bid is delivered by other than
personal delivery, it shall be enclosed in a separate envelope with the notation “SEALED BID ENCLOSED FOR
LICKING COUNTY BOARD OF COMMISSIONERS: PATASKALA BMV ALTERATIONS. DELIVER
IMMEDIATELY TO THE CLERK” on the face of the envelope, with the date and time of the bid opening written
on the envelope. Each Bidder is responsible for delivery of the bid to the designated location prior to the
deadline for accepting bids.
F. The completed Bid Form shall be accompanied by the Bid Guaranty (see Section 9 below).
G. The Bidder shall take the following precautions in preparing its bid:
1. Sign the bid and check to insure all blank spaces have been filled in with requested information and that the
specified accompanying documents (listed in Item F above) have been included in a sealed opaque
envelope addressed as described in Item E above.
2. When the Bid Form provides for quoting either an addition or deduction for an Alternate item, indicate
whether the sum named is an addition or deduction. If no indication is given as to whether the amount
stated is an addition to or a deduction from the Base Bid Amount, the amount stated will be assumed to be
an addition to the Base Bid Amount, unless the wording for the alternate indicates that it is a deduct item.
3. When the Bid Form provides for quoting a unit price, the Bidder should quote the unit price as set forth in the
Bid Documents.
4. When applicable, make sure that the Bid Guaranty is properly executed and signed by:
