Late ProposalsIt is the responsibility of the Proposer(s) to see that their proposals have sufficient timeto be received by the Purchasing Department before the submittal deadline.Any proposal, portion of a proposal, or unrequested proposal revision received at theCity of Bangor Purchasing Department after the time and date specified, will be returnedto the proposer unopened.Bid No. P26-28Page 2 of 14Backhoe/Loader (Life Cycle Costing)VI. Withdrawal of ProposalsNo proposer may withdraw their proposal for a period of ninety (90) days from the dateof opening. All proposals shall be subject to acceptance by the City during this period.To withdraw a proposal prior to the opening, the proposer shall request the withdrawalin writing. All costs associated with the withdrawal (i.e. mailing fees) will be borne by theProposer.VII.AwardThe bid award will be based on one or more of the following:1. Ownership Cost of the equipment offered per the life cycle/total cost.2. Quality and performance of the equipment offered3. Availability of the equipment4. Qualifications of Proposer, and/or prior history or experience with theequipment offeredVIII.RejectionThe City of Bangor reserves the right to reject any and all proposals, to waive anyinformalities or defects in proposals or to accept a higher cost proposal if it is deemed tobe in the best interest of the City of Bangor. The City also reserves the right to negotiatewith the successful proposer.IX. Information for ProposersProposals should be based up the following guidelines:1. The entire unit and all equipment must be thoroughly inspected, serviced andready for use upon delivery to the Fleet Maintenance facility no later than 60 daysfrom the date of award.Conditions for the Total Cost Bid Agreement:NOTE: The successful proposer must post a Fulfillment Bond in the amount of theguaranteed buy back of the equipment to guarantee that the successful proposerwill fulfill all of his/her obligations under this agreement, and the cost of this Bondshall be reflected in the price quoted on the bid form. The Fulfillment Bond mustbe received by the City before payment is issued.1. It is understood that the equipment purchased under this agreement will be operatedby City personnel for general construction work and other purposes for which theequipment is designed, including snow removal.2. The City will assume responsibility for all repair costs resulting from damage due tofire, windstorm, flood waters, lightening, theft, vandalism, accidents and operators’Bid No. P26-28Page 3 of 14Backhoe/Loader (Life Cycle Costing)or mechanics’ negligence. Total cost of the repairs due to the above circumstanceswill not be included in computing the guaranteed maximum total cost of repairscovered under this agreement.3. The successful Proposer shall pay for all repairs (including parts and labor) to theequipment covered by the manufacturer’s warranty, and these costs shall not beincluded in the total cost of repairs. Minor work may also be performed by thesuccessful Proposer at the Fleet Maintenance garage at no additional cost to theCity.4. The City will assume, at its sole expense, all costs to repair or replace all parts andcomponents normally consumed in day-to-day operations such as: lubricating oil,filters of all types, grease, fuel, anti-freeze, cutting edges, batteries, headlights, glassbreakage, belts, brake linings, cleaning and painting, tires, and tire repairs.5. The City will maintain the equipment in accordance with the manufacturer’srecommendations.6. The successful Proposer has the right to inspect the equipment during normalworking hours and make recommendations for repairs or maintenance, to complywith the requirements stated by the manufacturer in the shop manual for themaintenance and repair of the equipment.7. The successful Proposer will be fully responsible for the total cost of all repairs (otherthan in paragraph 4) in excess of the guaranteed maximum cost of repairs (asindicated on the Bid Form) for the time of operation in hours, or period of time inyears, from the date of delivery, whichever occurs first. These costs will be paid bythe successful Proposer upon receipt of an invoice from the City.8. In determining the guaranteed total cost of such repairs, and in the enforcement ofparagraph 7, the following rules shall apply:a. In the event that the cost of individual repairs, including parts and labor ascomputed by the Fleet Maintenance Department is less than $500.00, the Cityshall have the right to make the repair at the Fleet Maintenance facility. Noticeto the successful Proposer prior to the repair being made will not be required.All work performed by Fleet Maintenance under the terms of this agreement willbe reported to the successful Proposer within thirty (30) days of its completion.b. In computing the cost of repairs, all City labor and equipment charges will beactual costs, including travel time. The City will bear the cost of transportationof the equipment from the field to the maintenance headquarters to which theequipment is assigned. Transportation costs to and from any other repair sitewill be a part of the cost of repairs. Repair parts shall be purchased from thesuccessful Proposer.Bid No. P26-28Page 4 of 14Backhoe/Loader (Life Cycle Costing)c. If the cost of repairs is in excess of $500.00, as estimated by the FleetMaintenance Department, the successful Proposer will be notified so that anestimate can be prepared. Such repairs may be made by the service departmentof the successful Proposer and billed to the City at the prevailing rate. If,however, the Proposer agrees, then such repairs will be made in the CityMaintenance Facility, in which event the cost of such repairs shall be computedon the same basis as that set forth in subparagraph 8(b).d. Repairs may be made in service departments other than that of the successfulProposer or the City by mutual agreement.e. During the period which may exceed the guaranteed maximum repair cost,repairs made at the Fleet Maintenance facility will be computed as persubparagraph 8(b) and billed to the successful Proposer for payment. Repairsmade by the successful Proposer will be billed to the City of Bangor at “nocharge”.f. Loaner Provisions: (during the warranty period): If the equipment cannot beused due to repairs that have not been completed within the three (3) normalworking days allowed (Sundays and holidays excluded), either at the FleetMaintenance facility due to the unavailability of parts or at the successfulProposer’s service department for any reason, then the successful Proposer, atthe request of the City of Bangor, must provide a comparable piece of equipmentat “No Charge” until such time as the equipment has been returned to service.g. During the period of guaranteed maximum cost of repairs the provisions ofsubparagraph 8(f) will apply with the following exception: The successfulProposer will, at the request of the City of Bangor, provide a comparable pieceof equipment at the Proposer’s standard prevailing rental rates. This will bebilled to and paid by the City but will be considered part of the repair cost andapplied to the guaranteed maximum repair cost.h. During the period that exceeds the maximum cost of repairs, provisions ofsubparagraph 8(f) will apply.9. The successful Proposer guarantees that they will buy back the equipment from theCity at the end of 4,000 hours of operation as recorded by the engine service meteror four (5) years after receipt of the equipment, whichever occurs first.10. In the event of a disagreement as to the interpretation or application of this contract,an arbitration board shall be set up to arbitrate and resolve any disagreement and/orhelp interpret this agreement as the need may arise. This arbitration board shall haveone (1) person appointed by the City, one (1) appointed by the Proposer, and a thirdperson to be selected by the two (2) previously named.
