All Bid Proposals shall besubmitted on forms furnished by the District. BidProposals must conform with, and be responsive to, theBid and Contract Documents, copies of which may beobtained from the District as set forth above. The Districtmay reject Bid Proposals submitted to the District after thedate and time set forth above for the public opening andreading of Bid Proposals.1.02 Bid and Contract Documents. The Bid and ContractDocuments are available at the location stated above. Allrequests for hard copy documents will be theresponsibility of the bidder. Each Bid Form shall be inaccordance with the Contract Documents. Bidders areresponsible for confirmation that they have viewed alladdenda prior to the bid deadline and will be required toacknowledge addenda on their bid form.1.03 Bid Proposal. Each Bid Proposal shall consist of at leastthe following components plus any other items identifiedin the Instructions for Bidders:A.Bid FormB.Bid SecurityC.List of SubcontractorsD.Non-Collusion DeclarationE.Statement of Bidder’s QualificationsF.Federal E-Rate Supplemental Terms andConditionsAll information or responses of a Bidder in its BidProposal and other documents accompanying the BidProposal shall be complete, accurate and true;incomplete, inaccurate or untrue responses or informationprovided therein by a Bidder may be grounds for theDistrict to reject such Bidder’s Bid Proposal for non-responsiveness.1.04 Job-Walk. The District will conduct a MANDATORY[ONE TIME ONLY] PRE-BID JOB WALK for the Work tobe held at the location, date and time stated above.1.05 Prevailing Wage Rates, Employment of Apprenticesand Labor Compliance Program. The Project is subjectto the provisions of Labor Code §§1720 et seq. andregulations set forth in Title 8 §§16000 et seq. of theCalifornia Code of Regulations which govern the paymentof prevailing wages on public works projects. All Bidders,and their subcontractors, shall be governed by andrequired to comply with these statutes and regulations inconnection with the Project including, but not limited to,the requirement that all Bidders and theirsubcontractors be registered with the CaliforniaDepartment of Industrial Relations (“DIR”) pursuantto Labor Code § 1725.5. Pursuant to Labor Code §1771,the Contractor receiving award of the Contract andSubcontractors of any tier shall pay not less than theprevailing wage rates to all workers employed in theexecution of the Contract. Bidders shall comply withapplicable statutes and regulations, including but notlimited to Labor Code §§ 1771, 1775, 1777.5, 1813 and1815.Pursuant to Labor Code §1773, the Director of the DIRhas determined the generally prevailing rates of wages inthe locality in which the Work is to be performed.Pursuant to Labor Code §1773.2, copies of thesedeterminations, entitled “PREVAILING WAGE SCALE”,are maintained at the District’s offices located at theabove address and are available to any interested partyupon request. Copies of rate schedules are also availableon the Internet at: http://www.dir.ca.gov/DIR/S&R/statistics_research.html. The Contractor awarded theContract for the Work shall post a copy of all applicableprevailing wage rates for the Work at conspicuouslocations at the Site of the Work.The Project will be subject to labor compliance monitoringand enforcement by the Compliance Monitoring Unitwithin the Division of Labor Standards Enforcement andthe contractors, and all subcontractors, shall be requiredto furnish certified payroll records directly to theDepartment of Industrial Relations LaborCommissioner/Compliance Monitoring Unit.1.06 Contractor’s License Classification. In accordancewith the provisions of California Public Contract Code §§3300, the District requires that Bidders possess thefollowing classification(s) of California ContractorsLicense at the time that the Contract for the Work isawarded: “C-7 and/or C-10”.1.07 Bid Security. Each Bid Proposal shall be accompaniedby Bid Security in an amount not less than TENPERCENT (10%) of the maximum amount of the BidProposal, inclusive of any additive Alternate Bid Item(s).Failure of any Bid Proposal to be accompanied by BidSecurity in the form and in the amount required mayrender such Bid Proposal to be deemed non-responsiveand rejected by the District.1.08 Fingerprinting. The successful Bidder will be required toassure that its employees, subcontractors of any tier,material suppliers, and consultants do not have directcontact with the District’s students during the performanceof the Contract in compliance with Education Code§§45125.1 and 45125.2. To ensure these provisions,Bidder’s supervisory personnel shall submit theirfingerprints to the California Department of Justice insufficient time to have the application(s) processed priorto start of on-site Work. The supervisor(s) willcontinuously monitor the workers’ conduct while on schoolgrounds. In addition, the successful Bidders shallbarricade the Work area to separate its workers from thestudents. All costs associated with this process are theresponsibility of the successful Bidders.1.09 No Withdrawal of Bid Proposals. Bid Proposals shallnot be withdrawn by any Bidder for a period of ninety (90)days after the opening of Bid Proposals. During this time,all Bidders shall guarantee prices quoted in theirrespective Bid Proposals.1.10 Substitute Security. In accordance with the provisionsof California Public Contract Code §22300, substitution ofeligible and equivalent securities for any monies withheldby the District to ensure the Contractor’s performanceunder the Contract will be permitted at the request andexpense of the Contractors.The foregoingnotwithstanding, the Bidders to whom the Contracts areawarded shall have ten (10) days following action by theDistrict’s Board of Education to award the Contracts tosuch Bidders to submit their written requests to theDistrict to permit the substitution of securities for retention.The failure of any Bidder to make such written request tothe District within said ten (10) day period shall bedeemed a waiver of the Bidder’s rights under CaliforniaPublic Contract Code §22300.1.11 Waiver of Irregularities. The District reserves the rightto reject any or all Bid Proposals or to waive anyirregularities or informalities in any Bid Proposal or in thebidding.1.12 Award of Contract. The Contracts for the Work, ifawarded, will be by action of the District’s Board ofTrustees to the responsible Bidder submitting the lowestresponsive Bid Proposal. If the Bid Proposal requiresBidders to propose prices for Alternate Bid Items, theDistrict’s selection of Alternate Bid Items, if any, fordetermination of the lowest priced Bid Proposal and forinclusion in the scope of the Contract to be awarded shallbe in accordance with this Notice and the Instructions forBidders.1.13 Inquiries and Clarifications. This document is forinformational purposes and shall not relieve the Bidder ofthe requirements to fully familiarize itself with all thefactors affecting the Project and the Bid. The Bidder isadvised that all inquiries and clarifications about the BidDocuments, Drawings, Specifications, etc., shall besubmitted to the District in writing at least five (5) daysprior to the date and time of scheduled bid opening andreceipt of proposals. The District will respond at itsearliest possible opportunity. Oral communication byeither party with regard to this matter is invalid.1.14 Alternate Bid Items.SELECTION BY PRIORITIZATIONThe Bid Alternates are listed in order of highest priority(i.e., Alternate No. 1 is the highest priority and so on). Ifthe Base Bid amount is less than the Project Budget,additive Bid Alternate amounts will be added in priorityorder until another Alternate cannot be added withoutexceeding the Project Budget. The Contract will beawarded, if at all, on the basis of the Base Bid amountplus the largest possible number of additive Bid Alternateswhile remaining at or within the Project Budget. If theBase Bid amount exceeds the Project Budget, deductiveBid Alternate amounts will be deducted from the Base Bidamount in priority order (lowest numbered Alternate tohighest) until the amount is less than or equal to theProject Budget. The Contract will be awarded, if at all, onthe basis of the Base Bid amount minus the fewestpossible number of deductive Bid Alternates whileremaining at or within the Project Budget. The Districtmay award the Contract on the basis of the Base Bid onlyif no combination of Base Bid amounts plus additive BidAlternates can be accomplished within Project Budget,provided that the Base Bid amount is less than or equal tothe Project Budget.1.15 Disabled Veteran Business Enterprises ParticipationGoals. The District has established a participation goal ofthree percent (3%) for Disabled Veteran BusinessEnterprises (“DVBE”) for the Work of the Project.
