It is the sole responsibility of the bidderto see that the bid is received in proper time at the address and department noted herein.REQUIRED BID SECURITY: Each bid must be submitted with security in an amount not less than tenpercent (10%) of the maximum bid amount as a guarantee that the bidder will enter into the proposedcontract, if awarded to the bidder, and will provide the performance and payment bonds, insurancecertificates and other documents described in the Contract Documents. Attendance is not a conditionof bid submission. The forms of the bonds are set forth in the Contract Documents and all bonds must be issued bya California-admitted surety as defined in California Code of Civil Procedure Section 995.120.PREVAILING WAGES: The successful bidder and each of its subcontractors of any tier will be required topay not less than the general prevailing rates of per-diem wages in the locality in which the work is to beperformed for each craft or type of worker needed to execute the contract (“Prevailing Wages”). A copy ofthe per-diem rates of Prevailing Wages applicable to the Project is on file and available for review at thelocation specified above as the place for submitting bids, and a copy will be posted at the site of the Project.Pursuant to Labor Code sections 1725.5 and 1771.1, all contractors and subcontractors that wishto bid on, be listed in a bid proposal, or enter into a contract to perform public work must beregistered with the Department of Industrial Relations. No bid will be accepted, nor any contractentered into without proof of the contractor’s and subcontractors’ current registration with theDepartment of Industrial Relations to perform public work. If awarded a Contract, the Bidder and itssubcontractors, of any tier, shall maintain active registration with the Department of IndustrialRelations for the duration of the Project.This Project is subject to compliance monitoring and enforcement by the Department of IndustrialRelations. In bidding on this project, it shall be the Bidder’s sole responsibility to evaluate andinclude the cost of complying with all labor compliance requirements under this contract andapplicable law in its bid.WAGE THEFT PREVENTION: A potential contractor that has submitted a formal or informal bid toprovide goods and/or services to the SCCOE may be disqualified if the potential contractor has beenfound, by a court or by final administrative action of an investigatory government agency, to have violatedapplicable wage and hour laws in the five years prior to the submission of a bid to provide goods and/orservices. A current contractor found by a court or by final administrative action of an investigatorygovernment agency to have violated applicable wage and hour laws, in the five years prior to or duringthe term of the contract with the SCCOE, may be in material breach of its contract with the SCCOE if theviolation is not fully disclosed and/or satisfied per SCCOE guidelines and contract requirements. SuchSCCOE PROJECT NAME: Wool Creek P.I.P. Replacement RE-BIDProject No. iB 03_25_26breach may serve as a basis for contract termination and/or any other remedies available under law,including a stipulated remediation plan.The contract will be awarded to the lowest responsive, responsible bidder based on the specifications notedin the bid. The SCCOE reserves the right to reject any or all bids, to accept or reject any one or more itemsof a bid or to waive any irregularities or informalities in the bids or in the bidding.No bidder may withdraw his bid for a period of sixty (60) days after the date set for the opening of bids.
