HCS staff will beavailable to answer technical questions concerning the scope of work and project requirements.INSTRUCTIONS TO BIDDERS1. DEFINITION OF TERMSWhenever used in any of the Contract Documents, the following meanings shall be given to theterms used herein:1. The term “Owner” means the Harnett County Schools or Board of Education, whichever isapplicable to the Contract.2. The term “Contract” means the executed agreement between the Owner and the successfulbidder, all documents contained herein, and all other documents required by the Owner and/orlaw to execute said agreement.3. The term “Contractor” means the individual or entity with whom Owner has entered into theagreement.2. SPECIFICATIONSIt is necessary from time to time to revise otherwise standard specifications. Therefore, it is to theinterest of each and every bidder to carefully read the documents contained herein before submittingprices.3. BIDDER’S QUALIFICATIONSFor projects exceeding $40,000, consideration will be given only to Contractors who submitevidence that they are properly licensed as required by Chapter 87 of the North Carolina LicensedGeneral Statutes to bid and perform the work described herein as the general contractor. In addition,the Owner may make such investigations as deemed necessary to determine the ability of the Bidderto perform the work, and the Bidder shall furnish the Owner all such information and data for thispurpose as the Owner may request.The Owner reserves the right to consider as unqualified for construction any Bidder who does notperform with his own forces a minimum of ten percent (10%) of the work involved in improvementsembraced in this contract.Awarded contractor shall be authorized to conduct business in the state of North Carolina as foundby checking the Secretary of State website and/or Register of Deeds office, indicating properregistration and active status. This is a condition of executing the contract.4. INTERPRETATION OF QUANTITIES IN PROPOSALThe quantities contained in the Proposal are approximate only and the Owner may increase ordecrease the quantities as deemed necessary. Compensation received by the Contractor shall bebased upon actual quantities that are completed and accepted in accordance with the terms of theContract.5. INTERPRETATION AND ADDENDANo oral interpretation will be made to any bidder as to the meaning of the contract documents orany part thereof. Every request for such an interpretation shall be made in writing to the Director ofPurchasing. Any inquiry received seven days (7) days or more prior to the date fixed for openingof bids will be given consideration. Every interpretation made to a bidder will be in the form ofAddendum to the Contract Documents and, when issued, will be on file in the office of thePurchasing Department at least five days (5) before the bids are opened. In addition, all Addendawill be mailed to each person holding Contract Documents, but it shall be the bidders responsibilityto make inquiry as to the Addenda issued. All such Addenda shall become part of the Contract, andall bidders shall be bound by such Addenda, whether or not received by the bidders.IFB-2026-20 Parking Lot Milling and Repaving Overhills Middle School26. INSPECTION OF SITEEach bidder should visit the site of the proposed work and fully acquaint himself with the existingconditions relating to the construction project. Each bidder should fully inform himself as to thefacilities involved and the difficulties and restrictions attending the performance of the Contract.The bidder should thoroughly examine and familiarize himself with the Drawings, TechnicalSpecifications and all other Contract Documents. The Contractor by the execution of the Contractshall in no way be relieved of any obligation under it due to his failure to receive or examine anyform or legal instrument or to visit the site and acquaint himself with the existing conditions. TheOwner will be justified in rejecting any claim based on facts that the bidder should have been awareof as a result of his site inspection.7. PREPARATION AND SUBMISSION OF BIDSPlease read all instructions carefully before preparing and submitting your bid.All bids shall be prepared and submitted in accordance with the following requirements.Failure to comply with any requirement shall cause the bid to be considered irregular andshall be grounds for rejection of the bid.a. The itemized Proposal form furnished herein shall be used and shall not be altered in any manner.You may include only the required forms – see Item 17.b. All entries on the itemized proposal form shall be written in ink.c. The total amount bid shall be written in the proper place on the itemized proposal form.d. Changes in any entry shall be made by marking through the entry in ink and making the correctentry adjacent thereto in ink. A representative of the Bidder shall initial the change in ink.Do not use “White Out” or similar product to make corrections.e. The bid shall be properly executed. All bids shall show the following information:1. Name of individual, firm, corporation, partnership, or joint venture submitting bid.2. CORRECTION OF BID ERRORSCorrections to bid forms by bidders shall be made by crossing out incorrect numbers and writing incorrect numbers, then initial. Do NOT use white out! Line-item subtotals will prevail in event ofdiscrepancies.9. UNBALANCED BIDSThe Contractor shall not submit a bid containing any unbalanced bid prices. Any unit or lump sumbid price that does not reflect reasonable actual costs that the Contractor anticipates for theperformance of the item(s) in question along with a reasonable proportional share of the Contractor’santicipated profit, overhead cost, and other indirect costs is an unbalanced bid price. Any bidcontaining unbalanced bid prices may be deemed non-responsive and rejected.IFB-2026-20 Parking Lot Milling and Repaving Overhills Middle School310. COLLUSIVE AGREEMENTSEach bidder submitting a bid to the Owner for any portion of work contemplated by the documentson which bidding is based shall execute and attach thereto an affidavit, substantially in the formsprovided herein, to the effect that he has not entered into a collusive agreement with any otherperson, firm or corporation in regard to any bid submitted. Before executing any subcontractagreement, the successful bidder shall submit the names of any proposed subcontractors for priorapproval and an affidavit substantially in the form provided herein.11. ALTERNATIVE BIDSNo alternative bids will be considered unless alternative bids are specifically requested.12. MATERIALSThe name of a certain brand, make, manufacturer or definite specification is to denote the qualitystandard of the article desired and not to restrict competitive bidding. It is set forth and conveyedto prospective bidders the general style, type, character and quality of the article desired. Bidders,however, may submit to the Owner evidence that proposed substitutions are fully up to standardsspecified and obtain his approval before placing orders.13. ERRORS, OMISSIONS, AND DEVIATIONSThe Contractor is responsible for all errors, omissions, and deviations from the Contractrequirements.14. TIME FOR RECEIVING BIDSBids received prior to the advertised hour of opening will be securely kept, sealed. The officerwhose duty it is to open them will decide when the specified time has arrived, and no bid thereafterwill be considered.15. MINIMUM NUMBER OF BIDS (Formal Contracts Only)North Carolina General Statute 143-129 and 143-132 prohibits the awarding of a formal contractunless at least three (3) competitive bids are received from reputable and qualified contractors.Therefore, if fewer than three (3) such bids are received, they will not be opened but returned to thecontractors; and the project may be re-advertised.Formal contract thresholds are as follows:Harnett County Schools-funded projects: $250,000.00State and Federal funded projects: $500,000.0016.
