Category: Paving Status: Open Description: Sealed bids will be received at the Office of the Westmoreland County Controller, Suite 111, 2 North Main Street, Greensburg, Pennsylvania until 2:00 P.M., prevailing time, Tuesday, March 31, 2026, and will be opened, checked, and read aloud at approximately 2:15 P.M. later in the Commissioners' Conference Room, for the purchase of Bituminous Plant Mix Material and Stone Aggregate for the Westmoreland County Department of Public Works.
Bid Documents will be on Westmoreland County’s website http://www.westmorelandcountypa.gov/Bids on or before Tuesday March 9, 2026, preparatory to and during bidding. Addenda will ONLY be posted on the Westmoreland County website. All Bidders are required to periodically visit the County’s website for Addenda updates. It is ALL Bidders’ responsibility to verify that they have received and reviewed all addenda posted on the County’s website before submitting a bid.
A certified check or bidder's bond in the amount of ten (10%) of the grand total bid must be enclosed with the Bid Documents. Bid Bond of the two lowest bidders will be held until the contract is awarded and the successful bidder supplies performance bond and signs contract. All other bid bonds will be returned within fifteen days after opening.
The Westmoreland County Commissioners reserve the right to reject any or all bids. The Commissioners also reserve the right to approve the sufficiency of any required surety.

General: Separate and sealed bids for Bituminous Plant Mix Material and Stone Aggregate forWestmoreland County will be received at the Office of the County Controller, Courthouse Square, Suite111, 2 North Main Street, Greensburg, Pennsylvania 15601 until 2:00 p.m. on Tuesday, March 31, 2026.LATE BIDS WILL NOT BE ACCEPTED OR CONSIDEREDBids will be opened and read aloud on March 31, 2026, at approximately 2:15 P.M.2. Submission of Bids: An original and one (1) copy of the complete Bid must be submitted in a sealedenvelope, and addressed to the Westmoreland County Controller and clearly marked on the outside of theenvelope with the Bidder's name and address and the designation:“BID – BITUMINOUS PLANT MIX MATERIAL AND STONE AGGREGATE”No responsibility will be attached to any COUNTY representative for premature opening of a bid notproperly addressed and identified.3. Bid Security: Each bid must be accompanied by a certified, good faith check drawn upon a bankauthorized to do business in the Commonwealth of Pennsylvania, cashier's check, or by a bid bond withcorporate surety, in the amount of ten percent (10%) of the amount bid for the grand total price of theBituminous Plant Mix and Stone Aggregate. Bid bonds must be signed by an authorized representativeof both the bidder and the surety company, and accompanied by a power of attorney authorizing executionof the bond on behalf of the surety company, or the bid will be rejected.4. Tax Exemptions: The County is exempt from all Federal excise and transportation taxes, the provisionsof the Fair Trade law, and the Pennsylvania sales and use tax for purchase of tangible personal property.The registration number with the Internal Revenue Service is 25-6001046. No exemption certificates arerequired and none will be issued. Nothing in this paragraph is meant to exempt a bidder from payment ofsales tax or use tax required to be paid with respect to its purchase or use of tangible personal propertyused or transferred in connection with the performance of this contract. If the County is required by lawto pay any excise tax and then seek a refund or credit, the bidder may add the amount of the tax to the bidprice as a separate item.The bidder will be required to complete an Internal Revenue Service Form (IRS) W-9, providingthe bidder's taxpayer identification number and, if applicable, certification regarding backupwithholding and submit the completed W-9 Form along with the executed contract. The form canbe found on the IRS web site through this link: https://www.irs.gov/forms-pubs/about-form-w-9 .Selected contractor will submit the completed W-9 Form along with the executed contract.5. Right to Accept or Reject Bids: The Westmoreland County Commissioners reserve the right to waiveinformalities for the best interest of the County, approve sufficiency of surety and reject any and all bids.Failure of the bidder to sign the bid or have the signature of an authorized agent or representative on theofficial bid form will be cause for rejection of the bid. Signature must be written in ink; typing or printingis not acceptable. Bidders must include all information required on the Official Bid Form. Failure tocomply may be cause for rejection of the bid. Award of the contract will be made at the County's optionto the lowest responsible bidder.6. Approved Equal: Whenever a product is defined in this invitation by trade name and catalogue number2of a manufacturer or vendor, the term "or approved equal," if not inserted therewith shall be implied. Anyreference to a particular manufacturer's products either by trade name or by limited description is solelyfor the purpose of more clearly indicating the minimum standard of quality desired, except where a nosubstitution is requested, the County will consider bids for the referenced item only. The term "orapproved equal" is defined as meaning any other make which, in the sole opinion of the County, is of suchcharacter, quality and performance equivalence as to meet the standard of quality of items specified forwhich it is to be used equally as well as that specified. The bidder quoting on a commodity other than asspecified shall furnish complete identification on the bid proposal of the product he is offering by tradename brand and/or model number. The bidder shall also furnish descriptive literature and data with respectto the alternative commodity he proposes to furnish. Bidders offering an alternate shall also indicate anyknown specification deviations from the referenced item on the “Bid Exception Sheet”.7. Withdrawal of Bids: Bids may be withdrawn at any time prior to the designated time of the opening ofbids. All bids must be firm for thirty (30) days following the bid opening; and, no bids will be permittedto be withdrawn during such period. Bids will be awarded or rejected within thirty (30) days from opening.In the event award of Bid cannot be made within thirty (30) days from date of Bid Opening, bidders willbe afforded the opportunity to extend their bid for an additional thirty (30) days be completing andsubmitting to the County a Consent to Extension of Date for Bid Award Form, a copy of which is attachedhereto as Attachment “A”.8. Provisions Required by Law Deemed Inserted: Each and every Provision of law and clause required bylaw to be inserted in the Contract for this project will be deemed to be inserted therein and the Contractwill be read and enforced as though it were included here, and if through mistake or otherwise any suchprovision is not inserted, or is not correctly inserted, then upon the application of either party, the Contractshall forthwith be physically amended to make such insertion.9. More Than One Bid: If more than one bid is offered by any one BIDDER, in his own name or in the nameof his agent, partner, or other person, all bids submitted by such BIDDER shall be rejected.10. Non-Discrimination Agreement: The Successful Bidder shall execute the attached Non-DiscriminationAgreement herein marked as Attachment "B".11. Contractor Integrity: The Successful Bidder shall execute the attached Contractor Integrity Agreementherein marked Attachment "C".12. No-Lien Affidavit – The successful bidder shall execute the attached Contractor’s No-Lien Affidavitmarked Attachment “D”.13. Affidavit RE – The successful bidder shall execute the attached Affidavit-RE marked Attachment “E”.14. Addenda to Contract: During the bidding period the County may issue written Addenda to each person,firm or corporation which has secured a copy of these specifications, making changes or corrections tothe specifications as issued. Such changes or corrections shall be included in the work and/or materialscovered by the bid proposal, and such Addenda shall become part to the specifications and contract.Bidders who secure Bid Specifications via the internet are cautioned to verify if Addenda have been issuedby the County prior to submission of bid. The County assumes no responsibility to notify any prospectivebidder of Addenda to Bid Specifications that are secured via the internet15. Payment: The County will make payment to the successful Bidder within thirty (30) days upon receipt ofan invoice and receipt of and acceptance of the materials ordered. The invoice is to be submitted to:3Westmoreland County Department of Public Works, 194 Donohoe Road, Greensburg, PA 15601.16. Performance Bond: The successful bidder will be required to furnish a bond guaranteeing performance ofthe contract, with sufficient surety in the amount of fifty percent (50%) of the amount of the contract withinfifteen (15) days of the date of written notice of award of the contract herein marked Attachment “F”.NOTE: FAILURE TO FURNISH SUCH BOND WITHIN THIS TIME PERIOD SHALL, AT THEOPTION OF THE COUNTY, CONSTITUTE GROUNDS TO REVOKE THE BID AWARD ANDDECLARE THE BID SECURITY FORFEITED.17. Insurance: During the term of this contract, the Contractor shall maintain in effect insurance policiescovering the following:1) Automobile - $500,000 combined single limit.2) Workmen's Compensation - In amounts required by law.3) General Liability - $500,000 per occurrence of personal injury; $500,000 per occurrence ofproperty damage.A Certificate of Insurance must be provided along with the Performance Bond within fifteen(15) days of written notice of award of the contract.18. Term of Agreement: The term of this agreement shall begin on May 1, 2026 through April 30, 2027.19. Contact Person: Any questions regarding this bid should be directed to Vaughn W. In accordance to Pennsylvania’s “Right To Know” Laws, (Act 3 of 2008: 65 PS 67.101 et seq), the Countymay make available for viewing or provide copies of all bids received and all associated contractdocuments following awarding of same.21. The submission of a Bid shall constitute and establish the Bidders intent to enter into a binding contractwith Westmoreland County for the goods and services solicited. Additionally, should any bid submittedcontain defect(s) that in the County’s opinion, is of a non-material nature, the Bidder agrees that by thesubmission of a Bid, Bidder will correct any defect(s) upon request of the County.22. Unit Prices: In the event Unit Prices are required, the County reserves the right, should there be anydiscrepancy, inconsistency or difference between the Unit Price(s) and Total Price(s), to choose the lowestof the prices listed and the vendor shall be bound to provide the goods and/or services in question at thelower cost. The County reserves the right to award for individual items, groups or combined award as maybe in the County’s best interest.23. Quantities listed are estimates only. Actual amounts ordered may vary.24. For all Public Works Projects in excess of $25,000.00, the successful bidder shall be required to strictlyfollow and comply with all provisions of the Public Works Employment Verification Act 43 PS § 167.1and PA Code Regulations at 66.1 – 66.9.25. The bidder shall list on a separate sheet of paper, when needed, any variations from, or exceptions to, theconditions and specifications of this bid. This sheet shall be labeled “Exception(s) to Bid Conditions andSpecifications”, and shall be attached to the bid.4SPECIFICATIONSQUALITY: All items except anti-skid shall be Pennsylvania Department of Transportation approved inaccordance with Pennsylvania Department of Transportation Form 408 Specifications. Materialsshall also meet the approval of the County prior to delivery.CONTRACT TERM: May 1, 2026 through April 30, 2027DELIVERY: This is a fixed price contract. Unlike previous years, price adjustments may only take place ifthere is a substantial change in fuel prices during the term of the contract. Check the PA DGS(Department of General Services) website for price adjustments when applicable.The Westmoreland County Department of Public Works reserve the right to limit or increasequantities as use requires. Material must be available within ten (10) days after the contract isawarded, and thereafter as use requires on a two (2) day notice.The Bituminous Plant Mix Material will be picked-up at the bidder's plant. Therefore in order fora bidder to submit a price for Bituminous Plant Mix the bidder's batch plant must be located inclose proximity to that geographic region. The County reserves the right to reject a low bid if thiscriterion is not met.The prices for Bituminous Plant Mix Material are based on the Penn D.O.T. Asphalt Index at thetime of the bid. The prices are subject to adjustment pursuant to increase or decrease in themonthly Penn D.O.T. Asphalt Index in accordance with Form 408, Section 110.04.The Coarse Aggregate bid will include a picked-up and delivered price. Therefore, in order for abidder to submit a price for Coarse Aggregate - Picked-Up the bidders quarry must be located inclose proximity to that geographic region.
