RFP #26033 Questions & AnswersQuestion1. When will vendors receive the applicablecontract for review?2. Will customer be willing to considercontract revisions/exceptions?AnswerContracts with awarded vendors are anticipatedto be available in Fall 2026.In the event the vendor intends to deviate fromthe general terms and conditions or specificationscontrary to those listed in the "Terms andConditions", "Specifications" and otherinformation attached in the RFP, all suchdeviations must be listed as noted in the RFP,with complete and detailed conditions andinformation also being attached (attach additionalpages as necessary). Vendors must list allspecifications for item(s) bid that differ from anyspecifications/brands listed in proposal. ESC-20will be the sole judge to determine if deviationsare acceptable in meeting the needs of ESC-20.3. To what extent will revisions/exceptionsimpact final award decisions?4. Is customer receptive to mutualtermination rights?5. Is customer receptive to the prospect ofrate/pricing increases where unexpectedmarket forces make this a necessaryconsideration?6. The solicitation references the UniformCommercial Code (UCC) as beingapplicable to the relationship betweencustomer and vendors. With the UCCbeing applicable to transactions involvingthe sale of goods, how is it applicablewhere customer is seeking services?For subsequent contracts, ESC-20 will be the solejudge to determine if any revisions/exceptions areacceptable in meeting the needs of ESC-20.Contracts would be in alignment with the "Termsand Conditions", "Specifications" and otherinformation attached in the RFP.See Attachment A on pages 19-22 of the RFP forthe Standard Evaluation Criteria. What are the parameters of the crisismanagement for the intended program?If the invoice is reflective of services rendered todate and not pre-billing for future service periods,ESC-20 is receptive to Net 30 payment terms.No. As noted in the Scope of Services on page 3,“ESC-20 is seeking to partner with a company toprovide centralized contracted behavior servicesdesigned to meet the needs of students withsignificant behavioral challenges who also presentwith varying cognitive abilities. The successfulservice provider will partner with ESC-20 toensure the services offer a structured,therapeutic environment with separateclassrooms to support students with averagecognitive abilities as well as those with lowerfunctioning skills.”At this time, it is anticipated that the sending orhost LEA will provide the curriculum. The vendoris responsible for intervention curriculum.Vendor is responsible for providing technology totheir staff.It is the vendor responsibility to hire and ensurestaff members meet Texas license andcertification requirements.Contracts with awarded vendors are anticipatedto be available in Fall 2026.ESC-20 projects a start date in January 2027.ESC-20 will award all recommended vendorsfollowing the Standard Evaluation Criteriaoutlined in Attachment A on pages 19-22.ESC-20 is in the process of working with LEAs todetermine needs. Initial projections indicate ahigher need for preliminary services to middleschool students.ESC-20 is in the process of working with LEAs todetermine needs. At this time, ESC-20 anticipateshosting one preliminary program starting inJanuary 2027 with the potential for additionalsettings in the following school years aligned withthe RFP renewal periods.Vendor must adhere to the requirements of theIndividuals with Disabilities Education Act (IDEA)and Texas regulations, including TEA proposedminimum standards. It is the expectation of ESC-20 that any awarded vendor is aware of andadheres to applicable federal and stateregulations. To allow for fair scoring, no furtherinformation will be provided.
