NOTICE TO BIDDERS / INVITATION TO BID1. Notice is hereby given that the governing board (“Board”) of the Hayward Unified School District (“District”)will receive sealed bids to construct the following project:26.4 – Stonebrae Elementary School Playground Resurfacing Project (“Project” or “Contract”)2. Bidders must submit sealed bids on or before 10 a.m., Wednesday, March 18, 2026,at the District Office –Purchasing Department, located at 24411 Amador St, Hayward, California 94544, and Bidders must ensure thatthe District time stamps the Bidder’s bid at or before that time. After the designated bid opening time, theDistrict will open the bids and publicly read them aloud. The bid must be in sealed envelope inside theshipping packet and marked on the exterior “Bid Enclosed – 26.4”. Any claim by a Bidder of error in its bidmust be made in compliance with Public Contract Code § 5100, et seq. The District is not responsible for (1)bids received after the deadline noted above; or (2) bids misdelivered, by any method, even to a differentDistrict address.3. The Project consists of:[Install IPEMA-certified pour-in-place rubber surfacing at two adjacent playground pads totalingapproximately 4,780 square feet, including demolition and disposal of existing surfacing whererequired, surface preparation, installation of new rubber retops, and completion of all work inaccordance with project requirements]4. All bids shall be on the forms provided by the District. Each bid must conform and be responsive to allpertinent bid and Contract Documents, including, but not limited to, the Instructions to Bidders.5. To bid on this Project, the Bidder is required to possess one or more of the following State of CaliforniaContractor Licenses: BThe Bidder's license(s) must be active and in good standing at the time of the bid opening and must remain sothroughout the term of the Contract.6. As security for its Bid, each Bidder shall provide with its Bid form● a bid bond issued by an admitted surety insurer on the form provided by the District,● cash, or● a cashier's check or a certified check, drawn to the order of the HUSD,in the amount of ten percent (10%) of the total bid price. This bid security shall be a guarantee that the Biddershall, within seven (7) calendar days after the date of the Notice of Award, enter into a contract with theDistrict for the performance of the services as stipulated in the bid.7. All bidders’ questions must be submitted in writing via email to facilitiesbond@husd.k12.ca.us by 5:00 pm,March 10, 2026.8. The successful Bidder shall be required to furnish a 100% Performance Bond and a 100% Payment Bond if it isawarded the Contract for the Project.9. The successful Bidder may substitute securities for any monies withheld by the District to ensure performanceunder the Contract, in accordance with the provisions of Public Contract Code § 22300.10. The successful Bidder and its subcontractors shall pay all workers on the Project not less than the generalprevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as determinedby the Director of the Department of Industrial Relations, State of California, for the type of work performedand the locality in which the work is to be performed within the boundaries of the District, pursuant to LaborCode § 1770 et seq. Prevailing wage rates are on file with the District and are available to any interested partyon request or at www.dir.ca.gov/oprl/statistics_and_databases.html. Bidders and Bidders’ subcontractorsshall comply with the registration and qualification requirements pursuant to Labor Code §§ 1725.5 & 1771.1.11. A mandatory pre-bid conference and site visit will be held on Wednesday, March 4, 2026, at 2:00 p.m. at 28761Hayward Blvd, Hayward, California 94542. All prospective Bidders are required to sign in at the AdministrationBuilding. The Site Visit is expected to take approximately [3] hours. Failure to attend or tardiness will renderbid ineligible.12. Contract Documents are available on February 20, 2026, for review at the District website.www.husd.us/departments/business-services/bonds13. The District’s Board reserves the right to reject any and all bids and/or waive any irregularity in any bidreceived. If the District awards the Contract, the security of unsuccessful Bidder(s) shall be returned withinsixty (60) days from the time the award is made. Unless otherwise required by law, no Bidder may withdrawits bid or bid security for ninety (90) days after the date of the bid opening.14. The District shall award the Contract, if it awards it at all, to the lowest responsive responsible Bidder basedon: The base bid amount only.
