General Provisions:It is the intent of this request for proposals to obtain competitive pricing forarchitectural and engineering services.2. Project Manager:Jon Haight, Assistant Commissioner of Public Works/ Buildings & Grounds, 3 EastPulteney Square, Bath, N.Y. 14810. Telephone number: 607-664-2384.3. Qualifications:Steuben County will be free to make any inquiries deemed necessary to ascertainthe qualifications of the contractor and/or the accuracy of statements made bythe contractor as to its qualifications.4. Contact Information and Requirements:Along with its response, the submitter of the RFP shall include the followinginformation name, address, telephone number and FAX number.5. Proposal Cost; Budget Narrative and Justification:The price shall be an in toto price per the proposed scope of services/deliverables.By in toto it is meant, the aggregate of all costs billable to Steuben Countyincluding but not limited to staffing, site/facilities, travel, freight, labor, materialsand equipment.6. Selection of a Contractor:Selection shall only be made from proposals submitted by qualified, responsiveand responsible entities who sufficiently meet the terms, conditions andspecifications stated herein.However, under all circumstances and all statements to the contrary not with-standing, that Steuben County reserves as its right, the right to determine thecontractor in accordance with the best interest of Steuben County.Determination is not made at the opening. All submitted proposals are subjectto final review and acceptance by the appropriate personnel or committee(s) ofthe Steuben County Legislature before a determination is made.[2]Receipt of proposals by the County shall not be construed as authority to bindthe County.7. References:Any response to this request for proposal shall contain as a minimum at leastthree (3) reference with contact names and phone numbers where thecontractor has completed projects similar in nature in New York State.8. Submission of Proposals:Those submitting proposals do so entirely at their expense. There is no expressor implied obligation by Steuben County to reimburse any firm or individual forany costs incurred in preparing or submitting proposals, preparing or submittingadditional information requested by the County, or for participating in anyselection interviews.9. Contract Award:Award of contract will be made following a review of the proposal by theAssistant Commissioner of Public Works/ Buildings & Grounds and any additionalCounty staff as deemed appropriate, and approval will be made by a designatedcommittee. Contractor will be indemnifying and insuring for cloud-basedbreaches not caused by the fault of Steuben County.10. Method of Award:The award may be made to the most responsible contractor whose proposal isdetermined to be in the best interest of Steuben County and who is deemed thebest fit to serve the County’s requirements based upon criteria stated under theScope of this RFP, the evaluation of references, corporate qualifications and, ifdeemed necessary, an interview with the contractor and the designatedcommittee.Price will not necessarily be the determining factor in the award of the contract.All proposals will be evaluated to determine if they meet the required format andare in compliance with all requirements of the Request for Proposals.Incomplete or non-responsive proposals may be rejected at the discretion ofSteuben County.11. Contract Term:The contract to provide architectural and engineering services for bathroomrenovations, if an award is made, will be effective on the date the contract issigned by all required parties.12. Cancellation of Contract:Steuben County reserves, as its right, the right to cancel the contract(s) resultingfrom an award of this solicitation at any time during the contract period, withoutpenalty to Steuben County and without stated reason, by delivering a written ten[3](10) day notice of intent to the contractor(s) or its representative(s). Saidnotification mailed to the contractor or its representative via the US PostalService; First Class Mail shall be considered sufficient and delivered.13. Assignability:The contractor shall not assign, transfer, convey, sub-contract, sublet or other-wise dispose of all or portions of the contract; and/or work to be performed as aresult of the contract; or its right, title or interest therein, or its power to executesuch contract, or its responsibility therein to any other person, company orcorporation, without the prior written consent of the Commissioner of Financeand the Administration Committee.14. Insurance:a) This document includes an information sheet entitled: STEUBEN COUNTYSTANDARD INSURANCE REQUIREMENTS. These requirements establishthe minimum insurance(s) which the contractor(s) shall have in effectprior to entering into a contract to do business with Steuben County. Saidinsurance(s) are required to remain in effect throughout the term of thecontract(s).In the event that the contractor’s insurance lapses during the term of thecontract, the County reserves, as its right, the right to cancel thecontractor’s contract(s) and to purchase the contractedproduct(s)/service(s) on the open market; with any increase in cost(s) toSteuben County being charged to the contractor. Credit shall not beissued to the contractor where open market cost(s) to the County are lessthan the cost(s) contracted with the contractor.b) Steuben County shall be named as an additional insured in thecontractor’s policy for all intents and purposes of contract(s) issued as aresult of an award. The document number and title shall be referenced inthe description/additional comments section of the certificate of insuranceform.PLEASE NOTE: Additional insured and certificate holder must only read:Steuben County, 3 E. Pulteney Square, Bath, N.Y. 14810.c) Each contractor shall submit an original of its Certificate of Insurance(which indicates the contractor’s compliance with the above sections a)and b) to Steuben County Purchasing Department, 3 E. Pulteney Square,Bath, New York 14810.d) The Certificate of Insurance must be approved by the County RiskManager prior to the contractor’s acting on and/or performing any of theobligations it incurred as a result of the award and/or contract.[4]e)f)15.a)b.Self-employed persons must carry Worker’s Compensation coverage asdirected by the Steuben County Risk Manager. Contractor shall submit anoriginal Certificate of NYS Worker’s Compensation Insurance Coverageform C-105.2, which indicates the contractor’s compliance, to be approvedby the County Risk Manager prior to the contractor’s acting on and/orperforming any of the obligations it incurred as a result of the awardand/or contract.Worker’s Compensation Insurance Exemption: Contractors claiming to beexempt from the requirement to carry/provide Workers’ CompensationInsurance shall submit a fully executed CE-200 form; the form to becomplete, notarized, and stamped as received by the New York StateWorkers’ Compensation Board.Non-Collusive Bidding Clause and Certificate:Clause –“By submission of this bid, each contractor and each person signing onbehalf of any contractor certifies, and in the case of a joint bid, each partythereto certifies as to its own organization, under penalty of perjury, thatto the best of knowledge and belief:1) The prices in this bid have been arrived at independently withoutcollusion, consultation, communication or agreement, for the purposeof restricting competition, as to any matter relating to such priceswith any other contractor or with any competitor;2) Unless otherwise required by law, the prices which have been quotedin this bid have not been knowingly disclosed by the contractor andwill not knowingly be disclosed by the contractor prior to opening,directly or indirectly, to any other bidder or to any competitor; and3) No attempt has been made or will be made by the contractor toinduce any other person, partnership or corporation to submit or notto submit a bid for the purpose of restricting competition.”The contractor shall submit a signed and dated Non-Collusive BiddingCertificate with its bid. Said certificate is mandated by Chapter 956 of theLaws of New York State, pursuant to Section 103-D of the GeneralMunicipal Law. Reference the “NON-COLLUSIVE BIDDING CERTIFICATE”form included in this bid document.16. Hold Harmless Clause and Form:a) Clause –“The contractor agrees that it shall at all times save harmless the Countyof Steuben from all claims, damages or judgements or for the defense orpayment thereof, based on any claim, action or cause of action[5]
