Respondents to 2023-05-1570 will need to submit a response to this Request for Proposal in order to be considered,

The City of New Haven seeks to contract a qualified State Marshal Service provider to facilitate the service of various legal transactions, including but not limited to subpoenas, writs, complaints, and other official documents, on behalf of various City of New Haven departments which may require travel beyond the city limits. The awarded marshal(s) will ensure accurate, timely, and compliant service of process according to the legal requirements of the State of Connecticut.

The purpose of the RFP is to compile a list of up to fifteen (15) Marshals (quantity established by City ordinance) who are willing and able to serve papers at CGS State 52-261 cost fee(s) or flat fee. The City of New Haven has, in the past, required Marshal service for the following: Foreclosures, Personal Property tax warrants, Building/Zoning code violations, Office of Corporation Counsel, Health Department.

Background

CGS § 6-38a State Marshal. Authority to provide legal execution and service of process.

  1. For the purposes of the general statutes “state marshal” created in June 30, 2000 with Public Act 00-99, under section 6-38 or appointed pursuant to section 6-38b who shall have authority to provide legal execution and service of process in the counties in this state pursuant to section 6-38 as an independent contractor compensated on a fee for service basis, determined, subject to any minimum rate promulgated by the state, by agreement with an attorney, court or public agency requiring execution or service of process.
  2. Any state marshal, shall in the performance of execution or service of process functions, have the right of entry on private property and no such person shall be personally liable for damage or injury, not wanton, reckless or malicious, caused by the discharge of such functions.
