RECEIPT OF BIDS. The Port will receive electronic bids only for the above-reference Project.All Bids must be submitted in the manner specified in Paragraph 19 herein. The Port will receiveBids until 12:00 p.m., on Tuesday, June 9, 2026. Bids received after the specified time will notbe accepted. No Bidder may make or file or be interested in more than one Bid for the samesupplies, services or both.2. LICENSE, DIR REGISTRATION, AND CARB REQUIREMENTS2.1 License. A California Class A contractor's license is required prior to award of thisContract. Joint ventures must secure a joint venture license prior to award of thisContract.2.2 DIR Registration. No contractor or subcontractor may be listed on a bid proposal orawarded any contract for the project unless registered with the California Departmentof Industrial Relations (DIR) pursuant to Labor Code section 1725.5, with limitedexceptions from this requirement for bid purposes only under Labor Code section1771.1(a). This project is subject to compliance monitoring and enforcement by theDIR.`2.3 CARB Requirements. Effective January 1, 2024, amendments to California AirResources Board (“CARB”) In-Use Off-Road Diesel-Fueled Fleets Regulation requirethe Port to obtain valid Certificates of Reported Compliance (“CRC”) from allcontractors and listed subcontractors who own or employ equipment subject to saidRegulation before awarding the Project. Bidders must demonstrate their compliancewith the Regulation as provided in paragraph 20 below.3. DETERMINATION OF SUCCESSFUL BIDDER. Port staff will recommend that the Boardaward this Contract to up to three contractors whose Bids meet all of the Bid requirements,and which, as determined by the Executive Director, best meet the needs of the Port.Comparison of bid prices will be based on Total Bid Price. The Port reserves the right to awardone, two or three contracts, if it determines that such awards will best meet the needs of thePort.4. REQUIRED BID FORM. Bidders must submit Bids on Document 00400, Bid Form. The Portwill reject as non-responsive any Bid not submitted on the required form. Bids must be full andcomplete. Bidders must complete all Bid items and supply all information required by BiddingDocuments. The Port reserves the right in its sole discretion to reject any Bid as non-responsiveAA-4378/M24013/M2401400200-1ADDENDUM NO. 4On-Call Marine Structures Rehabilitation Commencing July 1, 20262025-10-M1as a result of any error or omission in the Bid. Bidders must submit clearly written Bids, and thePort reserves the right to reject any Bid not clearly written. Bidders may not modify the Bid Formor qualify their Bids. The Bid must be clearly and distinctly written without any erasure orinterlineation. Any changes in the Bid shall be clearly made, with the original entry crossed outand the new entry initialed by the Bidder.5. REQUIRED BID SECURITY. Bidders must submit with their Bids a corporate surety bondfurnished by a surety authorized to do a surety business in the State of California, in the amountof Two Hundred Thousand and No/100 Dollars ($200,000.00), payable to the Port of Oakland.The Port will provide the required form of corporate surety bond, Document 00411, BondAccompanying Bid. The Port will reject as non-responsive any Bid submitted without thenecessary Bid security. As soon as practicable after the Bid opening, if there are more thanthree (3) responsive Bidders, all Bid securities and Bid bonds except for those of the successfulBidders will be returned to the other Bidders. The remaining Bid securities and Bid bonds willbe retained until award of the contract to the successful Bidder, at which time the Bid securitiesand Bid bonds of the second and third lowest bidders, if applicable, shall be returned. The Bidsecurity and Bid bond of the successful Bidder will be returned after execution of the contractand deposit of all necessary bonds and other items.6. REQUIRED SUBCONTRACTORS LISTS. For purposes of this Project only, listing ofsubcontractors, suppliers and trucking brokers on Document 00430, Port of OaklandSubcontractor and Supplier List Form, is optional. Please note that for purposes of this Projectonly, preference points will not be credited for participation by LIABE or LBABE subcontractors,suppliers and trucking brokers.Prior to commencement of each instance of work, the Contractor awarded this annual contractwill be required to submit the names of all subcontractors and their respective item of work onDocument 00430S, Port of Oakland Supplemental Subcontractor and Supplier List Form forAnnual Contract, as instructed therein, for those subcontractors who will perform any portion ofwork, including labor, rendering of service, or specially fabricating and installing a portion of thework or improvement according to detailed drawings contained in the plans and specifications,in excess of one-half of one percent (0.5%) of the estimated cost of the instance of work to beperformed. The Contractor must also submit the names of all trucking brokers, on Document00430S, Port of Oakland Supplemental Subcontractor and Supplier List Form for AnnualContract, regardless of whether the broker’s portion of the work will or will not exceed one-halfof one percent (0.5%) of the estimated cost of the work to be performed.7. REQUIRED NON-COLLUSION DECLARATION. Bidders must submit with their BidsDocument 00481, Non-Collusion Declaration. The Port will reject as non-responsive any Bidsubmitted without the Non-Collusion Declaration. No Bidder may make or file or be interestedin more than one Bid for the same supplies, services or both.8. REQUIRED BIDDER’S CERTIFICATIONS. Bidders must submit with their Bids Document00482, Bidder Certifications. The Port will reject as non-responsive any Bid submitted withoutthe Bidder Certifications.9. PRE-BID CONFERENCE AND SITE VISITS. The Port will conduct a pre-bid meeting for thiscontract at 11:00 am on Tuesday, May 5, 2026. The meeting will be conducted via Zoomvideoconferencing. The Zoom meeting ID is 401 387 0221. Submission of a Bid signifies carefulexamination of Bidding Documents and complete understanding of the nature, extent andlocation of Work to be performed. Bidder must complete the tasks listed in Document 00520,Agreement, Article 5, as a condition to bidding, and submission of Bid shall constitute theBidder's express representation to the Port that Bidder has fully completed these tasks.11. EXISTING CONDITIONS AND GEOTECHNICAL DATA. Bidders may examine any availableexisting conditions information by giving the Port reasonable advance notice. The Port will notbe responsible for accuracy of existing drawings or geotechnical data. Document 00320,Existing Conditions and Geotechnical Data, applies to all supplied existing drawings andgeotechnical reports, and all other information supplied regarding existing conditions eitherabove ground or below ground.12. ADDENDA. Bidders must direct all questions about the meaning or intent of the BiddingDocuments to the Port. Interpretations or clarifications considered necessary by the Port inresponse to such questions will be issued by Addenda posted athttp://www.portofoakland.com/Bids. Notification of the issuance of Addenda will be faxed oremailed to each Bidder at the fax number or email address supplied to the Port by the Bidder.Questions received less than seven (7) days prior to the date for opening Bids may not beanswered. Only questions answered by formal written Addenda will be binding. Oral andother interpretations and clarifications will be without legal effect.a. Addenda may also be issued to modify the Bidding Documents as deemed advisableby the Port.b. Addenda shall be acknowledged in Bid Form by number and shall be part of theContract Documents. A complete listing of Addenda may be secured from the Port.c. Addenda will be issued only by the Port of Oakland and only in writing.
