In accordance with the Missouri Sunshine Law, RSMo610.021., proposals will be opened on said date and time and only the bidder name and baseproposal price will be read aloud. All other documents will be checked for responsivenessafter Bid opening.The specific locations of the work to be done shall be contained in the special provisionssection of the bid document. The Contractor shall bid on all work.All equipment, materials, and workmanship must be in accordance with the Specificationsand other Contract Documents.A Pre-Bid Meeting will be held on January 27th, 2026 at 10:30 am CST at the Carson RossCommunity Recreation Complex. Attendance at the pre-bid meeting is required to bidon the mowing service. Addenda will be issued as the City deems necessary.Pursuant to 610.021 RSMo Item 12, all documents within a request for proposal will becomeopen record to the public upon a negotiated contract being executed. All documents withina request for bid become open record as soon as the bid is opened. Bidders and proposersshould be aware that all documents within a submittal will become open records.The City reserves the right to reject any or all proposals and to waive informalities ordeficiencies therein to negotiate with any or all bidders or others for more favorable termsor prices and to award a contract to other than the bidder submitting the lowest cost bidproposal with or without negotiation and to determine which is the lowest, best, and mostresponsive to accept, at its option, any alternates and to approve the bond.In no event shall the City be liable to the Contractor for special, indirect, or consequentialdamages. The maximum liability of the City shall be limited to the amount of money to bepaid or received by the City under this Contract.The Contractor shall defend, indemnify, and hold the City and its elected or appointedofficials, officers, employees, and agents harmless from and against all actual claims andalleged claims and all damages, including but not limited to losses, liabilities, costs, expensesand attorney fees arising out of personal injuries, including illness or death, and damage to,Right of Way Mowing Servicesor destruction of, property, which are caused by the Contractor or the Contractor’s agents,employees, sub-contractors or by others for whom Contractor is liable arising out of or inany way connected with or resulting from, performance of, or failure to perform, thiscontract, regardless of whether or not caused in part by any act or omission of City, itselected or appointed officials, officers, employees or agents. Contractor affirms that it hashad the opportunity to recover the costs of the liability insurance required in this Contract inits Contract price.The Contractor shall indemnify and hold the City harmless from all wages or overtimecompensation due its employees in rendering services pursuant to this contract, includingpayment of reasonable attorneys' fees and costs in the defense of any claim made under theFair Labor Standards Act, the Missouri Prevailing Wage Law, or any other federal or state law.The indemnification obligations of Contractor hereunder shall not be limited by anylimitations as to the amount or type of damages, compensation, or benefits payable by orfor the Contractor, under any federal or state law, to any person asserting the claim againstCity, its elected or appointed officials, officers, agents and employees, for whichindemnification is sought.The indemnification obligations herein shall not negate, abridge, or reduce in any way anyadditional indemnification rights of the City, its elected or appointed officials, officers, agentsand employees, which are otherwise available under statute, or in law or equity.All the provisions in this RFP, which becomes part of the Agreement, are subject to the termsof Missouri Sovereign Immunity as set forth in section 537.610.2 and 537.610.5 of theMissouri Revised Statutes. Further, this Contract is not intended to act as a waiver orlimitation of City, or any of its officer’s, agent’s or employee’s rights and/or defensesregarding sovereign or any other immunity or defense under Federal Law, Missouri Law orMunicipal Regulation.Request for ProposalsI.INTRODUCTIONThe City of Blue Springs, Missouri (hereafter referred to as “the City”) is seeking proposalsfrom qualified vendors to provide transportation, equipment, supplies, materials, and laborto perform mowing services for the Parks and Recreation Department on city right of waysand city owned properties.II. SCOPE OF WORKMowing of City Right-of-Ways and City PropertiesCity of Blue Springs, Missouri (“the City”)Right of Way Mowing Services1. General DescriptionThe Contractor shall provide all labor, equipment, supervision, and materials necessary tomow and maintain grass areas located within the City’s rights-of-way and City-ownedproperties, as directed by the City. All work shall be completed in a professional, safe, andworkmanlike manner.2. Mowing RequirementsAll grass shall be mowed to an approximate height of three and one-half (3½) inches,unless otherwise directed by the City’s Project Manager. Mowing shall include trimmingaround trees, poles, signs, fences, buildings, shrub beds, irrigation heads, curbs, sidewalks, and walkways. Turf shall be cutevenly and professionally. The Contractor shall not scalp turf, leave uncut areas, or leavewindrows or clumps of grass clippings. Any clippings discharged onto streets, sidewalks,parking lots, buildings, vehicles, or landscaping beds shall be removed and cleaned aftereach mowing. All plant growth in cracks, seams, or joints of paved surfaces such assidewalks, curbs, and driveways shall be cut down to pavement level during each mowingcycle. Herbicide use is not allowed unless prior written approval is given by the ProjectManager.3. Mowing Schedule and SeasonMowing shall occur on a rotating schedule of no less than every seven (7) days and nomore than every fourteen (14) days, as outlined in the bid documents. The mowing seasonshall include a minimum of twelve (12) guaranteed mowings. Additional mowings may berequested by the Project Manager and shall be billed separately at the contract rate. TheCity reserves the right to cancel scheduled mowings due to weather conditions or slowgrass growth, especially during periods of extreme heat. The total number of mowings in aseason may be up to thirty (30). The Contractor shall not be paid for mowing cyclescanceled by the City.4. Protection of City PropertyThe Contractor shall take special care to avoid damage to irrigation systems, landscaping,mulch rings, trees, and buildings. Damage caused by trimming or mowing shall be theresponsibility of the Contractor. If repeated wear causes bare spots, the Contractor shallrepair the area by reseeding or sodding using materials approved by the Project Manager,at no additional cost to the City.5.
