Louisiana R.S. 38:22123.4.4It shall be the Quoter’s responsibility to make inquiry as to the Addenda issued.4.0EXISTING CONDITIONS4.1Quoters are cautioned not to submit their quotes until said plans, specifications, and profiles have been carefullyexamined by them.4.2Each quoter shall fully acquaint himself with conditions relating to the scope and restrictions attending theexecution of the work under the conditions of this quote.4.3The failure or omission of a quoter to acquaint himself with existing conditions shall in no way relieve him of anyobligation with respect to this quote or to the contract.5.0PERFORMANCE/PAYMENT/MAINTENANCE BOND5.1An acceptable Performance/Payment/Maintenance Bond will be required of the successful quoter as follows:5.1.1When the total contract amount with alternates is $50,000 or more, a 100% performance bond shall be required.5.1.25.1.3When the total contract amount with alternates is $25,000 or more, a 50% payment bond shall be required.When the total contract amount with alternates is $20,000 or more, a two-year 10% maintenance bond shall berequired.6.0BONDING REQUIREMENTS FOR NONRESIDENT CONTRACTORS6.1The 1986 Regular Session of the Louisiana Legislature enacted important changes in the registration and bondingrequirements of nonresident contractors.Page 4 of 48CITY OF SHREVEPORT SPECIAL INSTRUCTION/PROVISIONS CONTINUED6.2Beginning January 1, 1987, the Department’s registration and bonding requirements must be met before thenonresident contractor can obtain any building permit, license or certificate necessary to lawfully commence anyconstruction project.6.3Any person failing to register any contract or execute the bond required by the statutes may be denied the right toperform such contracts.6.4A temporary injunction may be issued to prevent any activities in the performance of such contracts until thecontractor complies with the necessary requirements.6.5The Secretary of the Department may also impose a penalty in the amount of $200 or 2% of the constructioncontract, whichever is greater.6.6Louisiana Revised Statute 47:9A (2) defines resident and nonresident contractors. Contractors who meet thefollowing conditions are considered resident contractors for purposes of taxation by the Department:6.7Individual who has maintained their permanent domiciles in Louisiana for at least one year prior to quoted work.6.8Corporations which have operated permanent business facilities in Louisiana for at least one year prior toQUOTED work.6.9Corporations with at least 50% of outstanding and issued common stock owned by individuals who havemaintained their domiciles in Louisiana for at least one year prior to QUOTED work.6.10Partnerships, associates, and other legal entities in which resident corporations or individuals have at least a 50%ownership interest shall be considered resident contractors.6.11A contractor who does not meet these conditions will be considered a nonresident contractor and will be subject tothe contract registration and bonding requirements of the Department.6.12For questions or additional information, call the Sales Tax Section at 225/219-7656 Option 1.6.13Employers Required to File Form L-3.6.14Every employer must file an Employer’s Annual Reconciliation of Louisiana Income Tax Withheld (Form L-3) on orbefore January 31 of the current calendar year, accompanied by copies of the employees’ W-2 forms and Wageand Tax Statement forms (Form L-2).6.15Pre-addressed forms are included in the Employer’s Withholding Tax Returns and Reconciliation coupon booklets.6.16Any employer, who fails to receive a pre-addressed form, should notify the Withholding Tax Unit of theDepartment.7.0AWARD CRITERIA7.1Award will be made to the lowest responsible and responsive Quoter according to the criteria designated in theRFQ.7.2In addition to price, the Quote Evaluation will include the following factors (as they apply):7.2.1The quality of performance/workmanship of previous contracts, or references which attest to the specificexperiences of others.7.2.2The timely completion of previous contracts, or references which attest to the specific experiences of others.7.2.3The sufficiency of financial resources and its impact on ability of the Quoter to perform the contract.7.2.4The City reserves the right to conduct on-site inspections of any quoter’s facilities prior to award and the results ofsaid inspection will be considered by the City in determining Quoters’ capabilities of successfully administering tothis contract.7.2.5The ability and availability of the Quoter to provide quality and timely maintenance, service, and/or parts.7.2.6The cost of maintenance and operational costs.7.2.7The availability and capability of local support as it affects the quantity, quality, and timeliness of the work required.7.2.8The timely completion of a project as stated in the RFQ.7.2.9Substantial compliance or noncompliance with specifications set forth in the RFQ as determined by the City.Page 5 of 48
