Mullen Park.Sealed bids will be received until 10:00 AM, Monday, December 22, 2025, in the McAlester CityClerk’s Office on the second floor of the McAlester City Hall at 28 E Washington Ave., McAlester,Oklahoma 74501. All bids received by the specified time will be opened at 1:00 PM in the City CouncilChamber on the first floor of City Hall. All bids shall remain on file at least forty-eight (48) hours beforea contract will be made and entered into thereon. Bids received more than ninety-six (96) hours prior tothe Bid Opening will be returned.The Notice to Bidders; Form of Bid; Form of Contract; Plans and Specifications; Forms of Bid Bond,Performance Bond, Statutory Bond and Maintenance Bond; and other Contract Documents may beexamined at the Office of the City Clerk, on the first floor of the McAlester City Hall.All Bidders must be registered with SAM.gov. Interested persons may be added to the list ofpotential bidders by emailing a request to the Central Purchasing Agent.Conflicts between DocumentsIn the event of a conflict between the Specifications and the Supplemental Conditions, the latter shallgovern. In the event of a conflict between the Plans and Specifications, the Specifications shall govern.Bid SubmissionMULLEN PARK IMPROVEMENTS RFP# 2025-0083Bids must be sealed. Each sealed envelope containing a bid must be plainly marked on the bottom left-hand corner of the bid envelope “Mullen Park Improvements RFP# 2025-008”. The envelope must alsobear on the outside the bidder’s name and address. If forwarded by mail, the sealed envelope containingthe bid must be enclosed in another envelope addressed to the City of McAlester at the address above.Bids shall consist of returning the following completed forms, all of which are found in this solicitationpackage:Bid FormBid BondBusiness Relationship AffidavitNon-Collusion AffidavitEach bidder shall accompany his original bid, filed with the City of McAlester, with a certified orcashier’s check on a solvent bank located in Oklahoma or a Bid Bond in the amount of five percent (5%)of the amount bid, as a guarantee of his ability to perform the contract bid upon, and that he will enterinto a written contract with the City of McAlester or its agent to perform said work and/or furnish saidmaterials in accordance with said plans and specifications and furnish the required bonds within ten (10)days after acceptance of his bid.After the bid prices have been compared, the City of McAlester will return the bid bonds of all exceptthe three (3) lowest responsive responsible bidders. The bid bond of the successful bidder will beretained until the Performance Bond, Statutory Bond, Maintenance Bond and Certificate of Insurancehave been executed and approved, after which it will be returned. The bid security of the two (2)remaining unsuccessful bidders will be returned after the successful bidder has entered into a contractand has furnished the required bonds and insurance.Each bidder shall accompany his bid with a sworn statement in writing that the Bidder has not directlyor indirectly entered into an agreement, express or implied, with any other bidder concerning the price oramount of such bid or any bids, the limiting of the bids or bidders, the paying to anyone any money forpromotion expenses, the parceling or farming out to any bidder or bidders or other persons of any part ofthe contract or any part of the subject matter of the bid or of the profits thereof.Performance, Maintenance and Statutory Payment Bonds in the amount of one hundred percent (100%)of the contract price with a Corporate Surety licensed in Oklahoma and approved by the City ofMcAlester will be required for the faithful performance of the contract, and the bidder shall state in theproposal the name and address of the Surety or Sureties who will sign this bond in case the contract isawarded to him. The Maintenance Bond required will guarantee the repair of all damage due toimproper materials or workmanship for a period of one (1) year after the acceptance of the work by theCity of McAlester. Attorneys-in-fact who sign Bid Bonds and other bonds must file with each bond acertified and effective dated copy of their Power of Attorney.Equal Opportunity in EmploymentMULLEN PARK IMPROVEMENTS RFP# 2025-0084All qualified applicants will receive considerations for employment without regard to race, color,religion, sex, national origin, age or physical handicap. Bidders on this project will be required tocomply with the State of Oklahoma Title VII.Bid, Award, and ContractAll bids must be made on the required bid form. All blank spaces for bid prices must be filled in, in inkor typewritten, and the bid form must be fully completed and executed when submitted. Bidder mustsubmit three (3) copies of their proposal.Conditional bids shall not be accepted. Tie bids are non-restrictive: In order for a tied bid proposal to beaccepted, it must be lower than the sum of low separate bids.The City of McAlester may waive any informalities or minor defects or reject any and all bids. Any bidmay be withdrawn prior to the above scheduled time for the opening of bids or authorized postponementthereof. Bids received more than ninety-six (96) hours before the time specified, and bids received afterthe time set for opening bids will not be considered and will be returned unopened. No bidder maywithdraw a bid within sixty (60) days after the actual date of the opening thereof. Should there bereasons why the contract cannot be awarded within the specified period, the time may be extended bymutual agreement between the City of McAlester and the bidder.Bidders must satisfy themselves of the accuracy of the estimated quantities in the bid scheduled byexamination of the site and a review of the drawings and specifications, including Addenda. After bidshave been submitted, the Bidder shall not assert that there was a misunderstanding concerning thequantities of work or the nature of the work to be done.The City of McAlester shall provide to bidders prior to bidding all information that is pertinent to, anddelineates and describes, the land owned and rights-of-way acquired or to be acquired.The Contract Documents contain the provisions required for the construction of the project. Informationobtained from an officer, agent or employee of the City of McAlester or any other person shall not affectthe risks or obligations assumed by the contractor or relieve the contractor from fulfilling any of theconditions of the contract.PRE-BID CONFERENCEBidders are invited to attend a pre-bid conference to be held at 1:00 PM, Wednesday, December 10,2025, at William P. Mullen Park located at North A Street and W. Springer Ave. in McAlester, OK.Attendance at the pre-bid meeting is encouraged but is not mandatory. Bids will be accepted frombidders who do not attend the meeting.
