Thebidder’s security shall be in the amount of five percent (5 %) of the bid and shall be in the form of acashier’s check or a certified check drawn on an FDIC insured bank in Iowa or on an FDIC insured bankchartered under the laws of the United States; or a certified share draft drawn on a credit union in Iowa orchartered under the laws of the United States; or a bid bond on the form provided in the contractdocuments executed by a corporation authorized to contract as a surety in the State of Iowa. The bid shall contain nocondition except as provided in the specifications.Drug Free WorkplaceThe City of Cedar Rapids seeks to enhance worker safety by creating workplaces that are free of drugsand substance abuse. All contractors and subcontractors shall be responsible for pre-employment drugscreening of prospective employees. All contractors and subcontractors shall have in place a drug andalcohol testing policy that conforms to the requirements of Iowa Code, and will be required to submit withtheir bid an acknowledgement attesting to this practice.Applicable Laws and RegulationsBy virtue of statutory authority, preference will be given to products and provisions grown and coalproduced within the State of Iowa, and to Iowa domestic labor, to the extent lawfully required under IowaCode Chapter 73.In accordance with Iowa statutes, a resident bidder shall be allowed a preference as against anonresident bidder from a state or foreign country if that state or foreign country gives or requires anypreference to bidders from that state or foreign country, including but not limited to any preference tobidders, the imposition of any type of labor force preference, or any other form of preferential treatment tobidders or laborers from that state or foreign country. The preference allowed shall be equal to thepreference given or required by the state or foreign country in which the nonresident bidder is a resident.In the instance of a resident labor force preference, a nonresident bidder shall apply the same residentlabor force preference to a public improvement in this state as would be required in the construction of apublic improvement by the state or foreign country in which the nonresident bidder is a resident.Non-Discrimination NoticeThe City of Cedar Rapids, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252,42U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation,Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-assisted programs of theDepartment of Transportation issued pursuant to such Act, hereby notifies all bidders that it willaffirmatively insure that in any contract entered into pursuant to this advertisement, minority businessenterprises will be afforded full opportunity to submit bids in response to this invitation and will not bediscriminated against on the grounds of race, color, or national origin in consideration for an award.OWNER’s Right to Reject BidsThe City Council of the City of Cedar Rapids reserves the right to reject any and all bids, to waiveinformalities and technicalities, and to enter into such contracts as it deems to be in the best interest ofthe City. The City reserves the right to defer acceptance of any proposal for 60 calendar days after thebids have been received and opened.Source of PaymentCash shall be derived from special assessments not pledged to the payment of special assessmentbonds, from the sale of special assessment bonds to be issued in accordance with Chapter 384 of theCode of Iowa, as amended, and in anticipation of the collection of said special assessments. An estimateof special assessments is on file with the City Clerk. Special Assessment bonds to be sold by the Cityshall not be less than the par value thereof plus accrued interest.If no bids are received for the special assessment bonds at public sale, the bonds may bear interest at thehighest rate of interest permitted by law to be paid on the special assessments on the date of levy. Ifconstruction warrants or City cash funds are used during construction in making progress payments, suchwarrants or cash payments shall be exchanged for the bonds.
