Also, the bidtabulation will be posted, as always, to the Purchasing webpage once available.Bid responses must be made on the standard proposal forms, be enclosed in a sealed package bearingthe name and address of the bidder and the “BID TITLE NAME & CONTRACT #” on the outside,addressed to Melissa A. Kosensky, Purchasing Agent, at the address above.Specifications and instruction to bidders may be obtained at the County Purchasing Office or theSomerset County Park Commission website at www.somersetcountyparks.org and on the SomersetCounty website www.somersetcountynj.gov.Any Bid Addenda will be issued on the County and Somerset County Park Commission websites, andprocessed in accordance with N.J.S.A. 40A:11-23(c)(1). All interested bidders should check the websitefrom now through bid opening. It is the sole responsibility of the respondent to be knowledgeable of alladdenda related to this procurement.Bidders shall comply with the requirements of N.J.S.A. 10:5-31 and N.J.A.C. 17-27 et seq.Melissa A. Sealed bids shall be received in accordance with public advertisement as required by law, acopy of said notice being attached hereto and made a part of these specifications.B. Each bid shall be submitted on the proposal form attached, in a sealed envelope(1) Addressed to the Purchasing Agent(2) Bearing the name and address of the bidder on the outside(3) Clearly marked “BID” with the contract name and number being bid. Provide One (1)Original & One (1) copy of the bid. Faxed or emailed bids will NOT be accepted.C. It is the bidder’s responsibility to ensure that bids are presented to the Purchasing Agent onthe hour and at the place designated. Bids may be hand delivered or mailed; however, theSomerset County Park Commission disclaims any responsibility for bids forwarded by regularor express mail. If the bid is sent by express mail, the designation in B. above mustalso appear on the outside of the express company envelope. Bids received after thedesignated time and date will be returned unopened.D. The Somerset County Park Commission reserves the right to postpone the date forpresentation and opening of bids and will give written notice of any such postponement toeach prospective bidder as required by law.E. Sealed bids forwarded to the owner before the time of opening of bids may be withdrawnupon written application of the bidder who shall be required to produce evidence showingthat the individual is or represents the principal or principals involved in the bid. Once bidshave been opened, they shall remain firm for a period of sixty (60) calendar days.F. Each bid proposal form must give the full business address, business phone, fax, e-mail, thecontact person of the bidder, and be signed by an authorized representative as follow:• Bids by partnerships must be signed in the partnership name by one of the members ofthe partnership or by an authorized representative followed by the signature anddesignation of the person signing.• Bids by corporations must be signed in the legal name of the corporation, followed by thename of the State in which incorporated and must contain the signature and designationof the president, secretary or other person authorized to bind the corporation in thematter.• Bids by sole-proprietorship shall be signed by the proprietor.• When requested, satisfactory evidence of the authority of the officer signing shall befurnished.G. Multiple Bids Not AcceptedMore than one bid from an individual, a firm or partnership, a corporation or associationunder the same or different names shall not be considered.H. Official Request for Bid packages are available from the County’s and Somerset County ParkCommission websites at www.somersetcountynj.gov and www.somersetcountyparks.org atno cost to the prospective bidders. All addenda are posted on both site’s and issued inaccordance with N.J.S.A. 40A:11-23(c)(1). Potential bidders are cautioned that they arebidding at their own risk if a third party supplied the specifications that may or may not becomplete. The Somerset County Park Commission is not responsible for third party suppliedspecifications.I. Results of all bids are posted on the County and Somerset County Park Commission’swebsite.REV 9/202422. BID SECURITYThe following provisions, if indicated by an (X), shall be applicable to this bid and bemade a part of the bidding documents:A. BID GUARANTEEBidder shall submit with the bid a certified check, cashier’s check or bid bond in the amountof ten percent (10%) of the total price bid, but not in excess of $20,000, payableunconditionally to the Somerset County Park Commission.When submitting a Bid Bond, it shall contain Power of Attorney for full amount of Bid Bondfrom a surety company authorized to do business in the State of New Jersey and acceptableto the Somerset County Park Commission.The check or bond of the unsuccessful bidder(s) shall be returned as prescribed by law. Thecheck or bond of the bidder to whom the contract is awarded shall be retained until acontract is executed and the required performance bond or other security is submitted.The check or bond of the successful bidder shall be forfeited if the bidder fails to enter into acontract pursuant to statute. Failure to submit required guarantee shall be cause forrejection of the bid.B. CONSENT OF SURETYBidder shall submit with the bid a Certificate (Consent) of Surety with Power of Attorney forfull amount of bid price from a Surety Company authorized to do business in the State ofNew Jersey, and acceptable to the Somerset County Park Commission stating that it willprovide said bidder with a Performance Bond in the full amount of the bid. This certificateshall be obtained in order to confirm that the bidder to whom the contract is awarded willfurnish Performance and Payment bonds from an acceptable surety company on behalf ofsaid bidder, any or all subcontractors or by each respective subcontractor or by anycombination thereof which results in performance security equal to the total amount of thecontract, pursuant to N.J.S.A. 40A11-22.Failure to submit this shall be cause for rejection of the bid.C. PERFORMANCE BONDSuccessful bidder shall simultaneously with the delivery of the executed contract, submit anexecuted bond in the amount of one hundred percent (100%) of the acceptable bid assecurity for the faithful performance of this contract.The performance bond provided shall not be released until final acceptance of the wholework and then only if any liens or claims have been satisfied. The surety on such bond orbonds shall be a duly authorized surety company authorized to do business in the State ofNew Jersey pursuant to N.J.S.A. 17:31-5. For multi-year contracts, the Performance Bondmay be resubmitted each year on the Contract Anniversary Date for the amount remainingon the contract.Failure to submit this with the executed contract shall be cause for declaring contract nulland void pursuant to N.J.S.A. 40A:11-22.D. LABOR AND MATERIAL (PAYMENT) BONDThe successful bidder shall with the delivery for the performance bond submit an executedpayment bond to guarantee payment to laborers and suppliers for the labor and materialused in the work performed under the contract.REV 9/20243Failure to submit a labor and material bond with the performance bond shall be cause fordeclaring the contract null and void.E. MAINTENANCE BONDUpon acceptance of the work by the Somerset County Park Commission, the contractor shallsubmit a maintenance bond (N.J.S.A. 40A:1-16.3) in an amount not to exceed 100% of theproject costs guaranteeing against defective quality of 3work or materials for the period of:1 Year2 Years3. PREPARATION OF BIDS (PRICING INFORMATION AND FORMS)A. (1). The Somerset County Park Commission is exempt from any local, state or federal sales,use or excise tax. Somerset County Park Commission shall not pay for New Jersey StateSales and Use Tax that are included in any invoices. Somerset County Park Commission willnot pay service charges such as interest and late fees.(2). The Somerset County Park Commission or any of its offices and divisions will notcomplete credit applications as a result of contract(s) resulting from award based onthese specifications.The County of Somerset is rated by:Standard & Poor’s Ratings Group: AAAMoody’s Investors Services: AaaDun and BradstreetB. Bid responses shall be signed in ink (Original Signature Required) by the bidder; allquotations shall be made with a typewriter/computer or pen and ink. Any quotation showingany erasure alteration must be initialed by the bidder in ink. Unit prices and totals are to beinserted in spaces provided.C. Failure to sign and give all information in the bid may result in the bid being rejected.D. Estimated Quantities (Open-Ended Contracts, Purchase as Needed) The Somerset CountyPark Commission has attempted to identify the item(s) and the estimated amounts of eachitem bid to cover its requirements; however, past experience shows that the amount orderedmay be different than that submitted for bidding. The right is reserved to decrease orincrease the quantities specified in the specifications pursuant to N.J.A.C. 5:30-11.2 and11.10. NO MINIMUM PURCHASE IS IMPLIED OR GUARANTEED.E. Bidders shall insert prices for furnishing goods and services required by these specifications.Prices shall be net including any charges for packing, crating, containers etc. Alltransportation charges shall be fully prepaid by the contractor, F.O.B. destination andplacement at locations specified by the Somerset County Park Commission. As specified,placement may require inside deliveries. No additional charges shall be allowed for anytransportation costs resulting from partial shipments made for the contractor’s convenience.F. Any bidder may withdraw their bid at any time before the time set for receipt of bids.G. All forms shall be completed and attached to the bid proposal. BIDDER IS ALERTED TO THEBID DOCUMENT CHECK LIST PAGE.H. Results of all bids are posted on the County website www.somersetcountynj.gov andSomerset County Park Commission web site www.somersetcountyparks.orgREV 9/202444. FIRM FIXED CONTRACTThis is a firm fixed contract, prices firm, FOB Somerset County Park Commission locations. Noprice escalation. The vendor shall void the contract and permit the Somerset County ParkCommission to solicit open market pricing should any price increase or surcharge be imposed.5. INTERPRETATIONS AND ADDENDAA. The bidder understands and agrees that its bid is submitted on the basis of the specificationsprepared by the Somerset County Park Commission. The bidder accepts the obligation tobecome familiar with these specifications.B. Bidders are expected to examine the specifications and related documents with care andobserve all their requirements. Ambiguities, errors or omissions noted by bidders should bepromptly reported in writing to the Purchasing Agent. In the event the bidder fails to notifythe Somerset County Park Commission of such ambiguities, errors or omissions, the biddershall be bound by the bid.C. No oral interpretation of the meaning of the specifications will be made to any bidder. Everyrequest for an interpretation shall be in writing, addressed to the Purchasing Agent,referencing the Contract Name and Contract Number in the subject line, atPurchasingDiv@somersetcountynj.gov. In order to be given consideration, written requestsfor interpretation and or clarification must be received at last three (3) business days prior tothe date fixed for the opening of the bids.D. All interpretations, clarifications and any supplemental instructions will be in the form ofwritten addenda to the specifications, and will be distributed to all prospective bidders. Alladdenda so issued shall become part of the specification and bid documents, and shall beacknowledged by the bidder by completing the Acknowledgement of Receipt of Addendaform. The Somerset County Park Commission’s interpretations or corrections thereof shallbe final.Pursuant to N.J.S.A. 40A:11-23(c)(1) when issuing addenda, the owner shall providerequired notice prior to official receipt of bids to any person who has submitted a bid or whohas received a bid package. They will be sent via electronic transmissions to those knownrecipients of the bid specifications.E. Discrepancies in Bids1. If the amount shown in words and its equivalent figures do not agree, the written wordsshall be binding. Ditto marks are not considered writing or printing and shall not beused.2. In the event that there is a discrepancy between the unit prices and the extended totals,the unit prices shall prevail. In the event there is an error of the summation of theextended totals, the computation by the Somerset County Park Commission of theextended totals shall govern.6. BRAND NAMES, STANDARDS OF QUALITY AND PERFORMANCEA. Brand names and or descriptions used in this bid are to acquaint bidders with the type ofcommodity desired and will be used as a standard by which alternate or competitivematerials offered will be judged. Competitive items must be equal to the standard describedand be of the same quality of work.B. Variations between the goods and services described and the goods and services offered areto be fully identified and explained by the bidder on a separate sheet and submitted with thebid proposal form. Vendor’s literature will not suffice in explaining exceptions to thesespecifications. In the absence of any exceptions by the bidder, it will be presumed andrequired that materials as described in the proposal be delivered.REV 9/20245
