INTRODUCTION: The Texas Parks and Wildlife Department (TPWD) is soliciting bids to provide a newcontroller, air charging compressor, and other related equipment at the water treatment plant in order to replacea failing system at Lake Corpus Christi State Park located in San Patricio County, Texas per the specificationsprovided herein.1.1. The Owner will not acknowledge or receive Bids that are delivered by mail, telephone, or facsimile (fax).Properly submitted Bids will not be returned to the Bidders. Submitted Bids become the property of Owner.1.2. Documentation for this Invitation for Bids is available in Electronic State Business Daily (ESBD) and TexasParks and Wildlife (TPWD) websites. All bids must be submitted via electronic mail (email). Email your biddocuments to Anthony.Habermann@tpwd.texas.gov with INFContracting@tpwd.texas.gov on copy.1.3. Bids will only be accepted from Bidders when submitted to the Owner via electronic mail (email) NO LATERTHAN 2:00 PM CT, December 11, 2025. TERM OF CONTRACT: All Work shall be completed within sixty (60) calendar days commencing on the datespecified in the Authorization to Proceed. This performance period includes completing the various aspectsrequired to complete the Work, including submission of all submittals, mobilization, procurement, installation,testing, inspection and delivery of documents described in the solicitation and contract documents.2.1. This Contract is contingent upon the continued availability of funding. If funds become unavailable throughlack of appropriations, legislative budget cuts, amendment of the Appropriations Act, state agencyconsolidations, or any other disruption of current appropriations, provisions of the Termination Article inAttachments A - General Terms and Conditions for Minor Repair shall apply.2.2. The Purchase Order (Contract) may be extended by TPWD because of changes ordered in the work ordue to unforeseeable delays not within the control of or arising from the fault of either party. Claims orextensions of time must be made in writing and supported by sufficient written evidence to justify the claim.Claims for extensions of time shall be granted by written Purchase Order Change Notice.2.3. The Contract shall terminate upon full performance of all requirements contained in this Contract, unlessotherwise extended, as provided in accordance with the Contract terms and conditions.3. NON-MANDATORY SITE VISIT: Prospective bidders are strongly encouraged to visit the site to becomethoroughly familiar with site conditions and equipment needed to perform services prior to submitting a bid. Sitevisits must be scheduled in advance from November 17, 2025 through November 28, 2025 with the ParkSuperintendent, Kelly Malkowski, at (361) 537-7040 / Kelly.Malkowski@tpwd.texas.gov.Site is located at 23194 Park Road 25, Mathis, TX 78368.Note: Attendees should be prepared to tour the site by foot with proper clothing and footwear.4. STATEMENT OF WORK: Contractor shall provide all labor, materials, equipment, tools, bonding, insurance,and supervision necessary to perform the Water Plant Control Update as specified in Attachment B –Specifications. All work not specified and/or not shown in the specifications and pictures, but which isnecessary for the completion and/or functioning and operation of the Project, shall be understood and impliedas part of the Contract to be performed by the Contractor for the contract price. Such work shall be executedby the Contractor in the same manner and with the same character of material as other portions of the Contractwithout extra compensation.4.1. Service Requirement: Services shall include, but are not limited to, the requirements contained in thisIFB. Services set forth that contain the words “must” or “shall” are mandatory and must be provided asspecified with no alteration, modification, or exception. Services set forth that contain the words “may” or“can” allow Bidders to offer alternatives to the manner in which the commodities/services are provided.Awarded bidder must meet IFB criteria listed under Section 5 Minimum Qualifications. The requestedservices and corresponding deliverables are as follows:4.1.1. Furnish all labor, tools, equipment, materials and incidentals to perform the Water Plant ControlUpdate.4.1.2. Jobsite must be cleaned daily so as not to disrupt employees or normal operations of affectedarea(s).4.1.3. Upon completion of the work, area will be cleaned and all debris accumulated will be removed fromthe jobsite.4.1.4. Upon final acceptance of the work by TPWD, the Contractor shall furnish to TPWD the maximumavailable manufacturer’s warranty on all installed products. Material and labor on installation shallbe warranted by Contractor for a period of one-year.4.1.5. All work shall be performed during regular business hours unless scheduled and approved by ParkSuperintendent, Kelly Malkowski. Regular business hours are 8:00 AM – 5:00 PM, Monday throughFriday.4.2. Work Schedule: Contractor shall begin work as specified in the Notice to Proceed or Authorization toProceed with Construction Activities with all services within sixty (60) calendar days commencing on thedate listed in the Authorization to Proceed. A Contractor’s ability to meet this project schedule may be afactor in determining award. Contractor’s work hours shall be scheduled in advance with the TPWD ProjectManager.5. MINIMUM QUALIFICATIONS: Bidders shall complete and submit Attachment D – Contractor’sQualifications Form via email. Failure to properly complete and provide Attachment D – Contractor’sQualifications Form will result in disqualification of any bid that results from this IFB. TPWD may make suchinvestigations as necessary to determine the ability of the Contractor to perform the work and reserves the rightto reject any bid if the evidence submitted and/or obtained through investigation fails to satisfy TPWD that theContractor is properly qualified to carry out the obligations of the Agreement.Contractor must show evidence of at least three (3) and a maximum of five (5) successful CommercialPlumbing Installation projects of similar size, scope and complexity to that described in this IFB (as judgedby TPWD) in order to be considered for award. This experience must have occurred within the past five (5)years. Include a project description, contact names, position, company name, telephone number and emailaddress for each reference listed. Texas Board of Plumbing Examiners Plumbing licensure and an active TDLRLicense for all plumbing and electrical work are required.5.1. References must be verifiable by phone or email within ten (10) working days of bid evaluation.Note: A start up business is defined as a new company that has no previous operational history or expertise inthe relevant business and is not affiliated with a company that has that history of expertise.6. CONTRACTOR REQUIREMENTS:6.1. Contractor agrees to conduct all services under the Contract by and through appropriate communicationsas required by TPWD.6.2. Contractor understands and agrees that work, installation or any other service performed without the priorwritten approval of TPWD is work outside the scope of this Contract and shall be performed exclusively atContractor’s risk and own expense.6.3. Contractor is responsible for all materials and equipment stored at the work site.6.4. Contractor shall keep the premises clean on a continual basis and is responsible for the prompt removalof all debris, litter, waste materials, and rubbish regularly throughout the project.6.5. Contractor shall be solely responsible for the safe operation of all equipment used and for the safety of allpersonnel employed by or under contract to the Contractor.6.6. Contractor shall be solely responsible for any damage attributable to Contractor’s operation. Contractor,at its own expense, shall repair any such damage immediately. The repair work is subject to acceptanceby TPWD.6.7. Contractor shall provide all labor, equipment, supervision and any other necessary incidentals andmaterials to complete the project.6.8. Contractor shall be solely responsible for maintaining safety at all work sites. Contractor shall take allreasonable steps to ensure safety for both workers and the public, including traffic control.6.9. Contractor may be permitted to leave heavy equipment onsite per TPWD staff’s direction. TPWD will notbe responsible for contractor equipment left onsite.6.10. Contractor shall submit with reasonable promptness and in orderly sequence all shop drawings, samplesor other information required by the contract documents.6.11. Unless otherwise specified herein, the Contractor shall furnish and pay for all labor, materials, equipment,tools, construction equipment, and machinery, heat, transportation, and other facilities and servicesnecessary for the proper execution and completion of this contract.6.12. Contractor shall repair all defects in materials, equipment or workmanship appearing within one year fromthe date of acceptance and/or final completion of the work as a whole.7. TPWD RESPONSIBILITIES:7.1. TPWD will designate a Project Manager for this Contract who will serve as the point of contact betweenTPWD and Contractor. The instructions of the Project Manager and/or the Project Manager’s designatedrepresentative (hereinafter collectively referred to as the “TPWD PM”) are to be strictly and promptlyfollowed by Contractor at all times. The TPWD PM is to have free access to Contractor’s supplies,equipment, and work product at all times for inspection and audit.7.2. The TPWD PM will decide any and all questions that may arise as to the quality and acceptability of workperformed, and as to the manner of performance and rate of progress of the work. The TPWD PM willdetermine the amount of work performed and materials furnished which are to be paid under the contract.7.3. Failure of the TPWD PM during the progress of the work to: (i) discover or reject unacceptable work; (ii)discover work not in accordance with the contract; or, (iii) failure to exercise any remedies in connectiontherewith, shall not be deemed an acceptance thereof, nor a waiver, of TPWD’s right to full performanceof the contract.7.4. TPWD will furnish no material, labor, equipment, or facilities unless otherwise provided for in this contract.7.5. TPWD will monitor vendor performance. Failure to provide services in accordance with requirementsspecified herein and the resulting contract(s) and adherence to the TPWD Attachment A – GeneralTerms and Conditions for Minor Repair may be considered, by TPWD, as unsatisfactory performanceby the contractor. An unsatisfactory performance may result in a negative vendor performance report, orcancellation of the contract or both.8. SAFETY: All Contractors and subcontractors conducting work for TPWD shall abide by all Occupational Safetyand Health Administration (OSHA) rules and regulations provided by the Department of Labor, OSHA, Code ofFederal Regulations, Chapter 29. Employees of Contractor and subcontractors shall be trained in accordancewith Chapter 29, OSHA Regulations.8.1. Emergency: In any emergency affecting the safety of persons or property, the Contractor shall act, at theirdiscretion, to prevent threatening damage, injury or loss and notify TPWD within forty-eight (48) hours ifContractor believes that any significant changes in the work or variations from the Contract have beencaused by Contractor’s emergency response. Any additional compensation or extension of time claimedby the Contractor resulting from emergency work shall be considered in accordance with Attachment A -General Terms and Conditions for Minor Repair 09.9. ADDITIONAL SERVICES: Where found to be in the best interest of TPWD, this Contract may be amended inwriting to provide for additional services, provided that such additional services are within the original scopeand intent of the contract. In such cases, the contractor shall provide a written quotation for performing theadditional work. TPWD contracting section will execute a Change Order (amendment) for additional services,no additional services shall be performed without a fully executed amendment to the contract.10. QUANTITIES: Quantities listed are projected order quantities. TPWD reserves the right to increase or decreasequantities prior to award depending on bid results and budget constraints. Unless this solicitation documentstates otherwise, the resulting contract award does not guarantee volume or commitment of funds. TPWD willonly pay for actual goods received or services performed.11. INSURANCE: Upon acceptance of the bid that is considered to provide the best value to the State of Texas,the following insurance requirements shall be met by providing a current Certificate of Insurance andcorresponding policy endorsements.11.1.
