The City of Phenix City is seeking bids for BID # E26-01 Hot Mix Asphalt Paving, Roadway, Drainage and City Facility and Property Improvements

A bid bond or certified check in the amount of 5% of the total bid up to a maximum of tenthousand dollars ($10,000) must accompany the submitted bid. A performance bond in the amount of fifty thousand dollars ($50,000) valid for as long asthe contract is in effect, shall be submitted prior to beginning work.9. Proof of Liability Insurance and Workman’s Compensation Insurance shall be submittedbefore any work is started. The General Liability Insurance shall be a minimum of fivehundred thousand dollars ($500,000.00).10. Any exceptions and/or substitutions to the specifications and/or items of work should belisted in a detailed description on a separate sheet attached to the bid11. No errors shall be corrected after the bids are opened. In the event of a discrepancy unitprices will govern12. Bids must be submitted on this form printed in ink or typed, signed in ink, and notarized.13. Work shall begin within twenty-one (21) days after a Notice to Proceed is issued.14. The City Engineering Department shall be notified no later than 48 hours prior tobeginning work and 24 hours prior to resuming work when suspended more than 48hours. Failure to notify may result in work being rejected15. The Contractor shall perform work deemed “Emergency Work” including, but not limitedto slope failures, storm pipe failures, sink holes, river walk repairs, and other workconsidered critical infrastructure. The Contractor shall mobilize to perform “EmergencyWork” within 48 hours of notification of failure.16. Pay estimates shall be submitted for each “Notice to Proceed” after the work iscompleted and accepted by the City.17. Traffic control devices shall conform to the Manual on Uniform Traffic Control Devices,11th Edition and shall be furnished and installed by the bidder at no additional cost.18. Bituminous Material Price Adjustments will apply to the items in this bid according toALDOT Section 109.03, Article (e) of the Standard Specifications. The base index will bethe index for the month of the award of this bid.19. If requested by the City, test reports shall be submitted on all materials before finalpayment will be made.Page | 220. A maximum gross vehicle weight (GVW) of 66,000 lbs is required. No Tri-axle trucks willbe allowed as loads exceeding 66,000 lbs GVW will be rejected21. The bidder shall indemnify and hold harmless the City of Phenix City, its agents andemployees from all claims and suits relating to damages or injuries sustained by anypersons or property as a result of the work to be performed. The bidder is responsible forconforming to all applicable laws and ordinances and obtaining any necessary licenseand permits.22. Except otherwise provided in this Agreement, any claim, dispute or other matter inquestion arising out of or related to this agreement shall be subject to informal mediationbetween the parties, which will be non-binding to resolve any dispute. If said mattercannot be resolved through informal mediation, then in that event, either party in thisagreement can request formal non-binding mediation. If the parties do not resolve adispute through mediation, the method of binding dispute resolution should be thefollowing: Litigation in a court of competent jurisdiction in Russell County, Alabama or inthe United States District Court for the Middle District of Alabama. Dispute shall beinterpreted by laws of the State of Alabama.23. The Contractor warrants to the City that all materials furnished under the Contract will beof good quality, except such materials as may be expressly provided or allowed in theContract Documents to be otherwise, and that none of the Work will be Defective Work.Contractor shall employ a sufficient amount of skilled employees and equipment toperform the work in a quality and timely manner.24. The Contractor shall provide a one-year warranty for all work performed under this bid.25. If any of the Work is found to be Defective Work before the one year expiration from thedate of Substantial completion or each designated portion of the Work, the Contractorshall promptly upon receipt of written notice from the Owner or Engineer, and withoutexpense to either, replace or correct the Defective Work to conform to the requirementsof the Contract Documents, and repair all damage to the site and its contents which isthe result of Defective Work or its replacement or correction.26.
