The services providedmust meet objectives as described herein.Our business hours are Monday thru Thursday 7:00 a.m. and 5:30 p.m. excluding Saturdays,Sundays, Tribal and Federal holidays.1.02 IntroductionThe Confederated Tribes of the Colville Reservation is a Sovereign Nation. Presidential ExecutiveOrder established the Colville Indian Reservation in 1872, with a land base of 1.4 million acreslocated in north central Washington State. The Administrative Headquarters are located at theColville Indian Agency Campus, approximately 2 miles south of Nespelem, WA with offices locatedthroughout our reservation.1.03 Purpose of Sealed BidThe purpose of this RFP is to solicit proposals from qualified Professional Services Firms andestablish a Contract for Asbestos (ACM), Mold and Lead-Based Paint (LBP) Risk Assessment/Inspection and Testing Services to comply with National Emissions Standard for Hazardous AirPollutants (NESHAP) 40 CFR Part 61, Occupational Safety and health Administration 29 CFR1926.1101 and applicable portions of AHERA. These regulations require the owner to inspect abuilding for the presence of any asbestos-containing material (ACM) prior to undertakingconstruction, remodel, renovation, maintenance, or demolition to the building, and to provideinspection results to affected contractors or employees. The instructions on proposal preparation,1required documents, eligibility requirements and evaluation criteria are provided herein.1.04 General Scope of WorkThe Contractor shall provide all permits; meet all regulatory requirements and all activities necessaryto perform a complete job of Asbestos, Mold and Lead survey of the St. Mary’s Mission structures.Interior and exterior accessible spaces of the buildings shall be inspected for the presence of friableand non-friable Asbestos-Containing Materials (ACM). ACM activities shall conform to or exceedrequirements of the Environmental Protection Agency (EPA) Asbestos Hazard Emergency ResponseAct (AHERA) (40 CFR Part 763). In addition, interior and exterior painted surfaces of each buildingshall be inspected for LBP using field portable XRF methods. A LBP Risk Assessment will beperformed on each building where LBP is documented by inspection. LBP Inspection and RiskAssessment activities shall conform to or exceed requirements of the 1999 Housing and UrbanDevelopment (HUD) regulations of the Housing and Community Development Act (24 CFR Part35). A separate report is to be provided for each building. Each inspection report will includefindings from the asbestos, lead-based paint and mold inspection. Summaries listing ACM’s as wellas components testing positive for LBP are to be provided. At a Minimum, personnel utilized in theperformance of the work shall meet training and certification requirements of 24 CFR Part 35 and 40CFR Part 736. Proof of current certification as EPA AHERA Building Inspector and EPA LBP RiskAssessor/Inspector is mandatory.Tribal Employment Rights Ordinance, TOSHA and Tribal Solid Waste Disposal requirements apply.Before proceeding with the work, Contractor will have in place all required permits from eachapplicable regulating authority.1.05 Response FormatContractor proposals must be submitted in the format specified below. Contractors that deviate fromthis format may be deemed non-responsive.1.06 Completeness of ProposalThe Contractor must submit a completed Bid form signed by a Contractor representative authorizedto bind the proposing firm contractually. The Contractor must identify on the form any exceptionsthe Contractor takes to the Tribes Sealed Bid Proposal, or declare that there are no exceptions taken.1.07 Proposal Response Date and LocationProposals must be submitted electronically to the Confederated Tribes Facility Construction Managerno later than 02:00 pm, Tuesday, June 30, 2026. The FedEx delivery address is Theresa Desautel,Project COR, Colville Tribes, 21 Colville Street, Nespelem, WA 99155. Hard copies of the bids areto be delivered no later than Thursday, July 2, 2026. All Bids and accompanying documentation willbecome the property of the Colville Tribes and will not be returned. Contractors accept all risk oflate delivery of mailed proposal regardless of fault. By submitting his/her proposal, the Contractoracknowledges that he/she has satisfied him/herself as to the nature and locations of the work1.09 Site VisitationA site visit is not required, but is highly recommended. The non-mandatory site visit will beconducted on Tuesday, June 16, 2026 at 2:00 p.m. at the St. Mary’s Mission at 25 Mission Rd,Omak, WA 98841.1.10 Contractor’s Cost to Develop ProposalsCosts for developing proposals in response to the Bid Notice are entirely the obligation of theContractor and shall not be chargeable in any manner to the Colville Tribes.1.11 Indian PreferenceNotice is hereby given that the Confederated Tribes of the Colville Reservation has in force Title 10Employment and Contracting; Chapter 10-1 Tribal Employment Rights Ordinance (TERO), andChapter 10-3 Indian Preference in Contracting, covering but not limited to Indian employment,Training, contracting and subcontracting. Bidders are directed to contact the Colville Tribal TEROdepartment to obtain complete information regarding compliance requirements and responsibilitiesunder the law. It is also incumbent on the contractor and/or subcontractor to insure all compliancerequirements are met prior to commencing work. It is also advisable for covered entities to be awareof the TERO requirements for certification as an Indian firm, sanctions for non-compliance and theappeal process.The Colville Tribal TERO department can be reached by calling (509) 634-2735.Section 2 TERMS AND CONDITIONS2.01 Questions Regarding the Bid NoticeRequests for interpretation/clarification of the Bid Notice document must be made in writing andsubmitted to Theresa Desautel, the Facilities Construction Manager, by e-mailtheresa.desautel.adm@colvilletribes.com. Unauthorized contact with other tribal employeesregarding this Bid Notice may result in disqualification. All oral communications will be consideredunofficial and non-binding on the Colville Tribes. Allow seven (7) days for processing writtenquestions received. All questions must be submitted no later than 10 days from the Bid NoticeClosing Date.32,02 Bid Notice AmendmentsThe Colville Tribes reserves the right to request any respondent clarify its proposal or to supply anyadditional material deemed necessary to assist in the evaluation of the Bid.The Colville Tribes reserves the right to change the Bid Notice schedule or issue amendments to theBid Notice at any time. The Colville Tribes also reserves the right to cancel or reissue the BidNotice. All such addenda must be acknowledged and will become part of the Bid Notice.2.03 Withdrawal of ProposalProvided notification is received in writing, proposals may be withdrawn at any time prior to theproposal response due date and time specified. Proposals cannot be changed or withdrawn after thetime designated for receipt.2.04 Rejection of ProposalsThe Colville Tribes reserves the right to reject any or all proposals, to waive any minor informalitiesor irregularities contained in any proposal, and to accept any proposal deemed to be in the bestinterest of the Colville Tribes.2.05 Proposal Validity PeriodSubmission of a proposal will signify the Contractor’s agreement that its proposal and the contentthereof are valid for 90 days following the proposal response deadline unless otherwise agreed to inwriting by both parties. The proposal will become part of the Contract negotiated between theColville Tribes and the successful Contractor.2.06 Proposal SignaturesA representative authorized to obligate the firm must sign the proposal, with the Contractor’s addressand telephone information provided. Unsigned proposals will not be considered.2.07 Insurance RequirementsThe Colville Tribes will require the selected Contractor to comply with the insurance requirements aslisted in the Bid Notice; see Attachment “A”. Questions regarding insurance requirements can bediscussed with the Tribes Risk Management Office, (509) 634-2447.2.08 Equal Opportunity RequirementsThe Colville Tribes is an equal opportunity employer and requires all Contractors to comply withpolicies and regulations concerning equal opportunity. The contractor, in the performance of theContract, agrees not to discriminate in its employment because of the employees or applicant’s race,religion, national origin, ancestry, sex, age, or physical handicap.2.09 Other Compliance RequirementsIn addition to the nondiscrimination and affirmative action compliance requirements previouslylisted, the Contractor awarded a Contract shall comply with Tribal, Federal, State and local laws,4statutes and ordinances relatively to the execution of the work. This requirement includes, but is notlimited to, protection of public and employee safety and health; environmental protection; wastereduction and recycling; the protection of natural resources; permits; fees; taxes; and similar subject.2.10 Ownership of DocumentsAny reports, studies, conclusions and summaries prepared by the Contractor shall become theproperty of the Colville Tribes.2.11 Confidentiality of InformationAll information and data furnished to the Contractor by the Colville Tribes and all other documentsto which the Contractor’s employees have access during the term of the Contract, shall be treated asconfidential to the Colville Tribes. Any oral or written disclosure to unauthorized individuals isprohibited.2.12 Hold HarmlessThe Contractor shall hold harmless, defend, and indemnify the Colville Tribes and the Tribesofficers, agents, and employees against any liability that may be imposed upon them by reason of theContractor’s failure to provide worker’s compensation coverage or liability coverage.2.13 SafetyAll applicable regulations pertaining to safety, the Contractor shall strictly adhere to; includingTribal Occupational Safety and Health Act (TOSHA) standards and regulations and OSHA 29CFR1910.1001 & 1926.1101. Particular care shall be exercised in connection with the operation ofvehicles and other equipment on the site.2.14 TEROThe Colville Tribal Employment Rights Ordinance (TERO), including the 5% TERO fee shall applyto the Contract to the extent any of the work to be performed under the Contract is on or near theColville Indian Reservation. No work will take place until a TERO Utilization Plan has been signed,approved, and filed with the TERO office. The 5% TERO fee applies to all contracts over $5,000.00where the contractor is not a preference-certified entity.2.15 Bonds are not required for this Project-Disregard the following SectionBid proposals shall be accompanied by security in the amount of 5% of the total Bid amount onforms provided by the Contractor surety. The successful Contractor will furnish PerformanceSecurity and Labor and Material Security Bonds in the amount of 100% of the contract and will berequired before start of work.The bonds will be from an AA rated surety acceptable to the Colville Tribes. If allowable and theColville Tribes chooses to select a Contractor that cannot provide bonding, then the Colville Tribeswill retain 20% of the contract price until verified that the Contractor has satisfied all obligations inrelation to the contract.2.16 Liquidated DamagesFor failure to complete the specified work in the identified contract time a penalty of $100.00 per day5
