jim.kempton@falmouthma.govQualifications: The Town of Falmouth Department of Public Works, in conjunction with the Community Preservation Committee, has established this scope of work to preserve 250 additional gravestones in this phase, referred herein as Old Burying Ground Preservation, Phase 2A. For the purposes of this project, each gravestone in this scope of work has been categorized into 1 of 5 conservation strategies as described on the Bid Pricing Page. Bidders shall refer to the assessments in Appendix A for specific strategies and notes relative to the conservation of each particular gravestone to calculate a bid price for each of the 5 conservation strategy categories. Bidders shall include 3 or more references from projects of similar size and scope completed within the last 5 years. Bidders should be prepared to start this project within 10 days of the execution of the contract and complete within 6 months, weather permitting. McConartyDirector of Public WorksSECTION IIINFORMATION TO SERVICE PROVIDERS / GENERAL CONDITIONS1. Attention of all Service Providers is directed to Massachusetts General Laws and to all otherapplicable sections of the General Laws as most recently amended which govern the award of thisContract.2. The Service Provider shall submit his Bid upon forms furnished by the Department of PublicWorks. The Service Provider shall specify the price in figures and in words, if space for words isprovided. All words and figures shall be typewritten or in ink. In case of discrepancy, the amountshown in words will govern.3. All Bids shall be signed correctly in ink by the individual or in case of a firm, partnership orcorporation, it shall be signed by a person having a legal authority from said firm, partnership orcorporation.4. All Bids shall be submitted to the Office of the Parks Superintendent, Department of Public Works,416 Gifford Street, Falmouth, Massachusetts 02540 on or before the date stated in the Notice toService Providers.6. Bid forms shall be completely filled in. Bids which are incomplete, conditional, or obscure, orwhich contain additions not called for will be rejected. Use the pages of this Document whensubmitting Bids and submit Agreement Document intact. All Bids along with the qualifyingstatements shall be considered firm prices for the period of the Bid as submitted by the ServiceProvider. No award will be made to any Service Provider who cannot satisfy the Town ofFalmouth, Department of Public Works, that he has sufficient ability and experience in this class ofwork and sufficient capital and plant to enable him to prosecute and complete the work successfullywithin the time named. The Owner's decision or judgment on these matters will be final, conclusiveand binding.7. The Town may make such investigations as it deems necessary to determine the ability of theService Provider to perform the work, and the Service Provider shall furnish to the Town all suchinformation and data for this purpose as the Town may request. The Town reserves the right toreject any Bid if the evidence submitted by, or investigation of, such Service Provider fails tosatisfy the Town, that such Service Provider is properly qualified to carry out the obligations of theAgreement and to complete the work contemplated therein within the time period set forth in theBid documents.All applicable Federal, State and Local Laws, ordinance and rules, regulations (including but notlimited to any laws, ordinances or regulations relating to the Town of Falmouth, or theMassachusetts Department of Environmental Protection) of any authorities shall be binding uponthe Service Provider throughout the pendency of this Contract. The Service Provider shall beresponsible for8. Certificate of Insurance acceptable to the Town shall be filed with the Town prior to execution ofany contractual Agreement. These Certificates shall contain a provision that coverage affordedunder the policies will not be reduced or canceled unless at least fifteen (15) days prior writtennotice has been given to the Town.The Service Provider shall procure and maintain, at the Service Providers own expense, during theContract time, liability insurance as herein-after specified:Service Provider’s General Public Liability and Property Damage Insurance including vehiclecoverage issued to the Service Provider and protecting the Service Provider from all claims forpersonal injury, including death, and all claims for destruction of or damage to property arising outof or in connection with any operations under this Agreement. Insurance shall be written with alimit of liability of not less than $1,000,000 for all damages arising out of bodily injury includingdeath, at any time resulting there-from, sustained by any one person in any accident; and a limit ofliability of not less than $1,000,000 aggregate for any such damages sustained by two or morepersons in any one accident.9. The Service Provider shall procure and maintain, at the Service Provider’s own expense, during theduration of the Agreement, in accordance with the provisions of the Laws of the Commonwealth ofMassachusetts, G. L. Chapter 149, Section 34A, Workman's Compensation Insurance, includingoccupational disease provisions, for all the Service Provider’s employees, and in case any work issublet, the Service Provider shall require such sub-service provider similarly to provide Workman'sCompensation Insurance, including occupational disease provision for all of the latter's employeesunless such employees are covered by the protection offered by the Service Provider. In case anyclass of employees engaged in hazardous work under this Agreement is not protected under theWorkman's Compensation Law, the Service Provider shall provide and shall use each sub-serviceprovider to provide adequate and suitable insurance for the protection of its employee not otherwiseprotected.Signature of the Service Provider is required on the Written Bid Form regarding the Non-Collusiveresolution which states: "The Service Provider certifies under the provisions of Chapter 701 of theActs of 1983 and under the penalties of perjury, that this Bid is in all respects bonafide, fair andmade without collusion or fraud with any other person". As used in this Section, the word "person"shall mean any natural person, joint venture, partnership, corporation or other business or legalentity.A Performance and Payment Bond in the amount of One Hundred (100%) percent of the annualcontract price will be required for the faithful performance of the Contract. The Service Providershall obtain and submit the bond within ten (10) days after notification of the Bid award. Thesuccessful Service Providers Bid Bond shall not be released until such time the Performance andLabor and Materials Bonds have been posted. Within seven (7) working days of receipt ofacceptable Payment Bond and Agreement signed by the party to whom the Agreement was
