Samplebonds incorporated into this RFP as Attachment “C”.All bonds are to be secured from a surety that meets all of the State of California bonding requirements, asdefined in Code of Civil Procedure Section 995.120, and is admitted by the State of California.The Director of Industrial Relations has determined the general prevailing rate of per diem wages in SanBernardino County for each craft or type of worker needed to execute the Agreement, copies of which are on fileand will be made available to any interested party online at http://www.dir.ca.gov/dlsr. A copy of these ratesshall be posted by the successful Proposer at the job site. The successful Proposer, and all its subcontractor(s),shall comply with all applicable Labor Code provisions, which include, but are not limited to the payment of notless than the required prevailing rates to all workers employed by them in the execution of the Agreement, theemployment of apprentices, the hours of labor and the debarment of contractors and subcontractors.Pursuant to Labor Code sections 1725.5 and 1771.1, all contractors and subcontractors that wish to bid on, belisted in a bid proposal, or enter into a contract to perform public work must be registered with the Departmentof Industrial Relations. No proposal will be accepted nor will any contract be entered into without proof of thecontractor’s and subcontractors’ current registration with the Department of Industrial Relations to perform publicwork. If awarded a contract, the proposer, and its subcontractors, of any tier, shall maintain active registrationwith the Department of Industrial Relations for the duration of the Project. Notwithstanding the foregoing, thecontractor registration requirements mandated by Labor Code Sections 1725.5 and 1771.1 shall not apply towork performed on a public works project that is exempt pursuant to the small project exemption specified inLabor Code Sections 1725.5 and 1771.1.This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. Inbidding on this Project, it shall be the Proposer’s sole responsibility to evaluate and include the cost of complyingwith all labor compliance requirements under the Agreement and applicable law in its proposal. The CaliforniaAir Resources Board (“CARB”) implemented amendments to the In-Use Off-Road Diesel-Fueled FleetsRegulations (“Regulation”) which are effective on January 1, 2024 and apply broadly to all self-propelled off roaddiesel vehicles 25 horsepower or greater and other forms of equipment used in California. A copy of theRegulation is available at https://ww2.arb.ca.gov/sites/default/files/barcu/regact/2022/off-roaddiesel/appa-1.pdf.Proposers are required to comply with all CARB and Regulation requirements, including, without limitation, allapplicable sections of the Regulation, as codified in Title 13 of the California Code of Regulations section 2449et seq. throughout the duration of the Project. Proposers must provide, with their proposal, copies of Proposer’sand all listed subcontractors’ most recent, valid Certificate of Reported Compliance (“CRC”) issued by CARB.Failure to provide valid CRCs as required herein may render the Proposal non-responsive.The award of this contract is subject to available budget adequate to carry out the provisions of the proposedagreement including the identified scope of services. The City reserves the right to reject any or all proposalsdetermined not to be in the best interest of the City.RFP & CONTRACT SPECIFICATIONSPage 2 of 11KEEP THESE PAGES FOR YOUR RECORDSI. GENERAL CONDITIONS1. General Information - The Public Works Department of the City of Antioch, California, will receiveproposal responses at its office located at 1201 W. 4th Street, Antioch, CA 94509 on April 2nd, 2026until 2:00 PM. Questions relating to specifications or technical questions must be submitted via emailto Bryan Pitts at bpitts@antiochca.gov. Contractors are NOT to pursue City staff by telephone or inperson.2. Form of Proposal - The proposal shall be made on the attached proposal forms. If the form is deemedinadequate, additional information may be submitted with the proposal, via an attachment of catalogs,drawings, photographs, or a letter. Letters repeating prices and details from the City's specificationsmust be omitted. Proposals shall be made only on the designated form, properly executed, andenclosed in a sealed envelope bearing the name of the vendor, the proposal number, due date, andproposal title. Forms are available and may be secured by prospective vendors at the Department ofPublic Works at 1201 W. 4th Street, Antioch, CA 94509. Proposals shall be written in ink, computergenerated, or by typewriter. Mistakes may be crossed out and corrections inserted adjacent thereto andmust be initialed in ink by the person signing the proposal. Proposals are to be verified beforesubmission as they cannot be corrected or altered or signed after proposals are opened.3. Interpretation of Proposals - Should a vendor find discrepancies in, or omissions from thespecifications, or should vendor be in doubt as to their true meaning, vendor shall submit a formalrequest to the Public Works Department for an interpretation thereof prior to the proposal opening tothe attention of Rachel Harris at rharris@antiochca.gov. The person submitting the request shall beresponsible for its prompt delivery. Any interpretation of, or, change in the proposed documents will bemade only by an addendum published on the City’s website and shall become part of any contractawarded. The City will not be responsible for any other explanation or interpretations.4. Addenda - Any addenda issued by the City during the time of request shall be covered in theproposal and shall be made a part of the contract.5. Proposal Opening – Proposals shall be delivered to the Public Works Department of the City ofAntioch located at 1201 W. 4th St. Antioch, CA 94509 on or before the day and hour set for the openingof proposals. A vendor may withdraw his proposal, either personally or by written request, at any timeprior to the scheduled time for opening of proposals. Proposals are to be opened on April 2, 2026 at2:00pm in the training room at the City of Antioch’s Public Works Building.6. Late proposals - Any proposals received after the scheduled time of opening will be clocked in but willnot be opened or considered.7. Award or Rejection - The proposal will be awarded to the vendor offering the best value to the Cityand will be announced by way of publishing to the City’s website (Proposal Documents).8. Insurance Requirements- Proposers acknowledge the City’s insurance requirements as detailed inExhibit “D” to Attachment “B”. Exceptions to City insurance requirements will not be made. AnyProposer unable to meet the insurance requirements at the time of the Proposal Due date, as detailed,shall not be eligible for selection or award of contract.RFP & CONTRACT SPECIFICATIONSPage 3 of 11KEEP THESE PAGES FOR YOUR RECORDS9. Surety Bonds – Contractor is required to provide the following surety bonds from an admitted andauthorized surety in California.• Performance Bond• Payment Bond10. Prevailing Wage - Where labor is required for public work as part of this contract, pursuant to theprovisions of the Labor Code of the State of California, contractors shall pay no less than the minimumwages established by the Director of the Department of Industrial Relations of the State of California.It shall be required that the contractor’s DIR# be written on the sealed, proposal package forverification purposes. If no DIR# is stated, the submitted proposal package will not be reviewed.To the extent applicable, Contractor shall comply with the requirements of the California Labor Codeincluding but not limited to hours of labor, nondiscrimination, payroll records, apprentices, workers'compensation, and prevailing wages.No less than the general prevailing rate of per diem wages, and not less than the general prevailingrate of per diem wages for holidays and overtime work, for each craft, classification or type of workerneeded to execute the work under this Agreement shall be paid to all workers, laborers andmechanics employed in the execution of the work by the Contractor or any subcontractor doing orcontracting to do any part of the work. The appropriate determination of the Director of the CaliforniaDepartment of Industrial Relations shall be filed with, and available for inspection, at the City offices.Contractor shall post, at each job site, a copy of the prevailing rate of per diem wages. TheContractor shall forfeit fifty dollars ($50.00) for each calendar day or portion thereof for each workerpaid less than the stipulated prevailing rates for any public work done under the Agreement by it orby any subcontractor under Contractor.The City reserves the right to request and review the contractor’s payroll records in the form of certifiedpayroll records. In the event certified payroll records are requested, they are to be submitted via emailto rharris@antiochca.gov. Furthermore, Contractor is to submit two sets: one complete and oneredacted of private information [On the second copy the name, address and social security number ofthe individual employees must be redacted (blacked out).]11. Contractor Selection Criteria- The City will be awarding this contract using a “Best Value”methodology including evaluation of price, and responses to technical questions including review ofreferences, “Attachment A”. Points will be awarded based on the following categories:• Attachment A. 60 points: Qualifications, Experience, References, Emergency ResponseTime (Based upon “Attachment A- Response to Technical Questions” including review ofreferences)• Part B. 40 points: On-Call Street Light and Electrical Repairs Service Costs (Based uponProposal Hourly Labor Rate Worksheet)RFP & CONTRACT SPECIFICATIONSPage 4 of 11KEEP THESE PAGES FOR YOUR RECORDSThe City will first evaluate, and rank proposals based on the Attachment A. 60-point selection criteriafor Qualifications, Experience, References and Emergency Response Time.20 points10 points15 points15 pointsPrevious experience in providing a superior level of On-Call Street Light andother Electrical Repair services at like-sized public and/orprivate facilities.Reference assessments of work quality, performance and workingrelationships by current and recent clients that indicate high levels ofsatisfaction and effectiveness.Qualifications of staff proposed to provide On-Call Street Light and OtherElectrical Repair Services at all City Facilities.Emergency Response time of one (1) hour from time of call out: 24 hours aday seven (7) days a week. In addition, a well-organized communicationsystems and electronic reporting capabilities that demonstrate an ability tocomplete tasks efficiently and effectively and do not require constantsupervision by the City.Secondly, the City will evaluate the cost proposals to ensure the lowest costs to the City. All the laborhourly rates will be added together to come up with a total cost. The cost proposal with the lowesttotal cost will receive the full 40 points. The remaining cost proposals receive points based on acomparison of their total cost to the lowest contractor’s total cost.The winning proposal will be selected based on the highest combined points from bothAttachment A and Part B as described above.12.
