NOTICE TO BIDDERS / INVITATION TO BIDNotice is hereby given that the governing board (“Board”) of the Orinda Union School District(“District”) will receive sealed bids to construct the following project:Glorietta Elementary School Transitional Kinder/Kindergarten Play Yard (DSA#01-122865)(“Project” or “Contract”)The Project consists of: Transitional and Kinder Play Yard Replacement including : Replacement offlatwork including Asphalt, Rubber surfacing and Sandbox in Play Area. Install of two new play structure(OFCI-owner furnished, contractor installed) over poured-in-place safety surfacing, Replacement offences and gates, Addition of wood fence at the toe of the hill, The addition of Trees, Plants andassociated irrigations, 18” concrete Seat walls, Installation of Site Furniture and Alternates maybeselected by District.The contractor will be responsible for receiving, as well as staging and safe keeping of OFCI items untilinstallation.Contractors must submit sealed bids on or before 2:00p.m., March 26, 2026, at the District Office, locatedat 8 Altarinda Drive, Orinda, California, at or after which time the District will open the bids and publiclyread them aloud. Any claim by a Bidder of error in its bid must be made in compliance with PublicContract Code § 5100, et seq. Any bid that is submitted after this time shall be non-responsive andreturned to the Bidder. The District is not responsible for Bids that are received after the deadline notedabove.Contractor shall possess at the time of it bid, the following classifications(s) of the Contractor’sCalifornia State license(s): B LicenseMandatory bidder’s conference and site walks will be held on:Mandatory Site Walk # 1: Thursday, February 19, 2026 @ 9:00AMMandatory Site Walk # 2: Thursday, February 26, 2026 @ 9:00AMPotential Bidders to meet at Glorietta Elementary School, located at 15 Martha Rd, Orinda, CA94563 for mandatory site walks. Group will meet in front of school. Parking is free for all visitors.All prospective Bidders are required to sign in with the Construction Manager. The Site Visit is expectedto take approximately 1 hour. Failure to attend or tardiness will render bid ineligible.Note: Potential bidders only need to attend one (1) of the Mandatory Site Walks to meet therequirement.Contract Documents are available for review at on District office. In Addition, Contract Documents areavailable for review at the Orinda Union School District website https://www.orindaschools.org underDepartments-Facilities-Invitation to Bid.Each bid shall be made on the Bid Form prepared by the District in the Contract Documents and mustconform and be fully responsive to all documents comprising the Contract Documents.The successful Bidder and its subcontractors shall pay all workers on the Project not less than thegeneral prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work asdetermined by the Director of the Department of Industrial Relations, State of California, for the type ofwork performed and the locality in which the work is to be performed within the boundaries of theDistrict, pursuant to Labor Code § 1770 et seq. Prevailing wage rates are on file with the District and areavailable to any interested party on request or at www.dir.ca.gov/oprl/statistics_and_databases.html.Bidders and Bidders’ subcontractors shall comply with the registration and qualification requirementspursuant to Labor Code §§ 1725.5 & 1771.1The successful Bidder may substitute securities for any monies withheld by the District to ensureperformance under the Contract, in accordance with the provisions of Public Contract Code § 22300.Bonds. A bid bond by an admitted surety insurer on the form provided by the District, Cash or cashier’scheck or a certified check, drawn to the order of the Orinda Union School District, in the amount of tenpercent (10%) of the total bid price, shall accompany the Bid Form, as a guarantee that the Contractorwill, within seven (7) calendar days after the Notice to Proceed or other direction, enter into a contractwith the District for the performance of the services as stipulated in the bid.In, Addition, a hundred percent (100%) Performance Bond and a one hundred percent (100%) PaymentBond will be required of the successful bidder.The District’s Board reserves the right to reject any and all bids and/or waive any irregularity in any bidreceived. If the District awards the Contract, the security of unsuccessful Bidder(s) shall be returnedwithin sixty (60) days from the time the award is made. Unless otherwise required by law, no Bidder maywithdraw its bid for ninety (90) days after the date of the bid opening.The District shall award the Contract, if it awards it at all, to the lowest responsive responsible Bidderbased on:The Base bid amount plus the following alternates:Additive Alternate # 1: Furniture such as Pebble Seats, Picnic Tables, Twig bench, S.L.D forcomplete listAdditive Alternat # 2: Additional Plays Structures, S.L.D (Note that-Additional Structures will becontractor furnished and Contractor InstalledAdditive Alternate #3: Landscape Wall, S.L.DAdditive Alternate #04: Asphalt Paint, S.L.D
