Bid Attributes

1 Scope of Work

Southwest ISD is accepting bids to refinish competition and practice gym floors at our secondary campuses.

The work for all practice and competition gyms, except Legacy HS Practice Gym, shall include:

Sweeping and mopping the floors to remove fine dirt and dust

Scraping up of gum deposited on gym floors

Wet buffing of the gym floors by using 220-grit abrasive pads and an adhesion formula.

Applying one (1) coat of 50% solids oil-based gym finish on the floors

The work for the Legacy HS Practice Gym shall include:

Sweeping and mopping the floors to remove fine dirt and dust

Scraping up of gum deposited on gym floors

Sand floor to bare wood using coarse, medium, and fine grit sandpaper.

Apply oil based gym sealer.

Paint game lines and graphics

Apply 2 coats of 50% solids oil base gym finish.

3 General Terms & Conditions

TERM OF CONTRACT

Southwest ISD seeks contract services Gym Floor Refinishing from the award date through no later

than August 31, 2026.

All work must be completed by by July 23, 2026, for all gyms.

Start date (tentative to change) for Southwest High School, Southwest Legacy High School and

Crossroads/Alternative High School (formerly CAST STEM High School) gyms is June 22, 2026.

Start date (tentative to change) for McNair Middle School, McAuliffe Middle School, Scobee Middle

School and Resnik Middle School gyms is June 1, 2026.

GOVERNING DOCUMENTS

The following instructions by the District are intended to afford Proposer(s) an equal opportunity to

participate in the proposal process and provide a predetermined set of criteria representing the

District's business and service requirements. This proposal is governed by the Texas Education Code

(TEC), other applicable State of Texas statutes and all local. Board of Education policies.

This Solicitation shall be governed by the following documents unless an exception is otherwise taken

within this Solicitation. Documents are incorporated by reference only and are not attached as part of

this Solicitation.

1) Texas Education Code 44.031 - 44.047.

2) Purchasing and Acquisition, Southwest ISD Policy CH (Legal)

3) Purchasing and Acquisition, Southwest ISD Policy CH (Local).

OFFER PERIOD

This bid is a firm offer which shall be irrevocable and open for acceptance for forty-five (45) calendar

days unless otherwise specified) from the date of submission.

AWARD

This project will be awarded to one (1) vendor based on the criteria for evaluation included in this proposal.

PRE-AWARD INQUIRIES

All requests for clarification, interpretations, and/or questions for this solicitation shall be through this

electronic solicitation. This ability can be found under the ”Question” tab. All requests must be

submitted prior to the date indicated by the ”Question Cutoff Date”. Only fully completed requests for

valid and current solicitation will receive a response; late or delinquent requests will not be entertained

or answered.

Each question, clarification or interpretation request must include all pertinent information required to

receive a response. Failure to provide all information may delay a response from the District. The

District reserves the right to inform the requester that the response to their request will be submitted

through an addendum to all interested vendors and not be addressed directly through their request.

The respondent is discouraged from contacting the District’s staff directly unless necessary.

NOTE: Contact with other employees of the District outside the Southwest ISD Purchasing Office is

prohibited during the solicitation process unless directed by the District Purchasing staff. Respondents

that fail to adhere to this requirement risk having their response disqualified.

PRICING

Pricing shall be based on the square footage of the gyms. See Line Items tab to see gym location, square footage

and provide pricing. Proposer is to type in the price in the box under the word “PRICE”. All costs associated with

providing the total service to the District (e.g.- sweeping, mopping, scraping, buffing, finish application, etc.) shall be

included in the price bid.

RESERVATION OF RIGHT

Southwest ISD expressly reserves the right to:

1) Waive minor deviations from specifications, if the District determines that the overall cost of the goods

or services will be lower and the overall function is improved or not impaired

2) Waive any minor informality or deficiency in any Solicitation procedure

3) Reject any or all Solicitation Responses

4) Cancel the Solicitation

5) Reissue a Solicitation

6) Extend the Solicitation opening time and date, the Contract Award date, or both

7) Specify approximate quantities

8) Increase or decrease the quantity specified in the Solicitation

9) Consider and accept alternate Solicitations, if specified in the Solicitation, when it is considered in the

best interest of the District

10) Procure any goods or services by other means

The vendor understands and agrees that the above general bid specifications and specific terms and

conditions are terms and conditions of the contract between the Southwest ISD and the vendor. These

general bid specifications and terms and conditions shall control and govern in the event of any conflict with

any other terms and conditions submitted by the vendor.

AUTHORIZED PURCHASE

The successful Proposer will not begin services or deliver the product without a purchase

order. Southwest ISD will neither be responsible nor make payment for any goods delivered or

services performed without a valid purchase order.

LEGAL VENUE

The vendor understands and agrees that venue for any litigation arising from this award or contract

shall lie in San Antonio, Bexar County, Texas and that any dispute shall be governed by the laws of the

State of Texas.

CONTRACT RELATIONSHIP

The proposer is not an employee of the District and is not entitled to fringe benefits. Furthermore,

the District will not deduct Federal Income Taxes, FICA or any other funds required to be deducted by

an employer as this is the responsibility of the Proposer. The Proposer is an independent contractor,

and District and Proposer have not entered into a joint venture or partnership in providing the

services herein and nothing contained herein shall constitute or designate the vendor or any of his

employees as employees of the Southwest ISD. The bid and any eventual award may not be assigned

or any right hereunder transferred to a third party.
