The successful bidder shall supply each ofthe Political Subdivisions at the same price and terms.The successful bidder is required to provide Ultra Low Sulfur (15 PPM) No. 2 Heating Oil asrequired in Massachusetts as of July 1, 2018 at no additional cost.The enclosed specifications and proposal documents are issued for the Town of Arlington, Townof Belmont, Town of Brookline, City of Cambridge, Town of Lexington, City of Newton, City ofWaltham, Town of Watertown, Town of Weston, Town of Winchester, and City of Woburn hereinreferred to as the Political Subdivisions.CONTRACT AWARDNOTE: THERE IS ONE PRICING OPTION ON THIS BID.Contract will be awarded within two (2) hours after the bid opening unless the award date isextended by consent of all parties concerned.VENDORS SHOULD NOTE: Any vendor that does not accept the award of the Cooperativewithin the specified time will be considered a non-responsible bidder for all future CooperativeFuel Bids for a period of three (3) years.CONTRACT PERIODFor this Fixed Price Bid, the contract period shall be from July 1, 2026 to June 30, 2027.Upon award to the successful bidder, each Political Subdivision shall enter into its own contractand will accept sole responsibility for any payment due the contractor.VENDORS SHOULD NOTE: Any vendor that does not accept the award of the Cooperativewithin the specified time will be considered a non-responsible bidder for all future CooperativeFuel Bids for a period of three (3) years.GENERAL INSTRUCTIONS TO BIDDERSProposals shall be typewritten or written in black ink on the enclosed forms. Officials ofcorporations shall designate their official title. Partners or sole owners shall so state, giving namesof all interested parties.1Bidders shall not base proposals on verbal information from any employee of the PoliticalSubdivisions.Political Subdivisions are tax exempt. Appropriate exemption certificates will be furnished by thePolitical Subdivisions.Bidders must state in their response to this bid the name, type, and amount of variousFederal and State fees and charges that will be added, such as: Oil Spill, L.U.S.T.,Underground Tank, etc. Documentation of the applicability of these items must beprovided. Failure to do so may result in non-payment of such items by the PoliticalSubdivisions.The successful bidder will be required to file Fair Employment Practices and/or AffirmationAction Statements in accordance with each Political Subdivision’s regulations.The successful bidder will protect the Political Subdivisions from any and all infringements ofpatents, royalties, or damages arising from the transaction.CONTRACT INFORMATIONPreference for award will be give to a bidder that submits a bid on two (2), or more, of the fuel oilproducts, as specified in this bid.Upon award to the successful bidder, each Political Subdivision shall enter into its own contractand will accept sole responsibility for any payment due the vendor.Payment and performance obligations in the succeeding fiscal year shall depend on the availabilityand appropriation of funds.PRICESThe fixed price bid shall be a firm for the contract period. The price shall be for the estimatedvolume requirements of the Political Subdivisions as ordered during the term of this contract.Actual volume requirements may vary from the estimated volume requirements, which are listedin the following section of this document.VENDORS SHOULD NOTE: Quantities listed in the following section are ESTIMATED.Bids which propose to limit the volume of fuel to be supplied, list minimum or maximumusage requirements will be considered non-responsive. Bids that are qualified in ANY waywill be considered non-responsive.Time payment discount offered for prompt payment will be taken into consideration whendetermining award if the discount period is a minimum of twenty (20) days from receipt ofinvoice.2The contractor shall establish the correct billing address and procedures for billing with eachPolitical Subdivision.PERFORMANCE BONDThe successful bidder will be required to furnish an acceptable performance bond to each PoliticalSubdivision for a sum of 25% of the value of the contract based upon the approximate quantitiesnoted in the specifications for each Political Subdivision and price bid. The performance bondmust be issued by a company authorized to issue such bonds in the Commonwealth ofMassachusetts.QUALIFICATIONSBidder must have been regularly engaged for at least three years prior to the date of bid opening inthe business of supplying the product bid upon, in the grade bid upon and in the manner oforganization, facilities, and assurance of supply to insure prompt and satisfactory service as calledfor with delivery in Massachusetts calibrated tank trucks.Bidder must have experience supplying large volume customers with No. 2, No. 4 and No. 6 fueloil. Bidder must list their current three largest volume customers as references. The organizationname, contact name, address, and telephone number of each reference must be provided as part ofthe bid.Bidder of No. 4 oil must have available at each terminal a blender of a two component continuousflow type with mechanically proportioned controls operating with individual supply pumps andcontinuous meters, capable of suitable blending and homogenizing the resultant No. 4 oil.Terminal shall have viscometers and competent personnel to control regularly the specifications ofthe No. 4 oil. Such facilities are subject to inspection prior to award and if found not incompliance with requirements, the bid may be declared not in compliance. Such facilities are alsosubject to inspection during the period of the contract. The lack or non-operation of such facilitiesor repeated delivery of oil from other than approved facilities may be considered breach ofagreement.Blending facilities will be waived upon proof that No. 4 oil being supplied is not a yard blendedtype, but is a straight run refinery No. 4, in full compliance with the specifications.Bidder of No. 6 oil must operate heating equipment and such other facilities as are necessary forthe proper handling of this grade, either in his possession or in the possession of the one who willdeliver the oil.Bidder must state precise sources of supply by giving the names and addresses of all supplierterminals.Bidder must list at least three customer references. The organization name, contract name,address, and telephone number must be provided.3Bidder must list the names and address of any subcontractors utilized for delivery of fuel, ifapplicable.Bidder must state the name and address of the bonding company which will provide performancebonds to the Political Subdivisions.Bidder may be rejected for documented previous unsatisfactory performance.INSURANCE COVERAGEPrior to starting on this contract, the contractor shall provide certificates from insurers clearlystating that the required insurance policies have been issued to the contractor and will remain ineffect during the time period required to complete the contract. The certificates must be in a formsatisfactory to each political subdivision. The insurance shall include all major divisions ofcoverage, and shall be on a comprehensive general basis including Premises and Operations(including X-C-U), Owner’s Protective, Products Competed Operations, Owned, Non-owned andHired Motor Vehicles. Such insurance shall be written for not less that any limits of liabilityrequired by law or the following limits, whichever are greater.The contractor agrees to take all precautions while conducting the work so as to prevent injuries ordamages to persons or property on the assigned job site. The contractor agrees that he shallpossess and maintain throughout the contract period/project insurance in the kinds and amounts asfollows:A.
