NOTICE INVITING BIDSNOTICE IS HEREBY GIVEN that sealed bids for the City of Malibu, MALIBUCOMMUNITY LABOR EXCHANGE CENTER SPECIFICATION NO. 2103, will bereceived by the City Clerk, at Malibu City Hall, 23825 Stuart Ranch Road, Malibu,California, 90265, at or before 3:30 p.m. on Thursday, December 11, 2025, at which timethey will be publicly opened and read by the City Clerk (or designated representative).SCOPE OF WORKIn general, the proposed improvements consist of a new TypeV-A, full sprinklered building, including all finishes, a restroom, ADA compliance, sitework,including parking lot and landscape, utility connections to existing infrastructure, a trashenclosure, and all other appurtenant work included and shown in the Contract Documentsand Specifications.PRE-BID CONFERENCEThis is a HUD Section 3 Contract and all Bidders/Proposers must commit to achievingestablished requirements, including benchmarks, for Section 3 Workers and Section 3Targeted Workers to be considered a responsive bidder/proposer and eligible for acontract award.This HUD Section 3 covered construction contract requires compliance with the laborhour benchmarks outlined in Section 3 of the Housing and Urban and Development Act.A Section 3 Mandatory Pre-Bid Meeting/Job Walk will be held to discuss the Bid andSection 3 Requirements. City of Malibu staff will respond to questions from potentialBidders. This meeting is scheduled at 3 p.m. on December 2, 2025 at City Hall, 23825Stuart Ranch Road, Malibu, California 90265, to explain the Section 3 requirements andbenchmarks. Direct all questions to Julie Santia, Section 3 coordinator atjsantia@malibucity.org. A site walk-through will be conducted immediately following thepre-bid conference.The bid shall be submitted and the work shall be performed by a Class “B” State ofCalifornia licensed contractor in strict conformance with the project specifications forProject Specification No. 2103 now on file in the City’s Public Works Department.An electronic copy of plans and specifications may be obtained by prospective biddersfrom the Public Works Department through mpublicworks@malibucity.org.All prospective bidders shall abide by the provisions of the Bid Terms and Conditionslisted in the project’s specifications.The City reserves the right to retain all bids for a period of 90 days after the bid openingdate for examination and comparison and to delete any portion of the work from theContract. The City reserves the right to determine and waive nonsubstantial irregularitiesin any bid, and to reject any or all bids. The bid shall be balanced so that each bid itemis priced to carry its share of the cost of the work and also its share of the contractor’soverhead and profit. The City reserves the right to delete any bid item to the extentthat the bid is qualified by specific limitation. An unbalanced bid shall beconsidered as grounds for rejecting the entire bid. The City shall award the bid to thelowest responsible bidder as the interest of the City may require.Bidders are advised that prior to awarding the contract a Federal and State ContractorEligibility check will be performed verifying status with the California Department ofIndustrial relations at http://www.cslb.ca.gov and eligibility athttp://www.dir.ca.gov/dlse/debar.html and with the online excluded parties list at thefederal System for Award Management (SAM) website https://sam.gov/content/entity-reinformation.This project is funded in whole or in part with Community Development Block Grant(CDBG) funds provided by the U.S. Department of Housing and Urban Development(HUD). Federal Labor Standards Provisions, including prevailing wage requirements ofthe Davis-Bacon and Related Acts will be enforced. In the event of a conflict betweenFederal and State wages rates, the higher of the two will prevail.In accordance with the provisions of Division 2, Part 7, Chapter 1 of the California LaborCode, the California Department of Industrial Relations has established the generalprevailing rates of per diem wages for each craft, classification and type of work neededto execute contracts for public works and improvements. The per diem wages publishedat the date the contract is advertised for bids shall be applicable. Future effective wagerates which have been predetermined are on file with the Department of IndustrialRelations, are referenced but not printed in said publication. The new wage rates shallbecome effective on the day following the expiration date and apply to this contract in thesame manner as if they had been included or referenced in this contract. The website forCalifornia Department of Industrial Relations Prevailing Wage Unit is currently located atwww.dir.ca.gov, prevailing wages are located on the website athttp://www.dir.ca.gov/dlsr/pwd/index.htm.Bidders are advised that, as required by federal law, the City of Malibu is implementingnew Disadvantaged Business Enterprise (DBE) requirements.The Disadvantaged Business Enterprise (DBE) contract goal is 15.3% for this projectFurthermore, the Davis Bacon Act provisions apply to this project. The current FederalGeneral Wage Determinations as predetermined by the Secretary of Labor are located atwww.dol.gov. If there is a difference in the Federal minimum wage rates and the CaliforniaDepartment of Industrial Relations rates for similar classifications of labor, the contractorand their subcontractors shall pay not less than the higher wage rate.The wage rate for any classification not listed by the California Department of IndustrialRelations, but which may be required to execute the proposed contract, shall be in accordwith specified rates for similar or comparable classifications or for those performing similaror comparable duties, within the agency’s determinations.At the time of submitting the bid the Bidder shall be registered with the CaliforniaDepartment of Industrial Relations in accordance with the provisions of Section 1771.1 ofthe California Labor Code, as amended by Senate Bill 854. No public work contract maybe awarded to a non-registered contractor or subcontractor.Contractors and their subcontractors who apply or bid for an award for an infrastructureproject subject to the domestic preference requirement in the Build America, Buy AmericaAct (BABAA) shall file the required certification to the LACDA with each bid or offer for aninfrastructure project, unless a domestic preference requirement is waived by HUD.Contractors and subcontractors certify that no federal financial assistance funding forinfrastructure projects will be provided unless all the iron, steel, manufactured projects,and construction materials used in the project are produced in the United States (BABAA,Pub. L. No. 117-58 §§ 70901-52). Contractors and subcontractors shall also disclose anyuse of federal financial assistance for infrastructure projects that do not ensurecompliance with BABAA domestic preference requirements. Such disclosures shall beforwarded to the grant recipient who in turn will forward the disclosures to HUD, thefederal awarding agency; subrecipients will forward disclosures to the pass-throughentity, who will in turn forward the disclosures to HUD.Without exception, the bidder is required to state the name and address of eachsubcontractor who will perform work or labor or render service to the primecontractor and the portion of the work which each will do in their bid as requiredby Section 2-3, "Subcontracts", of the Standard Specifications and in conformancewith Public Contract Code, Sections 4100 to 4113, inclusive.The City will not consider awarding any contract based upon any bid submitted by anycontractor nor consent to subletting any portions of the Contract to any subcontractorlocated in a foreign country during any period in which such foreign country is listed bythe United States Trade Representative as discriminating against U.S. firms in conductingprocurements for public works projects.All bidders are hereby notified that any contract entered into pursuant to thisadvertisement, Business Enterprises must be afforded full opportunity to submit bids inresponse to this invitation and will not be discriminated against on the grounds of race,color or national origin consideration for an award.The Contractor may substitute securities for retention monies pursuant to Public ContractCode Section 22300.Date this 14 th day of November, 2025CITY OF MALIBU, CALIFORNIA__________________________________________________Tatiana Holden, Assistant Public Works Director/City EngineerPublished: Malibu Times on November 20, 2025 and November 27, 2025
