The Proposalpackets may be obtained from SJPC at http://www.southjerseyport.com or upon request to: South JerseyPort Corporation, Attention: Perry Bicher, Acting Purchasing Agent, 2 Aquarium Drive, Suite 100, Camden,NJ 08103, purchasing@southjerseyport.com.Proposers are required to comply with the requirements of N.J.S.A. 10:5-31 et. seq., and N.J.A.C. 17:27 et.seq.STATEMENT OF RIGHTSThe SJPC reserves, holds, and may at its sole discretion, exercise the following rights andoptions with respect to this Request for Proposals (“RFP”).1. To select and enter into an agreement with the one or more Proposer(s) based uponexperience, qualifications, approach, and other factors specified herein, for thepurchase of materials, products, supplies, and non-professional services shall beawarded to the lowest responsible Proposer that submits a responsive Proposal.2. To reject any and/or all Proposals.3. To issue additional subsequent solicitations for RFPs and/or amendments to the RFP.4. To conduct investigations with respect to the qualifications of each Proposer.5. To negotiate with Proposers for amendments or other modifications to their Proposals.6. To modify dates.7. To enter into agreements for only portions (or to not enter into an agreement for any)of the services contemplated by the Proposal submitted.8. All Proposals prepared in response to this RFP are at the sole expense of theProposer, and with the express understanding that there will be no claim, whatsoever,for reimbursement from the SJPC for the expense of preparation.9. The New Jersey Open Public Records Act (hereinafter “OPRA”) mandates publicaccess to government records. However, Proposals submitted in response to this RFPmay contain technical, financial, or other data whose public disclosure could causesubstantial injury to a Proposer’s competitive position or constitute a trade secret. Toprotect these data from disclosure under the OPRA, the Proposer should specificallyidentify the pages of the Proposal that contain such information, by properly markingthe applicable pages and inserting the following notice in the front of its Proposal.3PROPRIETARY INFORMATIONProposers are allowed to identify proprietary information and specifically request that suchinformation be used for evaluation purposes only. Proposers should include a statement intheir responses that the data on specific pages of their Proposal identified by an asterisk (*)contains technical and/or financial information, which are trade secrets, or information forwhich disclosure would result in substantial injury to the Proposer’s competitive position.The Proposer, by identifying and requesting that such data be used only for the evaluation ofthe Proposal, understands that the disclosure will be limited to the extent SJPC considersproper under the OPRA. If an agreement is entered into with the Proposer, SJPC shall havethe right to use or disclose the data as provided in the agreement, unless otherwise obligatedby law or court order.The SJPC does not assume any responsibility for disclosure or use of marked data for anypurpose. In the event that properly marked data is requested under the OPRA, the Proposerwill be advised of the request, and may expeditiously submit to the SJPC a detailed statementindicating the reasons it has for believing that the information is exempt from disclosure underthe law. This statement will be used by the SJPC in making its determination as to whetherdisclosure is proper under the law.The SJPC has diligently prepared this RFP, and has presented all known, pertinent data asaccurately and as completely as possible. This data is provided for general informationpurposes only. The SJPC does not guarantee or warrant the correctness of this information;moreover, the SJPC accepts no responsibility for any omissions or deletions of informationrelating to this RFP.DISCLAIMERThe contents and information provided in this RFP are meant to provide general informationto interested parties, and in no way reflects the adherence of the SJPC to any public biddingrequirements. The successful Proposer shall be required to execute an agreement withSJPC that will govern the rights, duties and obligations between SJPC and the successfulProposer.Accordingly, the terms set forth within this RFP do not constitute any contract or agreementbetween SJPC and the successful Proposer. Moreover, SJPC accepts no responsibility forany omissions or deletions relating to this RFP; however, the successful Proposal will becomepart of the entire agreement.41.0 INFORMATION FOR PROPOSERSBACKGROUND, PURPOSE, AND INTENTThe SJPC is an agency of the State of New Jersey with a mission to develop, maintain and operate marineterminals and related intermodal transportation infrastructure within the South Jersey Port District. Theagency has primary offices at 2 Aquarium Dr., Suite 100 and port operations at the Balzano Marine Terminaland the Broadway Terminal in Camden, New Jersey. The agency also has facilities in Salem and Paulsboro.SJPC is a grantee of Foreign Trade Zone #142. Additional information may be found by visitinghttp://www.southjerseyport.comIt is the intent of the SJPC to award a contract to the responsive Proposer whose Proposal conforms tothe specifications in the RFP and provides the greatest benefit to the SJPC, when all factors areconsidered. The successful Proposer will be responsible for all negotiations with any respectiveauthorized suppliers to provide the SJPC with the best price advantage possible.Proposer(s) responding to this RFP must have extensive experience and a knowledgeable backgroundand qualifications in the provision of the services described in this RFP.In order to be considered for selection, proposals must be received no later thanThursday, January 15, 2026 at 11:00 AM.TERM OF CONTRACTFollowing a determination of award by the SJPC, a contract will be entered into with the successfulProposer(s). The contract term shall be for one year, with the Owner’s option to extend the contract fortwo, one-year extensions under the same terms and conditions.SUBMISSION OF PROPOSALSProposals submitted in response to this RFP must contain sufficient detail to allow the SJPC toevaluate the Proposer’s experience and qualifications, technical and customer service approach, andcost.
