BID CLOSING: Will be public following the receipt of bids at the office of the Contracts &Procurement Division, City Hall, 215 SE 7th Street, Room B60, Topeka, Kansas 66603.4. DESCRIPTION OF MAJOR UNITS OF WORK:5. DESIGN ENGINEER: City of Topeka, Engineering Division, 620 SE Madision St, 2nd Floor,Topeka, KS 666076. BID DOCUMENTS: Electronic copies (PDF’s) of the bid documents (plans and specifications) andany addenda are available using the Topeka Vendor Access website. Register online athttps://cityoftopekaks.tylerportico.com/va/vendor-access/registration .7. BID SECURITY REQUIREMENTS: All bids must be accompanied by a cashier's check or a bidbond for not less than five percent (5%) of the amount bid (including alternates), made payable to theCity of Topeka, Kansas. The original bid security shall be provided to the office of Contracts andProcurement before the 2:00 closing date.8. PRE-BID CONFERENCE: A pre-bid conference will be held at ___________N/A__________.Representatives of the Design Engineer and Owner will be present to answer questions.Attendance is ___N/A___ (mandatory or optional). If indicated as optional, attendance is highlyencouraged for bidders to attend in order to understand the expectations and details involved in theproject and contract.9. SUBMITTALS: Bid submittal requirements are explained in Document 100: Instructions toBidders.10. BID QUESTIONS: All questions must be submitted using the Bid Question Submittal Form(Excel) included in the Bid Attachments. Bidders shall download the form, enter their questionsdirectly into the Q# fields (handwritten submissions will not be accepted), and email the completedDocument 02001/29/2025Excel file to procurement@topeka.org no later than ten (10) days prior to the bid closing date andtime, unless otherwise stated in the bid documents.The email subject line shall read: Bid Number #### – Questions.If more than forty (40) questions are required, bidders may insert additional rows as needed. Theform must be submitted as an MS Excel (.xls or .xlsx) file.Responses to questions will be issued by addendum and posted in the Bid Attachments as a PDFtitled:Bid Number #### – Answers to Bid Question Submittal Form.11. Plan Holder List: Contractors seeking to be included on the Plan Holders List must complete thePlan Holders Information Form (Excel Worksheet) included in the Bid Attachments. Contractorsshall download the form, enter their business name, contact name, phone number, and emailaddress, and email the completed Excel file to procurement@topeka.org no later than ten (10) daysprior to the bid closing date, unless otherwise stated in the bid documents.The email subject line shall read: Bid Number #### – Plan Holders Request.A complete Plan Holders List will be published in the Bid Attachments as a PDF titled:Bid Number #### – Plan Holders List.Document 02001/29/2025DOCUMENT 100INSTRUCTIONS TO BIDDERS1. Defined Terms.Terms used in these Instructions to Bidders shall have the meanings assigned to them in the GeneralConditions. The term "Successful Bidder" means the lowest, qualified, responsible Bidder to whomOwner (on the basis of Owner's evaluation as hereinafter provided) makes an award.2. Copies of Bidding Documents.2.1. Complete sets of the Bidding Documents in the number and for the purchase sum,ifany, stated in the Invitation may be obtained from the office designated in the Invitation to Bid.2.2. Complete sets of Bidding Documents shall be used in preparing Bids; neither Ownernor Design Engineer assumes any responsibility for errors or misinterpretations resulting fromthe use of incomplete sets of Bidding Documents.2.3. Owner and Design Engineer in making copies of Bidding Documents available on theabove terms do so only for the purpose of obtaining Bids on the Work and do not confer alicense or grant for any other use.3. Qualifications of Bidders.To demonstrate qualifications to perform the Work, the apparent low Bidder must be prepared tosubmit within five days of Owner's request written evidence of the types set forth in the General orSupplementary Conditions, such as financial data, previous experience and evidence of authority toconduct business in the jurisdiction where the Project is located. Any information furnished pursuantto this section shall be deemed confidential and will not be disclosed by the Owner. Each Bid mustcontain evidence of Bidder's qualification to do business in the State of Kansas or covenant to obtainsuch qualification prior to award of the contract.4. Examination of Contract Documents and Site.4.1. Before submitting a Bid, each Bidder must (a) examine the Contract Documentsthoroughly, (b) visit the site to familiarize himself with local conditions that may in anymanner affect cost, progress or performance of the Work, (c) familiarize himself with federal,state and local laws, ordinances, rules and regulations that may in any manner affect cost,progress or performance of the Work; and (d) study and carefully correlate Bidder'sobservations with the Contract Documents.4.2. Reference is made to the Supplementary Conditions for the identification of thosereports of investigations and tests of subsurface and latent physical conditions at the site orotherwise affecting cost, progress or performance of the Work which have been relied upon byEngineer in preparing the Drawings and Specifications. Owner will make copies of suchreports available to any Bidder requesting them. These reports are not guaranteed as toaccuracy or completeness, nor are they part of the Contract Documents. Before submitting hisBid each Bidder will, at his own expense, make such additional investigations and tests as theBidder may deem necessary to determine his Bid for performance of the Work in accordancewith the time, price and other terms and conditions of the Contract Documents.12/4/2019100 - 1
