During thepreconstruction phase, the Contractor will collaborate with the County on existing conditions,design, constructability, cost, and schedule of the Project and develop a Guaranteed MaximumPrice (GMP) for the construction phase of the Project. Upon County acceptance of the GMP, theCounty may exercise its option for the construction phase. If the County and the Contractor donot agree upon a GMP, the County may not exercise its option for the construction phase of theProject to the Contractor.The budget not to exceed for this Project of When submitting viaBuyNet, allow extra time to submit by an alternate method in the event of technicaldifficulties.1.4.4 The County's decision about the timeliness or responsiveness of any submitted documentshall be final, and the County has the discretion to waive or not waive any defect ornonconformance.1.5 BONDING AND INSURANCE1.5.1 Proposer shall demonstrate a minimum bonding capacity of the Budget NTE for allContract Options in response to this RFP.1.5.2 The selected Proposer shall provide a Payment Bond and Performance Bond as specifiedin the article titled, “Insurance and Bonds” of the General Conditions.1.5.3 The selected Proposer shall provide insurance as specified in as described in 00 73 16Insurance Requirements.1.6 INSURANCE FOR ACTS OF GODThe successful Proposer shall provide Installation Floater/Builders Risk insurance including Actsof God for the total replacement cost of the Project, as described in 00 73 16 InsuranceRequirements.
