INTRODUCTIONA. PURPOSE OF THIS REQUEST FOR PROPOSALThe County is seeking a consultant to prepare three studies that are required for the Boardof County Commissioners (BCC) to consider an amendment to Ordinance 1995-04Imposing Fire and Rescue Impact Fees. These studies are to help formulate the Land UseAssumptions, Impact Fee Capital Improvement Plans and, the Nexus Study, all collectivelyreferred to in this Request for Proposal as the “Impact Fee Studies”.B. BACKGROUNDThe overall purpose of the Impact Fee Studies are to project the estimated demand forvarious types of development in Santa Fe County for the following five years, determinethe capital improvements that are necessary to support the anticipated development, andrecommend an impact fee for each type of development so the impact of the newdevelopment does not exceed the minimum level of service (LOS) for each type of capitalimprovement within the designated service area. Each study must be completed accordingto the requirements of the State of New Mexico Development Fees Act. The types of capitalimprovements to be considered in the Impact Fee Studies are:1. Water supply and delivery2. Wastewater collection and treatment3. Storm drainage facilities4. Roads, bridges, bus bays, right of ways, traffic signals, and landscaping5. Bicycle and pedestrian paths6. Parks and open space7. Fire, police and rescue services and essential equipmentThe Board of County Commissioners (BCC) adopted Ordinance 1995-04 (Exhibit A) in1995, imposing an impact fee exclusively for fire and emergency services. Since itsadoption, the ordinance has not been amended. Pursuant to the Development Fees Act, theBCC appointed citizens to serve on the Capital Improvements Advisory Committee(CIAC), whose primary role is to provide recommendations to the BCC regardingOrdinance 1995-04 and any proposed amendments.In 2015, the BCC adopted the Sustainable Growth Management Plan (SGMP) as theCounty’s General Plan. The SGMP states the overall purpose of an impact fee ordinance:“The goal of an impact fee program is to equitably distribute the costs of serving newdevelopment while achieving sufficiency of capital improvement revenues.”On October 10, 2023, through Resolution 2023-05 (Exhibit B), the BCC determined itwould not pursue amendments to Ordinance 1995-04 for an additional five years, at whichtime reconsideration will again be required.
