Proposals will be received by 10:00 A.M.Central Daylight Savings Time, April 23rd, 2026.CITY OF WEST FARGO RIGHTSThe City reserves the right to cancel this Request in writing or postpone the date and timefor submitting Quotes at any time prior to the Quotes due date. The City by this Request doesnot promise to accept the lowest cost or any other Quote and specifically reserves the rightto reject any or all Quotes, to waive any formal Quote requirements, to investigate thequalifications and experience of any Submitter, to reject any provisions in any Quote, tomodify request contents, to obtain new Quotes, to negotiate the requested services andcontract terms with any submitter, or to proceed to do the work otherwise.The City hereby notifies all submitters that it will affirmatively ensure that regarding anycontract entered into, pursuant to this request, minority business enterprises will be affordedfull opportunity, and are encouraged to submit Quotes in response to this invitation and willnot be discriminated against on the grounds of race, color, sex, or national origin inconsideration for an award. This specification shall not beinterpreted as restrictive but rather as a measure of quality and performanceagainst which all other materials will be compared. All materials furnished willmeet or exceed City of West Fargo Standard Specifications for Construction(Rev. 2025 or newer) or the NDDOT Standard Specifications for Road andBridge Construction (Rev. 2025 or newer).It is the intent of this specification that all products identified for purchase may notbe awarded to a single submitter. All items and products identified within thisrequest will be awarded individually based on lowest price. Product quality,availability, and delivery will be secondary factors in successful awards. WFPWalso reserves the right to reject any or all Quotes or any part thereof, and towaive any minor technicalities. If the material is not available at the time ofordering, WFPW will purchase said materials from the next lowest submitter thathas availability.2.0 EQUIVALENT PRODUCTQuotes will be accepted for consideration from any manufacturer or supplier thatis equal to or superior to the materials specified. Decisions of equivalency will be atthe sole interpretation of the WFPW. A specification sheet of each product is tobe submitted with the Quote.3.0 INTERPRETATIONSIn order to be fair to all submitters, no oral interpretations will be given to anysubmitter, as to the meaning of the specification documents or any part thereof.Every request for such consideration shall be made in writing. Based on suchinquiry, the WFPW may choose to issue an Addendum in accordance with localstate laws.4.0 GENERALThe specification herein states the minimum requirements of theWFPW. All Quotes must be regular in every respect. Unauthorizedconditions, limitations, or provisions shall be cause for rejection. TheWFPW will consider as irregular or non-responsive any and all Quotesthat are not prepared and submitted in accordance with the Quotedocument and specification, or any Quote lacking sufficient technicalliterature to enable the WFPW to make a reasonable determination ofcompliance to the specification.
