Town of Fort Mill Millstone Park Playground SurfacingImprovements Project RFP 500-152The Town of Fort Mill is soliciting proposals from qualified firms to review, evaluate, and provide pricingoptions for playground surfacing improvements at Millstone Park, located at104 Spratt Street, Fort Mill, SC 29715.Mandatory Pre-Bid MeetingFriday, January 23, 2026 at 11:30amLocation: Town of Fort Mill Millstone Park104 Spratt Street Fort Mill, SC 29715Rain or ShineBid OpeningMonday, February 2, 2026@ 2:00 pm205 North White StreetFort Mill, SC 29715If you deliver in person, pleasedrop off with the receptionist.1Scope of WorkProposers shall provide separate, itemized pricing for each of the following options:Option A – Poured-in-Place (PIP) Surfacing• Furnish and install a poured-in-place rubber playground surface• Surface shall be ADA-compliant and meet all applicable ASTM and CPSC standards, including fallheight requirements• Include base preparation, drainage considerations, and edging as required• Remove and properly dispose of all existing wood mulch playground surfacing.• Ensure removal activities do not damage existing playground equipment, borders, drainage, orsurrounding landscaping.• The successful proposer shall be responsible for providing all labor, materials, equipment,supervision, and incidentals necessary to complete the work in accordance with industrystandards and applicable codes.Option B – Artificial Turf Surfacing• Furnish and install playground-grade artificial turf with appropriate padding system• Surface shall be ADA-compliant and meet all applicable safety and fall protection standards• Include infill, drainage considerations, and edge containment• Remove and properly dispose of all existing wood mulch playground surfacing.• Ensure removal activities do not damage existing playground equipment, borders, drainage, orsurrounding landscaping.• The successful proposer shall be responsible for providing all labor, materials, equipment,supervision, and incidentals necessary to complete the work in accordance with industrystandards and applicable codes.Be sure to include a schedule for options A. and B.• Provide an estimated project timeline for each surfacing option, including:o Mobilizationo Installation durationo Substantial completionWarranty and Maintenance• Include warranty information for materials and installation• Provide recommended maintenance requirements for each surfacing option2All proposals shall be addressed and/or delivered in a sealed envelope to:Town of Fort Mill205 North White StreetFort Mill, SC 29715Attn: Phillip Aycock, Procurement Manager RFP 500-152Proposals will be received by 2:00 p.m. (Eastern Time) on February 2, 2026. If the Council does not appropriate the funding needed by the Town to make paymentsunder this Agreement for a given fiscal year, the Town will not be obligated to pay amounts due beyondthe end of the last fiscal year for which funds were appropriated. No act or omission by the Town, whichis attributable to non-appropriation of funds, shall constitute a breach of or default under thisAgreement.Bid CancellationCancellation An Invitation for Bids, a Request for Proposals, a Request for Qualifications, or othersolicitation may be cancelled, or any or all bids or proposals may be rejected in whole or in part as maybe specified in the solicitation, when it is in the best interest of the Town. The reasons therefor shall bemade part of the contract file.Compliance with LawThe selected consultant and its agents and employees shall be bound and comply with all federal, state,and local laws, ordinance rules and regulations, as well as all other governing bodies having legaljurisdiction with respect to the area where such work is performed.3Disqualification and Rejection of QuotationsTown of Fort Mill reserves the right to reject any consultant who has failed to perform satisfactorily, orcomplete on time, or in a manner inconsistent with the bid documents, contract of similar nature, or toreject the RFP of a consultant who is not able to perform such contract satisfactorily. The Townexpressly reserves the right to award the contract to the consultant that best meets the requirements asset forth herein – which is in the best interest of the Town, and it’s need. This solicitation does notcommit the Town of Fort Mill to award a contract, to pay any cost incurred in the preparation of aproposal, or to produce or contract for services. A respondent may not alter the RFQ or its components.The Town of Fort Mill reserves the right to accept or reject any or all proposals received as a result ofthe Request for Proposal, or to cancel it in part or in its entirety if it is in the best interest of the Town ofFort Mill. The Town reserves the right to change the solicitation schedule or issue amendments to thesolicitation at any time. All respondents submitting qualifications agree to abide by all relevantprovisions of the South Carolina Code of Laws as they apply.Compliance with LawThe selected consultant and its agents and employees shall be bound and comply with all federal, state,and local laws, ordinance rules and regulations, as well as all other governing bodies having legalauthority with respect to the area where such work is performed.Excluded BiddersBids from vendors/contractors with prior poor performance; quality issues, contact conformance,payment history, timeline compliance, or any other reason the Town deems POOR PERFORMANCE willnot be considered. Excluded Vendors/Contractors can resubmit complete company information withreferences for the Town review after a minimum of one year from the last excluded bid. The Town willcontact Vendor/Contractor with its decision within 30 days of company information submittal. The Townreserves the right to include or exclude said Vendor/Contractor based on findings.4Freedom of Information ActThe parties acknowledge that all material submitted may be subject to release under the South CarolinaFreedom of Information Act (FOIA) and will be released to the public unless exempt from disclosureunder FOIA. We discourage you from including any information you consider proprietary or trade secret,as this material is subject to the FOIA once it is in the Town’s possession. If you must include suchinformation in your submission, please identify it by color, labeling, and/or bold font so that it can bereadily identified. In the event the Town receives a request for this material, the Town will notify thoseparties who have identified information they believe is proprietary or trade secret of the request. TheTown has a Ten (10- day deadline to produce the material. This is your window to file an actionchallenging the release. Please be on notice that if the Town is not served such an action, theinformation will be released).Town of Fort Mill Business License / PermittingThe successful contractor, prior to execution of the contract, must possess or obtain a Town of Fort MillBusiness License. Such license must be maintained throughout the duration of the contract. The fee forsuch license is based on the amount of the contract with the Town if the contractor is not currentlydoing other business inside the town limits. If the contractor is currently doing other business within thetown limits of Fort Mill, and does not possess a business license, then the fee for the license is based onthe total gross receipts from customers within the city limits. Any subcontractors and sub-subcontractors must also possess or obtain a Town of Fort Mill Business License. The successfulcontractor, prior to execution of the contract, must also obtain any required permitting as deemednecessary by the town’s building code official. After the award of the bid the selected bidder wouldsubmit plans for the signage – they will be reviewed by Town staff to see if they meet the Town buildingand zoning codes and then the contractor would be able to pay for the permits and then begin work.Contact the Business Office at 803-547-2034 to ask pertinent questions regarding doing business in theTown of Fort Mill.5
