MERCHANT ST. RECONSTRUCTIONPROJECT – PHASE 2”, City of Effingham, Illinois, and in case of conflict with any part or parts of saidSpecifications, the said Special Provisions shall take precedence and shall govern.LOCATION OF PROJECTThe proposed work for this project is to be located along N. Merchant St. between Flamingo Ave. &Evergreen Ave. in the City of Effingham, IL 62401. Please see location map on the title sheet of theconstruction plans for additional details.DESCRIPTION OF WORKThe work included in this section consists of the reconstruction of pavement and subbase with othermiscellaneous work.LIQUIDATED DAMAGESIt is understood and agreed that time is of the essence in the performance of the Contract and that failureon the part of the Contractor to complete the contract work in the time herein set forth will result in certainloss and damages to the Owner. Failure on the contractor’s part to complete such work shall be consideredjust cause for forfeit of his/her surety bond.Any Street closures on Merchant Street shall be completed in a timely manner. Any roadway or drivewaypavement that has been removed shall be replaced with permanent or temporary pavement before openingto traffic. In the case the contractor shall fail or neglect to comply with these requirements, then saidContractor shall and will pay to the Owner such sums as may be due to him under the terms of the Contractat the rate specified in the Standard Specifications for Road and Bridge Construction.In case the Contractor of the work shall fail or neglect to have substantial completion of the project on orbefore December 31, 2026 then said Contractor shall and will pay to the Owner such sums as may be dueto him under the terms of the Contract at the rate specified in the Standard Specifications for Road andBridge Construction.Substantial completion shall be defined as all work from back-of-curb to back-of-curb on Merchant Street.Sanitary sewer, sidewalk, and seeding work may take place after the substantial completion date.JOINT UTILITY LOCATING INFORMATION FOR EXCAVATORS (J.U.L.I.E.)This work shall be done in accordance with Article 107.39 of the Standard Specifications except as hereinmodified.If any of the location marks placed by a utility company in conformance with this procedure are destroyedby Contractor operations, the Contractor shall immediately notify the utility owner and bear the costs ofremarking the facilities at his own cost and expense. Compliance with this special provision shall beconsidered incidental to the contract and no additional compensation will be allowed for any costs incurred.CONTRACTOR RESPONSIBLE FOR LOCATING UTILITESBefore beginning work, it shall be the Contractor’s sole responsibility to coordinate with the utility ownersand to determine the actual location of all such facilities. The Contractor shall also obtain from the respectiveutility owners detailed information relative to the location of their facilities and the working schedules of theutility owners for removing or adjusting them.4COOPERATION BETWEEN CONTRACTORSThere is a possibility that other Contractor operations may be ongoing within the proposed project limits atthe same time as the work included in this contract is being performed. The Contractor for this Sectionshall cooperate with any other Contractors performing work adjacent to this project in accordance withArticle 105.08 of the Standard Specifications. Any inconveniences or delays caused the Contractor incomplying with this requirement shall be considered incidental to the contract and no additionalcompensation will be allowed.LOCATION OF UTILITIES NOT SHOWN ON PLANSThe Contractor is advised that various underground and surface utilities and structures may or may not becorrectly shown on the plans. Such facilities are shown on the plans for the information of the Contractor,but information so given is not to be construed as a representation that such facilities will be found orencountered exactly as shown. Other utilities and structures may also be encountered which are not shownon the plans. The Owner and its Engineer assume no responsibility whatever in respect to the sufficiencyor accuracy of the information shown in the plans relative to the presence or location of such facilities.MAINTAIN UTILITIES IN OPERATING CONDITIONThe Contractor shall maintain in operating condition all utilities encountered in the work. The Contractorshall be entirely responsible for all damages to water pipes; electrical conduits; existing drains or sewers;gas pipes; and poles carrying electrical current, telephone or television lines during the prosecution of thework and shall be liable for damages to public or private property resulting there from, which amount maybe deducted from any monies due the Contractor for work done.
