All questions submitted in writing to Greg Roto atgroto@auburnma.gov by May 1, 2026 at 12:00 PM will be responded to. No questions will be acceptedor answered after this time.The subject project is being bid and constructed as a “public works” project and subject to the applicableprovisions of MGL Ch. 30 Section 39M. There are no filed sub-bids for this project.Bidders must be able to demonstrate that all employees present at the worksite have successfullycompleted the OSHA 10-hour training course.The MBE/WBE requirement and the minimum minority employee percentage for this project are both5%.Bidders must be able to demonstrate previous experience in work of similar nature and complexity andshall furnish all such information necessary for this purpose as the Town Engineer may request.The Town of Auburn reserves the right to accept any Bid or to reject any or all Bids if it deems it is in thebest interest of the Town to do so.Commonwealth of Massachusetts’s Minimum Wage Rates, in accordance with MGL Chapter 149,Section 26 to 27D inclusive, are applicable.MassDOT prequalification of contractors with the class of work as, “PAVEMENT –SURFACING”, will be required.Town of Auburn DPWEngineering Division2TABLE OF CONTENTSSectionNotice to BiddersDefinitions and Abbreviations1Information for Bidders2Bid3Agreement4Contract Bonds5General Specifications6Special Conditions7Special Provisions8Detail Sheets9Quantity Estimate by Street10AppendixTraffic Management PlansPrevailing Wage Rates3SECTION 1DEFINITIONS AND ABBREVIATIONSPART 1 – GENERAL1.1 DEFINITIONSWherever the words hereinafter defined or pronouns used in their stead occur in the ContractDocuments, they shall have the following meanings:The AGREEMENT, the INFORMATION FOR BIDDERS, the Contractor’s BID as accepted bythe Owner, the SPECIAL CONDITIONS, the GENERAL and DETAILED SPECIFICATIONS, theDrawings, and all Addenda and amendments to any of the foregoing collectively constitute theContract Documents, and are sometimes herein referred to as the “Contact”.The word “Owner” shall mean the party of the first part designated in the AGREEMENT.The word “Contractor” shall mean the party of the second part designated in the AGREEMENT.The word “Engineer” shall mean that person or firm duly appointed by the Owner to undertakethe duties and powers herein assigned to the Engineer, acting either directly or through dulyAuthorized representatives.The word “Work” shall mean the work herein specified to be done as described underLOCATION AND WORK TO BE DONE in Section 2 INFORMATION FOR BIDDERS.The word “Drawings” shall mean the Contract Drawings as described under LOCATION ANDWORK TO BE DONE in Section 2 INFORMATION FOR BIDDERS.The word “State” or “Commonwealth” shall mean the Commonwealth of Massachusetts.The word “Specifications” when used herein shall be deemed to refer to both the General andDetailed Specifications.The words “herein”, “hereunder”, and words of like import shall be deemed to refer to theContract Documents.Wherever in the Contract Documents, the words “as directed”, “as ordered”, “as requested”, “asrequired”, “as permitted”, or words of like import are used, it shall be understood that thedirection, order, request, requirement, or permission of the Engineer is intended. Similarly, thewords “approved”, “acceptable”, “satisfactory”, and words of like import shall mean approved by,acceptable to, or satisfactory to the Engineer.The words “or equal” or words of like import, shall mean equal in accordance with the followingprovisions; an item shall be considered equal if in the opinion of the Engineer: (1) it is at leastequal in quality, durability, appearance, strength and design; (2) it will perform at least equallythe function imposed by the general design for the work being contracted for or the materialbeing purchased; and (3) it conforms substantially, even with deviations, to the detailedrequirements for the item. The figures given on the Drawings or in the other ContractDocuments after the “elevation” or abbreviation of it shall mean the distance in feet above thedatum adopted by the Engineer.4The word “rock”, wherever used as the name of an excavated material or material to beexcavated, shall mean only pieces of concrete or masonry exceeding 1 cubic yard in volume, orsolid ledge rock which in the opinion of the Engineer, requires for its removal, drilling andblasting, wedging, sledging, barring, or breaking up with a power operated tool.
