All work shall be performed in accordance with the project specifications,applicable provisions of the CAMA General Permit, and in full compliance with all state, federal, and local laws,regulations, and permit conditions governing dredging, marine construction, and environmental protection.General Scope of WorkThe Cedar Island Harbor Channel Maintenance Dredging project involves the removal and disposal of approximately999 cubic yards of accumulated sediment from a public waterway that provides essential navigational accessbetween mainland Cedar Island and Cape Lookout National Seashore. The dredging area is located in thewesternmost portion of the channel and is approximately 660 feet in length and 10-25 feet in width, with a targetchannel depth of -6 feet relative to Normal Water Level (NWL).The contractor shall be responsible for furnishing all labor, materials, equipment, tools, and incidentals necessary tocomplete the work in accordance with the project specifications and permit requirements. Dredging operations shallbe performed using mechanical (bucket and barge) methods, and the entire channel reach must be restored to theauthorized -6 feet NWL depth. All dredged material shall be transported by barge and offloaded at County propertyadjacent to Cedar Island Harbor.All work must be conducted in compliance with CAMA General Permit #97205C , as well as all applicable federal,state, and local laws and regulations governing dredging, environmental protection, and marine construction. Thecontractor is responsible for implementing appropriate Best Management Practices (BMPs) to prevent sedimentation,turbidity, or environmental harm during the execution of the project.Contractor will provide weekly dredge totals to County staff and will coordinate with staff to document actual materialremoved. The contractor shall complete all work within the timeframe specified in the contract, which will be definedin the Notice to Proceed. It is understood and agreed that by submitting a bid that the Contractorhas examined these contract documents, drawings and specifications and has visited the site of the Work,and has satisfied himself relative to the Work to be performed.MATERIALS, EQUIPMENT AND EMPLOYEESa) The Contractor shall, unless otherwise specified, supply and pay for all labor, transportation, materials, tools,apparatus, lights, power, fuel, sanitary facilities and incidentals necessary for the completion of his work, andshall install, maintain and remove all equipment of the construction, other utensils or things, and beresponsible for the safe, proper and lawful construction, maintenance and use of same, and shall construct inthe best and most workmanlike manner, a complete job and everything incidental thereto, as shown on theplans, stated in the specifications, or reasonably implied there from, all in accordance with the contractdocuments.b) All materials shall be new and of quality specified, except where reclaimed material is authorized herein andapproved for use. Workmanship shall at all times be of a grade accepted as the best practice of the particulartrade involved, and as stipulated in written standards of recognized organizations or institutes of the respectivetrades except as exceeded or qualified by the specifications. The Contractor shall field verify and beresponsible for the accuracy of all measurements and material quantities pertaining to all trades ofconstruction.c) No changes shall be made in the Work except upon written approval and change order by Director, CarteretCounty General Services.d) Products are generally specified by ASTM or other reference standard and/or by manufacturer’s name andmodel number or trade name. When specified only by reference standard, the Contractor may select anyproduct meeting this standard, by any manufacturer. When several products or manufacturers are specifiedas being equally acceptable, the Contractor has the option of using any product and manufacturer combinationlisted.e) However, the Contractor shall be aware that the cited examples are used only to denote the quality standardof product desired and that they do not restrict bidders to a specific brand, make, manufacturer or specificname; that they are used only to set forth and convey to bidders the general style, type, character and qualityof product desired; and that equivalent products will be acceptable. Substitution of materials, items orequipment of equal or equivalent design shall be submitted to the Owner or architect or engineer for approvalor disapproval; such approval or disapproval shall be made by the Owner or architect or engineer prior to theopening of bids.f) If at any time during the construction and completion of the work covered by these contract documents, theconduct of any worker of the various crafts be adjudged a nuisance to the Owner or if any worker beconsidered detrimental to the work, the Contractor shall order such parties removed immediately from thesite.g) The Contractor shall employ a competent superintendent who shall represent the Contractor and have theauthority to make field decisions necessary for performing the work. Competency must be demonstrated byperforming high quality construction work on time according to the approved schedule. The superintendentmust be able to clearly verbally communicate using the English language in order to safely and effectivelyperform job duties and provide project updates to the County POC(s). Carteret County reserves the right torequire replacement of the superintendent by Contractor without explanation or expense from the County.CODES, PERMITS AND INSPECTIONSA. Contractor shall comply with all applicable federal, state, and local laws, regulations, and ordinances,including those governing navigable waters, environmental protection, and public safety.B. Work shall be conducted under the authority of CAMA General Permit #97205C, and the contractor shalladhere to all permit conditions.C. Contractor is responsible for verifying, securing, and maintaining any additional permits, licenses, orauthorizations required for access, spoil handling, transport, or disposal, if not already provided by theCounty.D. All dredging operations shall conform to applicable standards set forth by the North Carolina Department ofEnvironmental Quality (NCDEQ), U.S. Army Corps of Engineers, and Coastal Area Management Act(CAMA) regulations.E. Contractor shall implement and maintain Best Management Practices (BMPs) to control erosion,sedimentation, turbidity, and prevent pollution during all phases of the work.F. The contractor must coordinate with relevant regulatory agencies as required and ensure that anyinspection or reporting requirements are met.G. The County and its representatives shall have the right to inspect the work at any time, and the contractorshall provide full access to the worksite and all documentation upon request.H. Any deviations from permitted activities must be reported immediately to the County and appropriateregulatory authorities for review and approval.I. Final acceptance of the work is contingent upon satisfactory inspection by the County and verification ofpermit compliance.SAFETY REQUIREMENTSa) The Contractor shall be solely responsible for the entire site and the construction of the same and provide allthe necessary protections as required by laws or ordinances governing such conditions and as required bythe Owner or Designer. He shall be responsible for any damage to the Owner's property or that of others onthe job, by himself, his personnel or his subcontractors, and shall make good such damages. He shall beresponsible for and pay for any claims against the Owner arising from such damages.b) The Contractor shall adhere to the rules, regulations and interpretations of the North Carolina Department ofLabor relating to Occupational Safety and Health Standards for the Construction Industry (Title 29, Code ofFederal Regulations, Part 1926 published in Volume 39, Number 122, Part 11, June 24, 1974 FederalRegister), and revisions thereto as adopted by General Statutes of North Carolina 95-126 through 155.c) The Contractor shall provide all necessary safety measures for the protection of all persons on the work,including the requirements of the AGC Accident Prevention Manual in Construction as amended, and shallfully comply with all state laws or regulations and North Carolina Building Code requirements to preventaccident or injury to persons on or about the location of the work. He shall clearly mark or post signs warningof hazards existing, and shall barricade excavations and similar hazards. He shall protect against damage orinjury resulting from falling materials and he shall maintain all protective devices and signs throughout theprogress of the work.TAXESa) Carteret County is not exempt from North Carolina State Sales and Use Taxes on labor, material andequipment to be incorporated in the Work. Said taxes shall be included in invoices submitted by Contractor.Contractor in submitting his invoices shall break out all sales taxes as a separate item and County wherepurchase was made.EQUAL OPPORTUNITYa) The non-discrimination clause contained in Section 202 (Federal) Executive Order 11246, asamended by Executive Order 11375, relative to Equal Employment Opportunity for all persons withoutregard to race, color, religion, sex or national origin, and the implementing rules and regulationsprescribed by the Secretary of Labor, are incorporated herein.b) The Contractors agree not to discriminate against any employees or applicant for employmentbecause of physical or mental handicap about any position for which the employees or applicant isqualified. The Contractor agrees to take affirmative action to employ, advance in employment andotherwise treat qualified handicapped individuals without discrimination based upon their physical ormental handicap in all employment practices.MINORITY BUSINESS PARTICIPATIONa) It is the intent of the County to encourage Contractors in making every effort to utilize Minority BusinessEnterprises for subcontracted work. The County has established efforts to record participation of suchEnterprises by the attached “Appendix E – MBE DOCUMENTATION FOR CONTRACT PAYMENTS”. TheContractor shall include the attached Appendix E with each pay application.
