BOROUGH OF MADISON, NJSOLICITATION FOR CONCESSION OPERATOR FOR THE MADISON COMMUNITY POOLCONCESSION STAND – 2026 SEASONThe Borough of Madison is soliciting quotes for a Concession Operator for the Madison CommunityPool Concession Stand, located off Rosedale Avenue at the Community Pool Complex in Madison, NJ.Submission Deadline: April 6th @ 4pmAddress all Quotes and questions to: Pool@Rosenet.orgQuotes may be emailed to pool@rosenet.org or they may be mailed or hand delivered toBorough Hall, 50 Kings Rd, Attention CFO Jim Burnet. The Borough will not be responsible forany proposal that is sent by mail or other form of carrier which is lost or which arrives after thesubmission deadlineProposers may request a tour of the facility. Please email pool@rosenet.org to coordinate.The Borough, in its sole discretion, reserves the right to reject any or all qualifications and towaive any and all irregularities as is in the best interest of the Borough. A final award shall bemade by Resolution adopted by a majority of the Borough Council based upon the quote madeto the Borough that has been determined to be the most advantageous to the Borough, priceand other factors considered. The Borough reserves the right to negotiate the terms andconditions with any qualified proposer before making its determination and appointment.PURPOSE OF REQUESTThe Borough of Madison is requesting quotes from qualified individuals or companies to serveas Concession Operator for the Madison Community Pool Concession Stand, located offRosedale Avenue in the Borough of Madison.INSTRUCTIONS AND GENERAL CONDITIONS1. Please complete the attached Proposal sheet in its entirety.2. The successful bidder will provide all the necessary staffing, perform all the necessarybackground checks and verifications of all staff to be hired.3. After notification of award but prior to execution of a Goods and Services Contract and/orProfessional Services Contract, the successful bidder must submit a) an NJ BusinessRegistration Certificate, b) Non-Collusion Affidavit, c) Statement of Ownership and otherrequired documentation.4. The Borough of Madison reserves the right to close the Madison Community Pool Complexat any time during the duration of this contract. In the event the Borough closes the pool,the Concession Operator shall only be responsible for the pro rata portion of the concessionfee through the date of closure.FP-1SCOPE OF SERVICESThe Concession Operator shall operate the concession stand located at Madison CommunityPool in the Borough of Madison. The Concession Operator shall provide all necessarysupervision and staffing to prepare the concession stand for operation, operate the poolconcession stand as specified during the operating season, and clean up and close theconcession stand at the completion of the pool season.Operating Requirements - The concession stand shall be operated at all times in accordancewith the following requirements:Specific hours of operation are as follows: The concession stand shall be open from May 23,2026 through September 7, 2026 including special events and swim meets as follows:• May 23, 24, 25, 30, 31 as well as June 6, 7, 13, 14 from 11am to 7:30pm.• June 19 – September 7 from 10am to 7:30pm on weekdays and 11am to 7:30pm onweekends and Labor Day.• The Borough of Madison will notify the Concession Operator at least 48 hours before anyextension of hours for special events such as Moon Light Swims. The Concession Operatorshall remain open during those hours.1. The Concession Operator shall provide an adult supervisor, at least 21 years of age at alltimes at the concession stand.2. The Concession Operator shall be responsible for properly training all staff membersand shall require staff to attend food handling courses if required by the Health Officer.3. The Concession Operator shall be responsible for keeping the patio area, including anypicnic tables, benches and trash containers, clean at all times.4. The Concession Operator shall provide any additional equipment he/she deemsnecessary, e.g., soda dispensing equipment and freezer, at his/her own expense.5. The Concession Operator shall provide all plates, napkins and disposable items.6. The Concession Operator shall provide adequate staffing at all times so that the timerequired to be served does not become excessive. The Concession Operator isresponsible for paying staff including withholding of state and federal taxes.7. The Concession Operator is required to submit sales tax generated as a result ofoperating the Pool Concession Stand to the State of New Jersey as per state statute.8. The Borough of Madison shall pay for all utilities. The Borough of Madison shall repairor replace, as necessary, any equipment in the concession stand which has beensupplied by the Borough, unless the proposer’s negligence is determined to be thecause of any failure. The determination of the presence or absence of negligence willfall to the Borough Administrator in consultation with the Director of Public Works.Proposed Menu – Each proposer shall submit a proposed menu with pricing for eachconcession stand. Concession Operator must provide the following mandatory items at alltimes: soda (regular and diet); iced tea (regular and diet); coffee; bottled water; hamburgersFP-2and hotdogs; French fries; pizza; chicken strips or tenders and brand name ice cream (no knockoff brands allowed). It is strongly encouraged that the menu include healthy options includingvegetarian, gluten free, salads etc. Size of each item should be included with the menu. Shouldthe Concession Operator have a food establishment open to the public, then pricing and size formenu item(s) should be the same as what is offered at that establishment.Health Regulations – The Concession Operator shall obtain all required Board of Health permitsand licenses and maintain the Concession stand in accordance with Board of Healthrequirements. It is the Concession Operator’s responsibility to schedule all required Board ofHealth inspections, prior to opening.The Concession Operator shall remove all garbage to the dumpsters on a regular basis, at leasttwice daily, and shall comply with all recycling requirements of the Borough.Security Deposit - The Concession Operator shall provide a Security Deposit to the Borough ofMadison of $3,000 (three thousand dollars) at the execution of the contract to ensure that allterms of the agreement are fulfilled.Concession Fee - Proposers shall list a proposed concession fee on the included proposal form.The Concession Operator shall make payment in accordance with the following schedule:• Prior to May 23, 202625% of Concession Fee• July 1st50% of Concession Fee• August 1st25% of Concession FeeCONTRACT FORMThe successful proposer shall be required to execute the Borough’s form of contract, whichshall include, but shall not be limited to, indemnification, insurance, termination and licensingprovisions.INSURANCE REQUIREMENTSThe vendor shall purchase and maintain such comprehensive general liability and otherinsurance as will provide protection and hold the Borough harmless from claims which mayarise out of or result from the vendors performance of the work and successful concessionaire’sother obligations under the contract including a) Worker’s Compensation in accordance with NJStatutes, b) comprehensive, personal liability, property damage coverage of $500,000.00 eachperson and $1 million each occurrence, and c) excess general liability umbrella coverage at aminimum of $2 million.COST QUALIFICATION – By submission of a proposed concession fee, proposers acknowledgeand agree to adhere to any contract amount limitations set forth herein.QUOTE EVALUATION – The Borough will select the most advantageous quote based ProposedConcession Fee, menu submitted, qualifications, experience and other factors that are in thebest interest of the Borough.FP-3QUOTETO BOROUGH OF MADISON:The undersigned having carefully examined the information submits this quote to provideConcession Operator services for the Madison Community Pool for the 2026 season.BUSINESS NAME OF THE PROPOSER: ____________________________________NAME OF AUTHORIZED SIGNATORY:____________________________________AUTHORIZED SIGNATORY SIGNATURE: __________________________________BUSINESS ADDRESS: __________________________________________________________________________________________________________DATE: _______________ PHONE #: ________________________E-MAIL ADDRESS: ____________________________________Annual Concession Fee (Rent) we will pay: $__________________Please attach a menu and any other relevant information.FP-4
