For further information, please contact CurtisMilton at 970-964-2444 or e-mail at cmilton@montrosecounty.net.Bidder InstructionsSubmitted bids must be enclosed in a sealed opaque envelope marked “2026 MagnesiumChloride Bid” with the name of the bidder and delivered to Montrose County Public Works,Attn: Brandon Wallace, 63160 LaSalle Rd, Montrose, CO 81401, no later than 2 p.m. localtime, March 24, 2026. The bids will be opened immediately thereafter and read aloud. Bidsreceived after the time due will not be considered and will be returned to the bidder un-opened.A 5% bid security is required with the bid as outlined in C.R.S. 24-105-201. The bid securityshall be placed in a separate envelop marked “Bid Security” that is either attached to theoutside of the bid envelope or placed in a larger envelope that contains both the sealed bidenvelope and the bid security envelope. Bids not including a bid security will not be consideredand will be returned to the bidder un-opened.Bids are to be submitted on the Bid Forms included within the bid package. Bidder must providethe Unit Bid Price, Item Total Bid Price and Total Bid Price on the Bid Schedule Form. In caseof discrepancy on the Bid Schedule Form, the Unit Bid Price governs.Any bid questions must be received by 2 pm local time, March 17, 2026.Any modifications to the Invitation to Bid package will be an Addendum and posted to theCounty website and distributed to all known bidders by 5 pm March 18, 2026. It is theresponsibility of the bidder to verify if an addendum has been issued. Bidder shall acknowledgeAddenda in the Bid and Addenda Acknowledgment section of the Bid Form.General ConditionsAll bids shall be irrevocable for 45 days from the date of the bid opening.The successful bidding Contractor will be required to enter into an agreement with MontroseCounty. A sample agreement is included in this bid package, but the final agreement may bealtered and/or contain additional or different provisions.A payment and performance bond equal to 100% of the bid amount will be required as outlinedin C.R.S. 38-26-106 and the contract agreement for the successful bidder.Contractor shall carry insurance coverage as outlined in the contract agreement.2Payment to Contractor will be made upon submission and approval of invoice(s). Payment willfollow normal County payment processing cycles for issuance of checks.Awarding of BidAward will be made to a responsive, responsible bidder meeting applicable county and stateprocurement requirements. In reviewing the bids received, the County reserves the right to reject,for any reason whatsoever, any and all bids, and to waive any informality or irregularity in a bid.The County reserves the right to accept the bid that provides the best value to the County in theCounty’s sole discretion. The County reserves the right to make a determination in the County’ssole discretion as to the sufficiency of qualifications of any bidder. The action to award acontract is subject to approval by the Board of County Commissioners. The submission of a biddoes not in any way commit the County to enter into an agreement or contract with that bidder.Bidder must identify for non-disclosure purposes, any information contained within the proposalthat is proprietary in nature or protected by copyright, trademark, or other intellectual propertylaw. Montrose County will maintain confidentiality of such materials to the extent permitted bylaw, the County is subject to the provisions of the Colorado Open Records Act (CORA), C.R.S.24-72-201, et seq., and cannot therefor guarantee that any materials provided will not beproduced in response to a CORA request.It is anticipated that award of the contract will be made within two (2) weeks of the bid opening.All bidders will be notified of the Commissioners’ decision. Within one week of award, anyrequired submittals will be due. A purchase order will be used for authorization to proceed.Requirements of Successful Bidder A payment and performance bond equal to 100% of the bid amount will be required asoutlined in C.R.S. 38-26-106 and the contract agreement. Furnish certificates of required insurance coverage. Furnish a completed Form W-9 “Request for Taxpayer Identification Number andCertification”. Enter into a contract agreement with Montrose County. Furnish an Equal Employment Opportunity Certification letter.Additional Terms and Scope of Services1. The magnesium chloride content shall be a minimum 30% (typical) and the solutionshall be in liquid form. The magnesium chloride solution shall not contain any othersubstance whose application to Montrose County roads would violate any Federal orState law or regulation.2. A Product Data Sheet and MSDS Sheet must be provided with each delivered shipment.33. The County, at its discretion, may take samples of the product and run a completechemical analysis. If the test results fail to meet the minimum specifications, MontroseCounty will have the option to seek remedy or terminate the contract.4. Consistent out-of-specification performance shall be sufficient grounds for terminationof the contract and claim for damages including claims against contractor’s bond.5. Anticipated liquid magnesium chloride solution quantities may be exceeded if theCounty has need, and has appropriated additional money to pay for the additional liquidmagnesium chloride solution.6. Actual gallons purchased will be dictated by required application rate, bid price,appropriated budget, and schedule.Delivery of Liquid Magnesium Chloride Solution:7. The delivery of liquid magnesium chloride solution shall be to the Montrose CountyPublic Works Facility at 63160 LaSalle Road, Montrose or other acceptable location thatis within 9 miles of 63160 LaSalle Road where the Montrose County distributor truckand tanker trucks can load the product.8. The liquid magnesium chloride solution shall be either delivered to 63160 LaSalle Roador made available at other acceptable location between 7:00 a.m. and 5:00 p.m. Mondaythrough Thursday, excluding County observed holidays, unless approved by the County.Bidder shall specify lead-time required from order placement until delivery on the bidform.9. County will place orders for product as needed. Each order will be a minimum of 3,000gallons.10. The majority of the product will be used during the months of April through July.11. All liquid magnesium chloride solution shall be priced F.O.B. destination.12. A notification of shipping shall be e-mailed to bwallace@montrosecounty.net.Contractor shall contact Montrose County at 970-252-7001 if an exception arises to thelead-time stated in the bid.13. A copy of the delivery slip detailing the chemical and quantity shall be provided to theCounty at the time of delivery.14. The first shipment of product should arrive and be available no later than April 14, 2026,unless a later date is agreed to by the County.15.
