Any questions submitted after thedeadline shall be rejected.1.3 Proposal Submission:To be considered, all proposals must be submitted in the manner set forth in the RFP.It is the Responder’s responsibility to ensure that its/their proposal arrives on or beforethe specified time. Proposers shall provide one (1) hard copy in a SEALED envelopec l e a r l y m a r k e d w i t h t h e P r o p o s a l N u m b e r , and one (1) PDF electroniccopy sent via email to the Purchasing Representative, Nicole Supan atnsupan@cityofventura.ca.gov. If discrepancies are found between the hard copy andthe PDF, the hard copy will provide the basis for resolving such discrepancies. If nodocument can be identified as the original, proposal may be rejected at the discretionof the City.No oral, telegraphic, electronic, facsimile, or telephonic proposals or modificationswill be considered in the absence of a hard copy sealed proposal.Proposals received after the scheduled submittal deadline will be returned.Proposals postmarked prior to submittal deadline, but received after the deadline, willbe returned.1.4 Elevated Consultant InterviewsThe City may elect, at its option, to elevate the most qualified firms to an interviewphase.1.5 Proposal Format:Proposals must be submitted in the format described in the Proposal Format andRequirements Section No. 3.2. Proposals must be completed in all respects asrequired in the Proposal Format and Requirements Section. Proposals are to beRequest for Proposal No. P-130000788BSafe Sleep Programprepared in such a way as to provide a straightforward, concise description ofcapabilities to satisfy the requirements of the RFP. Expensive binding, coloreddisplays, promotional materials, etc., are not necessary or desired. Emphasis shouldbe concentrated on conformance to the RFP instructions, responsiveness to theRFP requirements, and on completeness and clarity of content. A proposal maynot be considered if it is conditional or incomplete.1.6 ContractA copy of the City of Ventura’s Professional Services Agreement, Attachment “B” isincluded herein, as it will be the document executed into a final contract betweenthe City and the awarded Contractor. You do not have to return Attachment “B” withyour proposal submission; the sample Professional Services Agreement is provided forreference only and does not have to be returned with the bid.1.7 Insurance Requirements:Successful firm shall provide insurance as noted in Exhibit “C” of Attachment “B”Professional Services Agreement.1.8 Term of Agreement:The initial term of this Agreement shall commence on January 1, 2026 (or “EffectiveDate”) and will continue for a period of three (3) years. The City may elect at its ownoption to renew this Agreement for an additional two (2) in one-year increments. Initialterm, plus any option to extend shall not exceed a total of five years.1.9 Agreement Prices:Unless otherwise stated, prices are maximum for the term of the Contract. Priceadjustments, if allowed under this Contract, must be requested in writing andaccompanied by the required information to substantiate the request for priceadjustment, as set forth in the Contract. Any allowable request for price adjustmentmust be delivered to the CITY at least 30 days before the adjusted prices becomeeffective. No price adjustment allowable under this Contract will be grantedretroactively. The CITY must also be given the benefit of any decline in prices. If anyprice increase is granted by the CITY, the increase shall not be greater than theConsumer Price Index (CPI) from the current year.1.10 Bidder’s SecurityA bid deposit in the amount of 10% of the bid is NOT required for this RFP.1.11 Faithful Performance BondA surety bond conditioned upon the faithful performance of the contract is NOTrequired for this RFP.1.12 Subcontracting:No Subcontracting any portion of Contractor’s duties under this agreement withoutprior written consent of the City.Request for Proposal No. P-130000788BSafe Sleep Program1.13 California Public Records ActAll submissions will be considered public documents under applicable state law exceptto the extent that portions of the submissions are otherwise protected under state law.Proposers should segregate any proprietary or confidential material and provide anexplanation as to why such information should not be deemed a public record, citing theapplicable portion of the California Public Records Act.1.14 Communication with City Staff or Elected City Representatives:Any communication with City staff or City Elected Representatives, except for thePurchasing and Contracts Division, regarding this RFP is prohibited. Disregard of thisprovision could result in rejection of the proposal.
