As a result, school bus parking lot areas to be crack sealed, sealcoated and restriped are not eligible for federal and state transit funding. Therefore, local fundingwill be applied to completing work requirements for school bus parking areas and project alternatesare identified in the bid price section of this Invitation to Bid to separate the eligible and ineligiblecosts associated with grant funding.2.2 Danville Public Schools Transportation only maintains one week during the year from April 3,2026, through April 10, 2026, when they do not operate school buses and when it is warm enough tocrack seal and seal coat pavement. Consequently, all work must be completed during thistimeframe. Due to the possibility of weather conditions, certain project areas may be unable to becompleted. Therefore, base bid and project alternate pricing are required for each of the three (3)phased project areas.2.3 Danville Public Schools Transportation will relocate all buses from the parking lot areas onThursday, April 2, 2026. Interested vendors can complete work requirements on Saturday andSunday the weekend of Friday, April 3. However, all work must be completed by the end of the dayon Friday, April 10th. Danville Public Schools Transportation will relocate school buses back to theparking lot areas on Saturday, April 11, 2026.2.4 Danville Transit will be operational the week of April 3, 2026, through April 10, 2026. As a result,it is recommended that the project be completed in three (3) phases. Please see Exhibit 1 forplanned phasing information.2.5 The project will be awarded based on the lump sum low bid price received to complete the basebid and alternate parking lot areas. If certain areas cannot be completed due to weatherconditions and project timeframe constraints, then the contractor will be paid for the parkinglot areas that are completed. Please see Exhibit 2 that identifies the base bid areas whereDanville Transit buses are parked and the project alternate areas where school buses are parked.Danville Transit staff will relocate transit buses to support project objectives.3.0 SUPPLEMENTAL GENERAL CONDITIONS3.1 Compliance: The Contractor shall comply with the provisions of the following:The City of Danville’s “Standard Requirements & Instructions for Bidding”, Version3.0, dated July 1, 2025. Copies may be obtained from the Purchasing Office or bydownloading from the City’s website “Finance Department, Purchasing Division.3.2 Award:A. The award will be made to the lowest responsible and responsive bidder, withconsideration given to completion time.B. The City reserves the right to reject any or all offers and to waive informalities andminor irregularities in offers received.C. The award will be made to the proposal conforming to the IFB 25-26-063 and will bemost advantageous to the City.QB- 25-26-0633.3 Authority:“Crack Seal, Seal Coat and Restripe Mass Transit Parking Lot Area”A. The Director of Purchasing as the designee of the City Manager has the soleresponsibility and authority for negotiating, placing, and when necessary, modifyingeach and every invitation to bid, purchase order or other award issued by the City ofDanville. In the discharge of these responsibilities, the Director of Purchasing may beassisted by assigned buyers. No other City officer or employee is authorized to ordersupplies or services, enter into purchase negotiations, or in any way obligate thegovernment of the City of Danville for any indebtedness. Any purchases contrary tothese provisions and authorities shall be void and the City shall not be bound thereby.B. This procurement process, including withdrawal of bids and appeal or protests, is governedby the "PROCUREMENT CODE OF THE CITY OF DANVILLE, VIRGINIA". Copies of theProcurement Code may be obtained by writing the City of Danville Purchasing Department,427 Patton St. Room 304, Danville, Virginia 24541 and by downloading from the City’swebsite, Finance Department, Purchasing Division. The City of Danville does notdiscriminate against faith-based organizations.3.4 Method of Bid Submission:A. Bids will not be accepted both electronically and on paper. Each bidder must chooseonly one method of submission to avoid any confusion or duplication of entries. Thelatest dated and time stamped bid will be the only bid accepted and evaluated.No bid may be considered if received after the time shown on the title page. Theallowable methods for submitting are electronic and paper submission.B. Paper Submission: Bid proposals must be written in ink or typewritten and shall besubmitted on the forms issued. SCC NumberContractors organized as a stock or nonstock corporation, limited liability company,business trust, or limited partnership or registered as a registered limited liabilitypartnership shall be authorized to transact business in the Commonwealth as adomestic or foreign business entity if so required by Virginia Title 13.1 or Title 50 oras otherwise required by law. A Contactor organized or authorized to transactQB- 25-26-063“Crack Seal, Seal Coat and Restripe Mass Transit Parking Lot Area”business in the Commonwealth pursuant to Virginia Title 13.1 or Title 50 shall includein its bid or proposal the identification number issued to it by the State CorporationCommission. Any bidder or offeror that is not required to be authorized to transactbusiness in the Commonwealth as a foreign business entity under Title 13.1 or Title50 or as otherwise required by law shall include in its bid or proposal a statementdescribing why the bidder or offeror is not required to be so authorized.3.5 Bidder Eligibility:A. Bidders are required to submit evidence that they have practical knowledge of theparticular work bid upon and that they have the financial resources to complete theproposed work. Failure on the part of any Bidder to carry out previous contractssatisfactorily, or lack of experience or equipment necessary for the satisfactory andtimely completion of this Project, may be deemed sufficient cause for disqualification ofsaid Bidder.B. The Bidder must readily and independently document that the Bidder possesses theexperience, equipment and financial resources necessary for a timely andprofessional completion of this project.C. Irregular Bid Proposals: Bid proposals shall be considered irregular for the followingreasons:1. If the bid is on a form other than that furnished by the City, if the City’s form isaltered, or if any part of the proposal form is detached.2. If there are unauthorized additions, conditional or alternate pay items, orirregularities of any kind which make the proposal incomplete, indefinite, orotherwise ambiguous.3. If the bid does not contain a unit price for each pay item listed in the proposal.4. If the bid contains unit prices that are obviously unbalanced.5. If the bid is not accompanied by the proposal guaranty specified by the City.D. Withdrawal of Bid Due to Error:1. A bidder for a City construction contract, other than a contract for construction ormaintenance of public highways, may withdraw his bid from consideration, if theprice bid was substantially lower than the other bids due solely to a mistake therein,provided the bid was submitted in good faith and the mistake was a clerical mistake,as opposed to a judgment mistake, and was actually due to an unintentionalarithmetic error or an unintentional omission of a quantity of work, labor, or materialmade directly in the compilation of the bid, which unintentional arithmetic error orunintentional omission can be clearly shown by objective evidence drawn from
