Anyone objecting to this purchase shall follow theprocedures outlined below.1. Commodity or commodities to be purchased (make, model, description):Bruker Elute DAD, including flow cell 1850690A diode array detector module for the Bruker Elute UPLC system, directly compatible with theUPLC system and Bruker Compass HyStar 6.2 Version 6.2.1.13 software.2. Explanation of the need to be fulfilled by this item(s), how is it unique from all otheroptions, and why it is the only one that can meet the specific needs of the department:This is an upgrade module for an Elute UPLC currently housed in the Chemistry Departmentthat currently only has a HRMS detector, so the DAD allows a different detection mode to beobtained with the current instrument to obtain additional chemical insights.This specific item is needed as it must be compatible with the current instrument and therelated instrument control and data processing software.3. Name of company/individual selling the item and why that source is the only possiblesource that can provide the required item(s):BrukerThe current UPLC system in the department is a Bruker Elute system and compatibility with thecurrent hardware and software is critical.4. Estimated cost of item(s) and an explanation why the amount to be expended is consideredreasonable:$11,700This price reflects a reasonable price, as the product meets the performance needs of theDepartment, is compatible with current software/hardware, and fits within the instrumentationbudget of the funding source.5. Explanation of the efforts taken by the department to determine this is the only source andthe efforts used to obtain the best possible price:An internet search was performed with no alternatives found. Two refurbished lab equipmentvendors were contacted (IET ltd and GenTech Scientific), but neither could offer an equivalentDAD module with definitive compatibility with the current instrument and software.Discussions with Bruker then proceeded to obtain the best possible quoted price.Any person or entity that objects and proposes that the commodity listed is not sole source andcan be provided by another person or entity shall submit a written notice to:Jennifer Mayfield, CPPODirector of Procurement & Contractsjmayfield@procurement.msstate.eduSubject Line must read “Sole Source Objection”The notice shall contain a detailed explanation of why the commodity is not a sole sourceprocurement. Appropriate documentation shall also be submitted if applicable.If after a review of the submitted notice and documents, MSU determines that the commodityin the proposed sole source request can be provided by another person or entity, then MSU willwithdraw the sole source request publication from the procurement portal website and submitthe procurement of the commodity to an advertised competitive bid or selection process.If MSU determines after review that there is only one (1) source for the required commodity,then MSU will appeal to the Public Procurement Review Board. MSU will have the burden ofproving that the commodity is only provided by one (1) source.
