No late submissions will be accepted.GLOSSARYThe following definitions shall apply to and are used in this Request for Qualifications:"Qualified Respondent" - refers to a Respondent who (in the sole judgment of PVSC) hassatisfied the qualification criteria set forth in this RFQ."RFQ" - refers to this Request for Qualifications, including any amendments thereof orsupplements thereto.“Selected Respondent” or "Consultant" – refers to the Qualified Respondent selected by PVSCfor the award of a contract to be eligible for assignment to provide Services."Services" - refers to the service assignments to be provided by the Selected Respondent for thePROFESSIONAL CONSULTING SERVICES ON AN AS NEEDED BASIS in accordance with theprovisions of this RFQ and the contract to be prepared by PVSC.“PVSC Teleconferencing Application” – refers to the electronic conduct of meetings orinterviews in accordance with protocols consistent with COVID-19 Emergency regulations orprocedures issued by the State of New Jersey and/or PVSC.I. INTENTThe Passaic Valley Sewerage Commission (“PVSC”) is requesting Statement of Qualificationsfrom interested and qualified consulting firms for professional services as identified herein.Sealed proposals will be received and opened at the times, dates and place set forth in the noticeattached at Page 2 hereof.The General Qualification Criteria articulated herein at Section IV for the selection ofPROFESSIONAL CONSULTING SERVICES ON AN AS NEEDED BASIS have beenspecifically approved by PVSC. Those criteria and the other requirements herein are intendedto be non-restrictive for the purpose of obtaining participation of qualified professionals anduniformity in the manner of submission of proposals.Per N.J.S.A. 58:14-1 et seq., PVSC shall be the sole judge concerning the criteria set forth hereinand the merits of the statement of qualifications submitted as well as the sole judge of the benefitsto PVSC represented by the submissions pursuant to this Request.Copies of this RFQ and associated reference documents may be obtained from the followingPVSC representative:Thomas Fuscaldo, PVSC Purchasing Agent600 Wilson AvenueNewark, NJ 07105Phone: (973) 817-5702Email: tfuscaldo@pvsc.comRFQ Document available for download at:https://nj.gov/pvsc/home/rfps/index.htmlII. INSURANCEEach respondent shall have the following insurance coverage at a minimum:1. Statutory Workers’ Compensation Insurance in compliance with the laws of the State ofNew Jersey $500,000 / $500,000 / $500,000 and Employers Liability Coverage in the amountof $1,000,000.2. Comprehensive General Liability and Bodily Injury Insurance including death$1,000,000 each occurrence. Combined Single Limit of $1,000,000 for each occurrence. ThePassaic Valley Sewerage Commission shall be named as an additional insured.3. Comprehensive Automobile Liability, Bodily Injury, Property Damage Insurance$1,000,000 each occurrence. Combined Single Limit $1,000,000 each occurrence. ThePassaic Valley Sewerage Commission shall be named as an additional insured.4. Professional Liability Insurance for $5,000,000 per claim and annual aggregate.Attached hereto as Attachment A is the Certification of Insurance. The Certification must beexecuted and documents attached thereto by the respondent to the extent that the respondentbelieves that the attachment of such documents provides proof of insurance for appropriatepurposes. Declaration pages shall be attached showing current coverages. It shall be theresponsibility of the respondent/professional to provide PVSC with additional declaration pagesof insurance in compliance with this paragraph showing current coverage when any insurancepolicy expires. Submission of proof of the required insurance coverage in the form of acertificate or certificates of insurance is a continuing condition precedent to service by theprofessional.III. NEW JERSEY STATE LAW REQUIREMENTSA. Public Law 2005, Chapter 51, formerly EXECUTIVE ORDER No. 134 (2004)1. Requirements. In order to safeguard the integrity of New Jersey StateGovernment procurement by imposing restrictions to insulate the award of Statecontracts from political contributions that pose the risk of improper influence, purchaseof access, or the appearance thereof, by Public Law 2005, C.51 (hereinafter, “Chapter51”) requires the submission of the Certification and Disclosure Form in Attachment Dand the Statement of Ownership in Attachment E. The terms and conditions set forth inthis Section are material terms of an Agreement with PVSC.2. Definitions. For the purpose of this Section, the following definitions shall bein force:a) Contribution – means a contribution reportable by the recipient under “The NewJersey Campaign Contributions and Expenditures Reporting Act.” P.L. 1973, c. 83(C.19:44A-1 et seq.), and implementing regulations set forth at N.J.A.C. 19:25-7 andN.J.A.C. 19:25-10.1 et seq. As of January 1, 2005, contributions in excess of $300during a reporting period are deemed “reportable” under these laws for all contractsawarded in excess of $17,500.00 after October 15, 2004.b) Business Entity – means any natural or legal person, business corporation,professional services corporation, Limited Liability Company, partnership, limitedpartnership, business trust, association or any other legal commercial entity organizedunder the laws of New Jersey or any other state or foreign jurisdiction. It also includes(i)all principals who own or control more than 10 percent of the profits or assets of abusiness entity or 10 percent of the stock in the case of a business entity that is acorporation for profit, as appropriate; (ii)any subsidiaries directly or indirectlycontrolled by the business entity; (iii)any political organization organized under 26U.S.C.A. Section 527 that is directly or indirectly controlled by the business entity,other than a candidate committee, election fund, or political party committee; and
