Representation Regarding Gratuities and KickbacksThe bidder, offeror, or contractor represents that it has not violated, is not violating, and promises that it will not violate theprohibition against gratuities and kickbacks set forth in §11206 (Gratuities and Kickbacks) of the Guam ProcurementRegulations.”2. Representation Regarding Contingent FeesThe contractor represents that it has not retained a person to solicit or secure a territorial contract upon an agreement orunderstanding for a commission, percentage, brokerage, or contingent fee, except for retention of bona fide employees orbona fide established commercial selling agencies for the purpose of securing business.3. Representation Regarding Ethical Standards for Government Employees and Former Government EmployeesThe bidder, offeror, or contractor represents that it has not knowingly influenced and promises that it will not knowinglyinfluence a government employee to breach any of the ethical standards set forth in 5 GCA Chapter 5 Article 11 (Ethics in PublicContracting) of the Guam Procurement Act and in Chapter 11 of the Guam Procurement Regulations.4. Restriction Against Contractors Employing Convicted Sex Offenders From Working at Government of Guam Venues(1) no person providing services on behalf of the contractor has been convicted of a sex offense under the provisions ofChapter 25 of Title 9 GCA or an offense as defined in Article 2 of Chapter 28, Title 9 GCA, or an offense in anotherjurisdiction with, at a minimum, the same elements as such offenses, or who is listed on the Sex Offender Registry; and(2) if any person providing services on behalf of the contractor is convicted of a sex offense under the provisions of Chapter25 of Title 9 GCA or an offense as defined in Article 2 of Chapter 28, Title 9 GCA or an offense in another jurisdiction with,at a minimum, the same elements as such offenses, or who is listed on the Sex Offender Registry, that such person willbe immediately removed from working at said agency and that the administrator of said agency be informed of suchwithin twenty-four (24) hours of such conviction.Article II – Debarment and Suspension5. Debarment and Suspension. Code of Federal Regulations (CFR) 2 CFR Part 200 §200.214(Executive Orders 12549 and 12689)—A contract award (see 2 CFR 180.220) must not be made to parties listed on thegovernment wide exclusions in the System for Award Management (SAM), in accordance with the OMB guidelines at 2 CFR180 that implement Executive Orders 12549 (3 CFR part 1986 Comp., p. 189) and 12689 (3 CFR part 1989 Comp., p. 235),“Debarment and Suspension.” SAM Exclusions contains the names of parties debarred, suspended, or otherwise excluded byagencies, as well as parties declared ineligible under statutory or regulatory authority other than Executive Order 12549. TheAwardee certifies that neither it nor its principals are presently debarred, suspended, proposed for debarment, declaredineligible, or voluntarily excluded from participation in this transaction by any federal, state, or local government. If, at anytime during the term of this contract, the Contractor becomes debarred or suspended, the Contractor shall immediately notifyGSA in writing.Article III - Delivery Terms6. Required Delivery Date.Service shall commence within ninety (90) days of receipt of purchase order.7. Additional RequirementsSolution must include two (2) physical appliances, 1 EA for primary and 1 EA for High Availability ____________________________Installation and configuration must include at least one (1) week of on-site services performedby a manufacture Certified Engineer or authorized representative____________________________Bidder must migrate and enhance configurations from existing GovGuam firewall HA appliance. ____________________________Bidder must migrate and configure routes and configurations from existing internal firewall,to new firewall HA appliance____________________________Solution must be implemented to meet the baseline controls of the National Institute ofStandards and Technology (NIST) Special Publication 800-53 Revision 5. Solution must beFIPS-Compliant.____________________________Minimum of seven (7) days of log retention on local appliance; archived logs shall be configuredto push to a syslog server.____________________________Bidder must be authorized and a direct manufacturer authorized reseller of fully assembledequipment.____________________________Bidder must have design and deployment experience in Public Sector grade cybersecurity.____________________________On-site installation services must include knowledge transfer and training for a minimum of ten(10) people.
